Can the Supreme Court be free of politics? Do we want it to be? Normative constitutional theory has long concerned itself with the legitimate scope and limits of judicial review. Too often, theorists seek to resolve that issue by eliminating politics from constitutional decisionmaking. In contrast, Terri Peretti argues for an openly political role for the Supreme Court. Peretti asserts that politically motivated constitutional decisionmaking is not only inevitable, it is legitimate and desirable as well. When Supreme Court justices decide in accordance with their ideological values, or consider the likely political reaction to the Court's decisions, a number of benefits result. The Court's performance of political representation and consensus-building functions is enhanced, and the effectiveness of political checks on the Court is increased. Thus, political motive in constitutional decision making does not lead to judicial tyranny, as many claim, but goes far to prevent it. Using pluralist theory, Peretti further argues that a political Court possesses instrumental value in American democracy. As one of many diverse and redundant political institutions, the Court enhances both system stability and the quality of policymaking, particularly regarding the breadth of interests represented.

For John F. Ankeny and his wife, Sarah, the 80-acre tract they purchased in 1874 was perfect for the town they envisioned. It was surrounded by coal mines and farms and close to the state capital, and plans for a railroad through their property assured success. By 1881, the town had several homes and businesses and a 33¢ train fare into Des Moines. Through fires and war, Ankeny was nurtured by a strong sense of community and people whose names are still familiar today: superintendent Ed Neveln, the Kirkendall brothers, businessman "Uncle Henry" Wagner, and Charles Irvine and his world-champion Belgian horses. World War II brought further growth with the establishment of an ordnance plant on land now occupied by John Deere Des Moines Works. Ankeny now has more than 45,000 residents and an enviable quality of life. It is listed among the top 10 towns in the United States for families and, in 2012, was voted a "Playful City USA" for the sixth consecutive year.

Born in the northern region of the Sierra Nevada mountains, Marie Mason Potts (1895–1978), a Mountain Maidu woman, became one of the most influential California Indian activists of her generation. In this illuminating book, Terri A. Castaneda explores Potts’s rich life story, from her formative years in off-reservation boarding schools, through marriage and motherhood, and into national spheres of Native American politics and cultural revitalization. During the early twentieth century, federal Indian policy imposed narrow restrictions on the dreams and aspirations of young Native girls. Castaneda demonstrates how Marie initially accepted these limitations and how, with determined resolve, she broke free of them. As a young student at Greenville Indian Industrial school, Marie navigated conditions that were perilous, even deadly, for many of her peers. Yet she excelled academically, and her adventurous spirit and intellectual ambition led her to transfer to Pennsylvania’s Carlisle Indian Industrial School. After graduating in 1915, Marie Potts returned home, married a former schoolmate, and worked as a domestic laborer. Racism and socioeconomic inequality were inescapable, and Castaneda chronicles Potts’s growing political consciousness within the urban milieu of Sacramento. Against this backdrop, the author analyzes Potts’s significant work for the Federated Indians of California (FIC) and her thirty-year tenure as editor and publisher of the Smoke Signal newspaper. Potts’s voluminous correspondence documents her steadfast conviction that California Indians deserved just compensation for their stolen ancestral lands, a decent standard of living, the right to practice their traditions, and political agency in their own affairs. Drawing extensively from this trove of writings, Castaneda privileges Potts’s own voice in the telling of her story and offers a valuable history of California Indians in the twentieth century.

Regardless if it is a mother caring for a child with a developmental disability, a wife caring for a husband with a long term chronic illness, or a daughter sitting at the bedside of her father who is enrolled in hospice, family caregivers are the silent "other patient" in the health care drama. Healthcare providers who do not attend to the needs of the caregiver not only inflict interactional suffering, but dilute their treatment by not engaging the caregiver as a partner. In fact, they may unintentionally do harm as the caregiver flounders and thus patient treatment fails. As noted by one dying cancer patient in an educational YouTube video of his cancer journey, "there are two patients not one." If we are to eliminate the interactional suffering experienced by family caregivers, we must train both the caregiver and the health care team for the important interaction and roles that are required for the successful care of the patient. “I have no agenda,” US Supreme Court Chief Justice John Roberts proclaimed at his Senate confirmation hearing: “My job is to call balls and strikes and not to pitch or bat.” This declaration was in keeping with the avowed independence of the judiciary. It also, when viewed through the lens of Roberts’s election law decisions, appears to be false. With a scrupulous reading of judicial decisions and a careful assessment of partisan causes and consequences, Terri Jennings Peretti tells the story of the GOP’s largely successful campaign to enlist judicial aid for its self-interested election reform agenda. Partisan Supremacy explores four contemporary election law issues—voter identification, gerrymandering, campaign finance, and the preclearance regime of the Voting Rights Act—to uncover whether Republican politicians and Republican judges have collaborated to tilt America’s election rules in the GOP’s favor. Considering cases from Shelby County v. Holder, which enfeebled the Voting Rights Act, to Crawford v. Marion County Election Board, which upheld restrictive voter identification laws, to Citizens United and McCutcheon, which loosened campaign finance restrictions, Peretti lays bare the reality of “friendly” judicial review and partisan supremacy when it comes to election law. She nonetheless finds a mixed verdict in the redistricting area that reveals the limits of partisan control over judicial decisions. Peretti’s book helpfully places the current GOP’s voter suppression campaign in historical context by acknowledging similar efforts by the postCivil War Democratic Party. While the modern Democratic Party seeks electoral advantage by expanding voting by America’s minorities and youth, arguably hewing closer to democratic principles, neither party is immune to the powerful incentive to bend election rules in its favor. In view of the evidence that Partisan Supremacy brings to light, we are left with a critical and pressing question: Can democracy survive in the face of partisan collaboration across the branches of government on critical election issues?
