This book details the development of eleven modal auxiliaries in late 18th- and 19th-century Canadian English in a framework of new-dialect formation. The study assesses features of the modal auxiliaries, tracing influences to British and American input varieties, parallel developments, or Canadian innovations. The findings are based on the "Corpus of Early Ontario English," "pre-Confederation Section, "the first electronic corpus of early Canadian English. The data, which are drawn from newspapers, diaries and letters, include original transcriptions from manuscript sources and texts from semi-literate writers. While the overall results are generally coherent with new-dialect formation theory, the Ontarian context suggests a number of adaptations to the current model. In addition to its general Late Modern English focus, "New-Dialect Formation in Canada" traces changes in epistemic modal functions up to the present day, offering answers to the loss of root uses in the central modals. By comparing Canadian with British and American data, important theoretical insights on the origins of the variety are gained. The study offers a sociohistorical perspective on a still understudied variety of North American English by combining language-internal features with settlement history in this first monograph-length, diachronic treatment of Canadian English in real time.

Stefan Larsson's Conceptions in the Code makes a significant contribution to sociolegal analysis, representing a valuable contribution to conceptual metaphor theory. By utilising the case of copyright in a digital context it explains the role that metaphor plays when the law is dealing with technological change, displaying both conceptual path-dependence as well as what is called non-legislative developments in the law. The overall analysis draws from conceptual studies of "property" in intellectual property. By using Karl Renner's account of property, Larsson demonstrates how the property regime of copyright is the projection of an older regime of control onto a new set of digital social relations. Further, through an analysis of the concept of "copy" in copyright as well as the metaphorical battle of defining the BitTorrent site "The Pirate Bay" in the Swedish court case with its founders, Larsson shows the historical and embodied dependence of digital phenomena in law, and thereby how normative aspects of the source concept also stains the target domain. The book also draws from empirical studies on file sharing and historical expressions of the conceptualisation of law, revealing both the cultural bias of both file sharing and law. Also law is thereby shown to be largely depending on metaphors and embodiment to be reified and understood. The contribution is relevant for the conceptual and regulatory struggles of a multitude of contemporary socio-digital phenomena in addition to copyright and file sharing, including big data and the oft-praised "openness" of digital innovation.

Taking as a starting point the widely accepted view that states confronted with terrorism must find a proper equilibrium between their respective obligations of preserving fundamental rights and fighting terrorism effectively, this book seeks to demonstrate how the design and enforcement of a human rights instrument may influence the result of that exercise. An attempt is made to answer the question how a legal order's approach to the limitation of rights may shape decision-making trade-offs between the demands of liberty and the need to guarantee individual and collective security. In doing so, special attention is given to the difference between the adjudicative methods of balancing and categorisation. The book challenges the conventional wisdom that individual rights, in times of crisis, are better served by the application of categorical rather than flexible models of limitation. In addition, the work considers the impact of a variety of other factors, including the discrepancies in enforcing an international convention as opposed to a national constitution and the use of emergency provisions permitting derogations from human rights obligations in time of war or a public emergency. The research questions are addressed through a comparative study of the terrorism-related restrictions on five fundamental rights protected under the European Convention on Human Rights and the United States Constitution: the right to freedom of expression, the right to freedom of association, the right to personal liberty, the right to privacy, and the right to a fair trial. The book offers both a theoretical account of the paradoxical relationship between terrorism and human rights and a comprehensive comparative survey of the major decisions of the highest courts on both sides of the Atlantic.

The authors show how the parameters of Bayes’ theorem can be combined with a value function of health states in order to arrive at informed test and treatment decisions in the face of diagnostic and therapeutic risks. Distinguishing between risk-neutral, risk-averse, and prudent decision-makers, they demonstrate the effects of risk preferences on medical decisions. Furthermore, they analyze individual and multiple tests as well as diagnostic models in which the decision-maker chooses the test outcome. The consequences of test and treatment decisions for the patient are encompassed by quality-adjusted life years (QALYs) and the standard economic model, which applies the willingness to pay for health approach. Lastly, non-expected utility models of choice under risk and uncertainty are presented. Although these models can explain some of the test and treatment decisions observed, they are less suitable for normative analyses aimed at providing guidance on medical decision-making. This third edition provides extensively revised versions of all chapters and reflects recent innovations in medical decision-making such as decision curve analysis. New chapters focus on the health economics of and revealed preferences in medical decisions. The book is intended for students of (health) economics and medicine as well as for medical decision-makers and physicians dealing with uncertainty in their test and treatment decisions.

In Rhetoric, Poetics, and Literary Historiography, Stefan H. Uhlig offers a new account of the emergence of literary studies. Most histories of the early years of the field search for unifying origins of literature as a discipline and object of study. Uhlig turns to the decades around 1800 in Europe to reveal that the inception of the literary field was instead defined by intellectual diversity and contestation. He draws on an array of European writers to show how three schools of literary study—rhetoric teaching, theories of poetry, and literary history—emerged and clashed during this time, offering near-contemporaneous, yet divergent, visions of how to understand literature. Rhetoric and poetics thwarted criticism, to different ends, while literary historiography proved institutionally reassuring yet less useful as a tool for textual understanding. Uhlig details how Scottish writers like Adam Smith and Hugh Blair taught rhetoric as a form self-expression, while Anglophone and German theorists of poetry like William Wordsworth, Friedrich Schlegel, and Johann Wolfgang von Goethe both engaged with and resented critics. At the same time, varying opinions on the practice of literary history emerged, with Immanuel Kant and Thomas De Quincey arguing for the independence of literature from historical forces while writers like Matthew Arnold approached literature as a means of narrating cultural archives instead of drawing on close reading and analysis. Rhetoric, Poetics, and Literary Historiography traces current debates in literary studies back to this formative moment, serving as a guide to past and present controversies in the field.

Activities performed in organizations are coordinated via communication between the people involved. The sentences used to communicate are naturally structured by subject, verb, and object. The subject describes the actor, the verb the action and the object what is affected by the action. Subject-oriented Business Process Management (S-BPM) as presented in this book is based on this simple structure which enables process-oriented thinking and process modeling. S-BPM puts the subject of a process at the center of attention and thus deals with business processes and their organizational environment from a new perspective, meeting organizational requirements in a much better way than traditional approaches. Subjects represent agents of an action in a process, which can be either technical or human (e.g. a thread in an IT system or a clerk). A process structures the actions of each subject and coordinates the required communication among the subjects. This thesis sheds new light on the worldwide first electrical manipulation of a single nuclear spin. Over the last four decades, the size of a bit, the smallest logical unit in a computer, has decreased by more than two orders of magnitude and will soon reach a limit where quantum phenomena become important. Inspired by the power of quantum mechanics, researchers have already identified pure quantum systems, having, analog to a classical bit, two controllable and readable states. In this regard, the inherent spin of electrons or nuclei with its two eigenstates, spin up and spin down, is a promising candidate. Using expertise in the field of single-molecule magnets, the author developed a molecular transistor, which allows quantum information to be written onto a single nuclear spin by means of an electric field only, and, in addition, enables the electronic read-out of this quantum state. This novel approach opens a path to addressing and manipulating individual nuclear spins within a very confined space (a single molecule), at high speed. Thus, the author was able to show that single molecule magnets are promising candidates for quantum information processing, which is triggering a new field of research towards molecular quantum electronics.
