This casebook covers all topics in the first-year canon of civil procedure, and some topics in advanced litigation classes (e.g., class actions, appeals). The scholarly basis for this new model draws upon developments in international criminal law which first emerged from the Nuremberg trials and upon more recent interstate economic cooperation which has turned sovereign independence into interdependence across a range of state functions. Does this mean that traditional Westphalian concepts of sovereignty should be abandoned in constructing a new theory of world governance for the twenty-first century? Not at all. A new model, which can be called the pattern of interdependence-based sovereignty, serves to explain contemporary events that puzzle traditional theorists, such as the war over Kosovo, the invasions of Iraq and Libya, the emergence of a “Responsibility to protect” doctrine and its recent validation in Security Council Resolutions 1970 and 1973. We are witnessing the emergence of a new philosophy of action, which is in the process of producing a 21st century system of international relations. It has become apparent that a clear gap exists between European Union (EU) level policymaking and Member State implementation. Previous research has neglected to fully define factors that encourage or prevent implementation processes and instead focused on upstream decision making processes or downstream effects of policy. Simona Milio here proposes a shift in analytical focus towards policy-implementation since this constitutes a crucial common pathway that determines whether a policy actually becomes effective or not. EU implementation deficits appear to be influenced by problems related to the multi-level structure of European policy making. Successful implementation will only occur if relevant policy actors at national and sub-national levels are persuaded to co-operate with EU policy goals. Furthermore, this co-operation is not possible unless all parties manage the complex policy networks and implementation regimes responsible for putting European policies into force. Within this framework, this book answers three important questions: 1 Is the EU multi-level governance system weakening the implementation of policies? 2 Are national and sub-national governments capable of dealing with the challenges imposed by multi-level governance? 3 Which factors account for differences in implementation performance among Member States? In order to answer these questions, Simona Milio's research explores the influence of two variables on implementation processes: Administrative Capacity and Political Stability. Cohesion Policy is chosen as the focus of this study since it has demonstrated a dramatically different implementation pace among EU Member States over the past 20 years. Three EU Member States are chosen to test the hypothesis. Italy appears to be a pertinent example, given its constant struggle to conform to EU directives and to implement Cohesion Policy. Spain is chosen since, in contrast to the Italian scenario, it represents the best performing Member State in terms of implementation. Finally Poland is studied, as a case where a shift from centralization towards decentralization has occurred in order to implement Cohesion Policy and integrate the multi-level governance system.

The discussion of treatment sets out both conservative and surgical approaches, clearly explaining the indications for the various options, as well as their advantages and disadvantages. The trapeziometacarpal joint is a phylogenetically recent articulation that permits the pinching movements of the index finger and thumb so important in daily activities. Degenerative disease involving the trapeziometacarpal joint is an important disabling condition that affects predominantly females over 50 years old. Although a number of treatments are now available, there is no single gold standard. Conservative treatments can control pain yet are unable to halt progression of the articular aging, while none of the surgical solutions employed when conservative treatments prove insufficient can be considered perfect. For example, use of a spacer can restore strength but does not always completely alleviate pain while arthroplasty eradicates pain within a few weeks but cannot restore strength. In thoroughly reviewing the available treatments, this book will enable the practitioner to select the best option for the individual patient.

What marked the evolutionary transition from organisms that lacked consciousness to those with consciousness—to minimal subjective experiencing, or, as Aristotle described it, “the sensitive soul”? In this book, Simona Ginsburg and Eva Jablonka propose a new theory about the origin of consciousness that finds learning to be the driving force in the transition to basic consciousness. Using a methodology similar to that used by scientists when they identified the transition from non-life to life, Ginsburg and Jablonka suggest a set of criteria, identify a marker for the transition to minimal consciousness, and explore the far-reaching biological, psychological, and philosophical implications. After presenting the historical, neurobiological, and philosophical foundations of their analysis, Ginsburg and Jablonka propose that the evolutionary marker of basic or minimal consciousness is a complex form of associative learning, which they term unlimited associative learning (UAL). UAL enables an organism to ascribe motivational value to a novel, compound, non-reflex-inducing stimulus or action, and use it as the basis for future learning. Associative learning, Ginsburg and Jablonka argue, drove the Cambrian explosion and its massive diversification of organisms. Finally, Ginsburg and Jablonka propose symbolic language as a similar type of marker for the evolutionary transition to human rationality—to Aristotle's “rational soul.”

