Sports law has been growing with increasing rapidity over the years since the first edition of this book was published in 1999, regularly making headlines as well as leading to a developing body of law practised by specialist lawyers. The subject is split into various areas of practice: first, regulatory rules, which embrace the constitutional aspect of organised sport, including the disciplinary procedures of the various governing organisations; second, broadcasting and marketing resulting from the commercial exploitation, including sponsorship, of sports clubs, sporting events and players; and third, player's rights and obligations, which embraces a wide range of legal issues including club transfers and player contracts, and issues arising from employment (including discrimination law), personal injury and criminal law. Special attention is paid to the impact of EU and Human Rights law as well as to the influential jurisprudence of the Court of Arbitration for Sport. London 2012 provides an appropriate point at which to assess the current state of the law, as well as a look to the future. What do we owe to our descendants? How do we balance their needs against our own? Tim Mulgan develops a new theory of our obligations to future generations, based on a new rule-consequentialist account of the morality of individual reproduction. He argues that the resulting theory accounts for a wide range of independently plausible intuitions - covering individual morality, intergenerational justice, and international justice. In particular, the moderate consequentialist approach is superior to its two main rivals in this area - person-affecting theories and traditional consequentialism. The former fall foul of Parfit's Non-Identity Problem, while the latter are invariably implausibly demanding. Mulgan also claims that most puzzles in contemporary value theory (such as Parfit's Repugnant Conclusion) are actually puzzles in the theory of right action, and can only be solved if we abandon strict consequentialism for a more moderate alternative. The heart of the book is the first systematic exploration of the rule-consequentialist account of the morality of individual reproduction. Mulgan demostrates that this account is superior to all available alternatives, both consequentialist and non-consequentialist. Once we recognise the intergenerational dimension, moral and political philosophy cannot be considered in isolation. The latter must be founded on the former. Rule consequentialism provides the best foundation for a theory of intergenerational justice. Future People brings together several different contemporary philosophical discussions: obligations to future generations, the morality of individual reproduction, the demands of morality, and international justice. While the focus is on developing a new account, there are also substantial discussions of alternative views, especially contract-based accounts of intergenerational justice and competing forms of consequentialism.

A Defence of the Standard Conception of the Lawyer's Role

There is a widespread perception that even when lawyers are acting squarely within their roles, being good lawyers, they display the vices of dishonesty and deviousness. At the heart of the perception is the so called standard conception of the lawyer’s role according to which lawyers owe special duties to their clients which render permissible, or even mandatory, acts that would otherwise count as morally impermissible. Many have concluded that the standard conception should be set aside. This book suggests that the moral implications of the standard conception are often mischaracterised. Critics suggest that the conception requires lawyers to secure any advantage the law can be made to give. But Dare offers a moral argument for the conception, according to which it justifies a more limited and moderate sphere of professional conduct than is normally supposed, allowing lawyers to preserve their integrity while giving proper weight to the role-differentiated permissions and obligations of their roles.

Master's Thesis from the year 2015 in the subject Business economics - Business Management, Corporate Governance, grade: 1, , language: English, abstract: This study attempts to enhance the understanding of the liability of foreignness in the context of venture capitalists, hereafter VC, investing in emerging markets, hereafter EM, by drawing on case evidence from five cases. The outcomes of the study aim to provide VCs with a deep understanding of the investment environment within EM to lower the perceived risks and facilitate investments. The literature review revealed a lack of evidence for the main institutional pressures, their impact on VCs as well as the strategies used to mitigate the impact of the liability of foreignness. The main finding of the study is that a liability of foreignness exists for VCs due to political, legal and cultural pressures as well as a home bias. This leads to an increase in transaction costs. Furthermore, differences in the governance codes and business practices made it difficult for VCs to gain legitimacy within the EM while complying with all the rules and regulations of their home country. Furthermore, local adaptation through the establishment of local offices to gain access to local networks and resources was the favoured mitigation strategy of VCs. Superior firm resources were used to facilitate learning about the EM by attracting local entrepreneurs and leveraging the added value of such resources during negotiations. The relocation of the headquarters from a portfolio company operating in an emerging market to a developed country in order to access financial as well as human resources was identified as a new mitigation strategy.
