PROSE Award- Psychology Finalist A timely and important contribution to the study of immigration court from a psychological perspective Every day, large numbers of immigrants undertake dangerous migration journeys only to face deportation or “removal” proceedings once they arrive in the U.S. Others who have been in the country for many years may face these proceedings as well, and either group may seek to gain lawful status by means of an application to USCIS, the benefits arm of the immigration system. Mental Health Evaluations in Immigration Court examines the growing role of mental health professionals in the immigration system as they conduct forensic mental health assessments that are used as psychological evidence for applications for deportation relief, write affidavits for the court about the course of treatment they have provided to immigrants, help prepare people emotionally to be deported, and provide support for immigrants in detention centers. Many immigrants appear in immigration court—often without an attorney if they cannot afford one—as part of deportation proceedings. Mental health professionals can be deeply involved in these proceedings, from helping to buttress an immigrant’s plea for asylum to helping an immigration judge make decisions about hardship, competency or risks for violence. There are a whole host of psycho-legal and forensic issues that arise in immigration court and in other immigration applications that have not yet been fully addressed in the field. This book provides an overview of relevant issues likely to be addressed by mental health and legal professionals. Mental Health Evaluations in Immigration Court corrects a serious deficiency in the study of immigration law and mental health, offering suggestions for future scholarship and acting as a vital resource for mental health professionals, immigration lawyers, and judges.

What is terrorism? How is it different from other kinds of political violence? Why exactly is it wrong? Why is war often thought capable of being justified? On what grounds should we judge when the use of violence is morally acceptable? It is often thought that using violence to uphold and enforce the rule of law can be justified, that violence used in self-defense is acceptable, and that some liberation movements can be excused for using violence--but that terrorism is always wrong. How persuasive are these arguments, and on what bases should we judge them? How Terrorism is Wrong collects articles by Virginia Held along with much new material. It offers a moral assessment of various forms of political violence, with terrorism the focus of much of the discussion. Here and throughout, Held examines possible causes discussed, including the connection between terrorism and humiliation. Held also considers military intervention, conventional war, intervention to protect human rights, violence to prevent political change, and the status and requirements of international law. She looks at the cases of Rwanda, Kosovo, Iraq, and the Israeli/Palestinian conflict. Finally, she explores questions of who has legitimate authority to engage in justifiable uses of violence, whether groups can be responsible for ethnic violence, and how the media should cover terrorism. Held discusses appropriate ways of engaging in moral evaluation and improving our moral recommendations concerning the uses of violence. Just war theory has been developed for violence between the military forces of conflicting states, but much contemporary political violence is not of this kind. Held considers the guidance offered by such traditional moral theories as Kantian ethics and utilitarianism, and also examines what the newer approach of the ethics of care can contribute to our evaluations of violence. Care is obviously antithetical to violence since violence destroys what care takes pains to build; but the ethics of care recognizes that violence is not likely to disappear from human affairs, and can offer realistic understandings of how best to reduce it.

The 1989 International Convention on the Rights of the Child (CRC) and the 1990 African Charter on the Rights and Welfare of the Child (ACRWC) are two major international treaties protecting minors. Each treaty gives rise to new perspectives on children’s rights, and enshrine the principles of the best interests of the child and of children’s ownership of rights. The ACRWC incorporates the CRC’s rights while taking into consideration the specificity of the African context, striving to balance the rule of law with local customs. This book seeks to illustrate the rights and duties enshrined in the ACRWC, as well as the responsibilities established therein regarding the protection of minors. The role of the African Committee of Experts on the Rights and Welfare of the Child (ACERWC) will also be examined, in particular its activity of monitoring the States Parties’ implementation of the ACRWC and its institutional powers in exercising its powers. Finally, the book will analyse the progress made by the States Parties to the treaties. The focus will be both on the formal aspect of harmonizing national legal systems and the international rights, and on the substantive “steps required” of States Parties to reach the “opinion of law or necessity” that the ACRWC’s provisions should be perceived, first and foremost, as necessary and socially useful, as well as legally binding.

Here, a holistic approach to the funerary monuments allows for the integration of data from five different necropoleis and analysis of greater accuracy and scope. Author Virginia Campbell demonstrates that the funerary practices of Pompeii are, in some ways, unique in to the population, moving away from the traditional approach to burial based on generalizations and studies of typology. She shows that while some trends in Roman burial culture can be seen as universal, each population, time, and place constructs its own approach to commemoration and display. Including an extensive catalogue of tomb data and images never before assembled or published, this collective approach reveals new insights into ancient commemoration. The Tombs of Pompeii is the first English-language book on Pompeian funerary rituals. It’s also the first in any language to provide a complete survey of the tombs of Pompeii and the first to situate Pompeian differences within a wider Roman burial context.

The study, based on the principles of genre analysis, speech act theory applied to legal discourse and thick description of legal texts, was carried out on a corpus of ninety EU regulations on subjects (e.g. customs union, competition rules) that fall under the exclusive competence of the European Union according to the principle of conferral. The findings shed light on a new approach to hybridity in EU secondary legislation. EU regulations, which are hybrid legal texts, are inevitably influenced by the legal framework from which they originate and by the political and historical reasons that led the founding fathers of the former European Community to address the problem of the so-called 'democratic deficit' also from a textual point of view, and not only by means of economic and political strategies. The textual peculiarity of EU regulation is particularly significant when combined with the contractual nature of EU law. Thus, the results of this study support the hypothesis according to which EU regulations are an instrument created to regulate social behaviour and to address the phenomenon of the 'democratic deficit' from a textual perspective.
