Promises of indemnity are found in many kinds of commercial contracts, not just contracts of insurance. This book examines the nature and effect of contractual indemnities outside the insurance context. It is the first work to provide a detailed account of the subject in English law. The book presents a coherent theory of the promise of indemnity while also addressing important practical issues, such as the construction of contractual indemnities. The subject is approached from two perspectives. The foundations are laid by examining general principles applicable to indemnities in various forms. This covers the nature of indemnity promises; general principles of construction; the determination of scope; and the enforcement of indemnities. The approach then moves from the general to the specific, by examining separately particular forms of indemnity. Included among these are indemnities against liability to third parties, and indemnities against default or non-performance by third parties. The book states English law but it draws upon a considerable amount of material from other common law jurisdictions, including Australia, Canada, New Zealand and Singapore. It will appeal to readers from those countries.

Slavery, Emancipation and Colonial Rule in South Africa examines the rural Cape Colony from the earliest days of Dutch colonial rule in the mid-seventeenth century to the outbreak of the South African War in 1899. For slaves and slave owners alike, incorporation into the British Empire at the beginning of the nineteenth century brought fruits that were bittersweet. The gentry had initially done well by accepting British rule, but were ultimately faced with the legislated ending of servile labor. To slaves and Khoisan servants, British rule brought freedom, but a freedom that remained limited. The gentry accomplished this feat only with great difficulty. Increasingly, their dominance of the countryside was threatened by English-speaking merchants and money-lenders, a challenge that stimulated early Afrikaner nationalism. The alliances that ensured nineteenth-century colonial stability all but fell apart as the descendants of slaves and Khoisan turned on their erstwhile masters during the South African War of 1899-1902.

Cannabis, marijuana, pot, ganja - it goes by many names — is by far the most widely used illegal substance, and accounts for more arrests than any other drug. Barely a week goes by without this drug appearing in the newpapers, and politicians have famously tied themselve in knots, trying to decide just how to deal with this recreational drug. While there have been many drug policy books on other substances - both legal and illegal, few have focused on this drug. Cannabis Policy: Moving beyond Stalemate is unique in providing the materials needed for deciding on policy about cannabis in its various forms. It reviews the state of knowledge on the health and psychological effects of cannabis, and its dangerousness relative to other drugs. It considers patterns and trends in use, the size and character of illicit markets, and the administration of current policies, including arrests and diversion to treatment, under the global prohibition regime. It looks at the experience of a number of countries which have tried reforming their regimes and softening prohibition, exploring the kinds of changes or penalties for use for possession: including depenalization, decriminalization, medical control, and different types of legalization. It evaluates such changes and draws on them to assess the effects on levels and patterns of use, on the market, and on adverse consequences of prohibition. For policymakers willing to look outside the box of the global prohibition regime, the book examines the options and possibilities for a country or group of countries to bring about change in, or opt out of, the global control system. Throughout, the book examines cannabis within a global frame, and provides in accessible form information which anyone considering reform will need in order to make decisions on cannabis policy (much of which is new or has not been readily available). Orwell was wrong. Sports are not "war without the shooting", nor are they "war by other means." To be sure sports have generated animosity throughout human history, but they also require rules to which the participants agree to abide before the contest. Among other things, those rules are supposed to limit violence, even death. More than anything else, sports have been a significant part of a historical "civilizing process." They are the opposite of war. As the historical profession has taken its cultural turn over the last few decades, scholars have turned their attention to subject once seen as marginal. As researchers have come to understand the centrality of the human body in human history, they have come to study this most corporeal of human activities. Taking early cues from physical educators and kinesiologists, historians have been exploring sports in all their forms in order to help us answer the most fundamental questions to which scholars have devoted their lives. We have now seen a veritable explosion excellent work on this subject, just as sports have assumed an even greater share of a globalizing world's cultural, political and economic space. Practiced by millions and watched by billions, sports provide an enormous share of content on the Internet. This volume combines the efforts of sports historians with essays by historians whose careers have been devoted to more traditional topics. We want to show how sports have evolved from ancient societies to the world we inhabit today. Our goal is to introduce those from outside this sub-field to this burgeoning body of scholarship. At the same time, we hope here to show those who may want to study sport with rigor and nuance how to embark on a rewarding journey and tackle profound matters that have affected and will affect all of humankind.

There has been a recent explosion of research incorporating a spatial dimension in environmental and natural resource economics, where the spatial aspects of human behaviour or the natural environment make a crucial difference in the analysis and policy response to the problem. Much of this research has been driven by the growing availability of spatially explicit social science data and the development of tools and methodological advances to use these data. Collected in this volume are 24 key articles considering the reasons for spatial variation in policies, due to either efficiency or equity considerations, and the consequences of that spatial variation for both environmental and economic outcomes. These articles demonstrate that the failure to address spatial issues in the analysis can create two problems: (1) the analysis provides a poor basis for predicting actual behaviour that is specifically based upon spatial considerations, and (2) the analysis fails to provide a basis for designing spatially targeted policies that could lead to more efficient outcomes.

For much of history, the rules of war decreed that "to the victor go the spoils." The winners in warfare routinely seized for themselves the artistic and cultural treasures of the defeated; plunder constituted a marker of triumph. By the twentieth century, international norms declared the opposite, that cultural monuments should be shielded from destruction or seizure. Prohibiting Plunder traces and explains the emergence of international rules against wartime looting of cultural treasures, and explores how anti-plunder norms have developed over the past 200 years. The book covers highly topical events including the looting of thousands of antiquities from the Iraqi National Museum in Baghdad, and the return of "Holocaust Art" by prominent museums, including the highly publicized return of five Klimt paintings from the Austrian Gallery to a Holocaust survivor. The historical narrative includes first-hand reports, official documents, and archival records. Equally important, the book uncovers the debates and negotiations that produced increasingly clear and well-defined anti-plunder norms. The historical accounts in Prohibiting Plunder serve as confirming examples of an important dynamic of international norm change. Rules evolve in cycles; in each cycle, specific actions trigger arguments about the meaning and application of rules, and those arguments in turn modify the rules. International norms evolve through a succession of such cycles, each one drawing on previous developments and each one reshaping the normative context for subsequent actions and disputes. Prohibiting Plunder shows how historical episodes interlinked to produce modern, treaty-based rules against wartime plunder of cultural treasures.
