Tracing the interwoven traditions of modern welfare states in Europe over five centuries, Thomas McStay Adams explores social welfare from Portugal, France, and Italy to Britain, Belgium and Germany. He shows that the provision of assistance to those in need has faced recognizably similar challenges from the 16th century through to the present: how to allocate aid equitably (and with dignity); how to give support without undermining autonomy (and motivation); and how to balance private and public spheres of action and responsibility. Across two authoritative volumes, Adams reveals how social welfare administrators, critics, and improvers have engaged in a constant exchange of models and experience locally and across Europe. The narrative begins with the founding of the Casa da Misericordia of Lisbon in 1498, a model replicated throughout Portugal and its empire, and ends with the relaunch of a social agenda for the European Union at the meeting of the Council of Europe in Lisbon in 2000. Volume 1, which focuses on the period from 1500 to 1700, discusses the concepts of 'welfare' and 'tradition'. It looks at how 16th-century humanists joined with merchants and lawyers to renew traditional charity in distinctly modern forms, and how the discipline of religious reform affected the exercise of political authority and the promotion of economic productivity. Volume 2 examines 18th-century bienfaisance which secularized a Christian humanist notion of beneficence, producing new and sharply contested assertions of social citizenship. It goes on to consider how national struggles to establish comprehensive welfare states since the second half of the 19th century built on the power of the vote as politicians, pushed by activists and advised by experts, appealed to a growing class of industrial workers. Lastly, it looks at how 20th-century welfare states addressed aspirations for social citizenship while the institutional framework for European economic cooperation came to fruition

This is the first modern study of the Fellowship of Merchant Adventurers - England's most important trading company of the sixteenth century - in its final century of existence as a privileged organisation. Over this period, the Company's main trade, the export of cloth to northwest Europe, was overshadowed by rising traffic with the wider world, whilst its privileges were continually criticised in an era of political revolution. But the Company and its membership were not passive victims of these changes; rather, they were active participants in the commercial and political dramas of the century. Using thousands of neglected private merchant papers, Fellowship and Freedom views the Company from the perspective of its members, in the process bringing to life the complex social worlds of early modern merchants. For members, 'freedom' meant not just the right to access a privileged market, but also to trade independently, which could conflict with the 'fellowship' of corporate affiliation, and the responsibilities to the collective that it entailed. The study's major theme is the challenge of maintaining corporate unity in the face of this and other pressures that the Company faced. It restores the centrality of the Merchant Adventurers within three important historical narratives: England's transition from the margins to the centre of the European, and later global, economy; the rise and fall of the merchant corporation as a major form of commercial government in premodern Europe; and the political history of the corporation in an era of state formation and revolution.
The legal meaning of bankruptcy and insolvency law has often remained elusive, even to practitioners and scholars in the field, despite having been enshrined in Canada’s Constitution since Confederation. Federal jurisdiction in this area must be measured against provincial powers over property and civil rights, among others. Debt and Federalism traces changing conceptions of the bankruptcy and insolvency power through four landmark cases that form the constitutional foundation of the Canadian bankruptcy system: the 1894 Voluntary Assignments Case, Royal Bank of Canada v Larue in 1928, the 1934 Companies' Creditors Arrangement Act Reference Case, and the 1937 Farmers' Creditors Arrangement Act Reference Case. Together, these decisions ultimately produced the bedrock for modern understandings of bankruptcy and insolvency law. Thomas G.W. Telfer and Virginia Torrie draw on archival and legal sources to analyze the decisions from a historical and doctrinal perspective. This astute book demonstrates that the legal changes introduced by these landmark cases underpin contemporary bankruptcy and insolvency law and scholarship.