It discusses all the available imaging technologies and the problems related to the calibration of the imaging system and accuracy of the estimated physiological parameters. Enhancing imaging modalities using contrast agents has opened up new opportunities for going beyond morphological information and enabling minimally invasive assessment of tissue and organ functionality down to the molecular level. In combination with mathematical modeling of the contrast agent kinetics, contrast- enhanced imaging has the potential to provide clinically valuable additional information by estimating quantitative physiological parameters. The book presents the broad spectrum of diagnostic possibilities provided by quantitative contrast-enhanced imaging, with a particular focus on cardiology and oncology, as well as novel developments in the area of quantitative molecular imaging along with their potential clinical applications. Given the variety of available techniques, the choice of the appropriate imaging modality and the most suitable pharmacokinetic model is often challenging. Seeking the Mothers in Ovid's "Heroides" explores Ovid's reconceptualization of the heroines' maternal experience. Rather than aligning them with the stereotypical roles of Roman women, motherhood enables the Ovidian heroines to challenge traditional norms with irreverent perspectives on gender categories and familial relationships. To confront these perspectives and overcome the dialectic between the (male) voice of the poet and the (female) voice of the heroines, Seeking the Mothers in Ovid's "Heroides" argues for a form of polyphonic "cooperation" between the two voices, thus providing new angles on ironical discourse and gender fluidity within the Heroides. By reading the Heroides both through feminist theory and against Ovid's poetic production, Simona Martorana provides a novel approach to describe how motherhood enhances the heroines' agency, drawing on works of Kristeva, Irigaray, Butler, Mulvey, Cavarero, Braidotti, and Ettinger. The application of theory is flexible throughout Seeking the Mothers in Ovid's "Heroides" and tailored to the nuances of specific passages rather than being uniformly imposed on the ancient text. Seeking the Mothers in Ovid's "Heroides" reveals how the irony, ambiguity, and polyphony intrinsic to Ovid's poetry are amplified by the heroines' poetic voices. Martorana breaks new ground by incorporating contemporary feminist theories within the analysis of the Heroides and provides an original comprehensive analysis of motherhood that encompasses other Ovidian works, Latin poetry, and classical literature more broadly.

This book provides an innovative and thought-provoking analysis of the policy of integrazione scolastica from an inclusive perspective. Drawing on historical and empirical research methods the book arises out of an ethnographic study, which investigates the extent to which the policy of integrazione scolastica can be considered an inclusive policy. The author poses two fundamental questions: why are there episodes of micro-exclusion and discrimination against disabled pupils still taking place in regular schools after more than 30 years have passed since the enactment of such a progressive policy? Can the policy of integration lead to the development of inclusion in Italy? The research findings presented in the book indicate that exclusion and discrimination towards disabled pupils in education do not result from a lack of implementation of the policy at a school level, rather from the perpetuation of dominant discourses, which construct disability as an individual deficit. The book does not deny the progress made in the country following the application of this anti-discriminatory policy; rather it challenges the hegemonic abilist culture and the traditional perspectives of disability and schooling that undermine the development of inclusive education. After having investigated the theoretical premises of the policy of integration, the author argues that this progressive policy is still rooted in a special needs education paradigm and that what was once a liberating policy has been transformed into a hegemonic tool which still manages, controls and normalizes disability leaving school settings and teaching and learning routines unchanged. She finally argues for a human rights approach for the development of an inclusive school for the 21st century. The book is an essential reading for academics, policy makers, researchers and students involved in education as it links ideological pressures to practical analyses.

From food to body practices, from ecological discourses to the Covid-19 pandemic, contemporary imaginaries abound with representations of an ideal “pure Nature”, essentially defined according to a logic of denial of any artificial, modified, manipulated — in short, cultural — aspect. How should we contextualise and understand such an opposition, especially in light of the rich semantic scope of the term “nature” and its variability over time? And how can we — if we actually can — envisage alternative models and approaches capable of better accounting for such richness and variability? The author addresses these fundamental issues, combining an initial theoretical problematisation of the concept of nature and its evolution — from classical philosophy to the crucial changes occurred through the Middle Ages, the Renaissance, Romanticism and the modern era, finally considering recent insights in philosophy, sociology, cultural anthropology and semiotics — with the analysis of its discursivisation — from the iconography of Mother Nature between the past and the present to the representation of catastrophic events in fictional and non-fictional texts, from clean eating and other popular food trends to the ambivalence of the naked body between its supposed natural ascription and its multiple cultural characterisations. Thus she introduces a critique of pure Nature, providing a systematic study of the way nature is attributed meaning and value in some of today’s most relevant discourses and practices, and finally tracing a possible path towards an “internatural turn”.
