The Meese Revolution explores how Ed Meese became the most powerful and important Attorney General in American history. Edwin Meese III is the most influential person ever to hold the office of U.S. Attorney General – and almost no one knows it. Ed Meese was at the center of virtually every major accomplishment of Ronald Reagan’s transformative presidency, from winning the Cold War without firing a shot to the economic boom that by the end of the 1980s was the envy of the world. More to the point for this book, Ed Meese is the person most responsible for the rise of constitutional originalism, which treats the text and original meaning of the Constitution rather than the policy fads of the moment as authoritative law. In 2024, originalism is a major force in the courts, with a majority of Supreme Court justices and a raft of lower-court and state-court judges at least taking it seriously as a major contributor to decision-making. That result was unthinkable in 1985 when Meese took office and originalism was essentially unknown to the legal academy and almost wholly absent from the judicial process. Ed Meese turned the U.S. Department of Justice into “the academy in exile,” where originalism was developed, refined, theorized, and put into practice. This book describes the rise of originalism, which necessitates telling the story of Ed Meese, without whom it surely does not happen. Meese’s story threads through virtually all important legal and policy events of the 1980s, many of which continue to shape the world of the twenty-first century. We are still living through the Meese Revolution.

Debates over the proper relationship between church and state in America tend to focus either on the founding period or the twentieth century. Left undiscussed is the long period between the ratification of the Constitution and the 1947 Supreme Court ruling in Everson v. Board of Education, which mandated that the Establishment Clause applied to state and local governments. Steven Green illuminates this neglected period, arguing that during the 19th century there was a "second disestablishment." By the early 1800s, formal political disestablishment was the rule at the national level, and almost universal among the states. Yet the United States remained a Christian nation, and Protestant beliefs and values dominated American culture and institutions. Evangelical Protestantism rose to cultural dominance through moral reform societies and behavioral laws that were undergirded by a maxim that Christianity formed part of the law. Simultaneously, law became secularized, religious pluralism increased, and the Protestant-oriented public education system was transformed. This latter impulse set the stage for the constitutional disestablishment of the twentieth century. The Second Disestablishment examines competing ideologies: of evangelical Protestants who sought to create a "Christian nation," and of those who advocated broader notions of separation of church and state. Green shows that the second disestablishment is the missing link between the Establishment Clause and the modern Supreme Court's church-state decisions.

Steven K. Green, renowned for his scholarship on the separation of church and state, charts the career of the concept and helps us understand how it has fallen into disfavor with many Americans. In 1802, President Thomas Jefferson distilled a leading idea in the early American republic and wrote of a wall of separation between church and state. That metaphor has come down from Jefferson to twenty-first-century Americans through a long history of jurisprudence, political contestation, and cultural influence. This book traces the development of the concept of separation of church and state and the Supreme Court's application of it in the law. Green finds that conservative criticisms of a separation of church and state overlook the strong historical and jurisprudential pedigree of the idea. Yet, arguing with liberal advocates of the doctrine, he notes that the idea remains fundamentally vague and thus open to loose interpretation in the courts. As such, the history of a wall of separation is more a variable index of American attitudes toward the forces of religion and state. Indeed, Green argues that the Supreme Court's use of the wall metaphor has never been essential to its rulings. The contemporary battle over the idea of a wall of separation has thus been a distraction from the real jurisprudential issues animating the contemporary courts.

The time was the forties and fifties, when children of immigrants were striving to become American and find a place in a booming post–war world. The core of Steve's world was one block, where he lived in a house his grandfather, Harry Schanbam, had built with his own hands. But the story starts back in Russia, where the family business of writing and ideas began. Steve's other grandfather, Abraham Rogowsky, stole money to become a Zionist pioneer in Palestine before moving to America. The tale continues through the Depression, when Steve's parents lived one block apart in Bayonne, wrote letters to each other and married in secret. During the war years, Steve's father wrote children's books and based one of his best sellers on outings he took with his twin sons to the local train station. As his byline, he used his boys' middle names–Jeffrey Victor–so Steve got his first writing credit before he was two. The story concludes with the boy leaving Bayonne, going on to Harvard, meeting the Catholic girl who became his wife, and starting work at the New York Times–across the river, and worlds away, from where he began. Now a grandfather of five, Steve Roberts looks in the mirror and sees his own father and grandfather looking back at him–a family chain that started in 19th century Russia and thrives today in 21st century America.
