Saints and their Communities offers a new approach to the study of lay religion as evidenced in collections of miracle narratives in twelfth-century England. There are a number of problems associated with the interpretation of this hagiographical genre and an extended introduction discusses these. The first issue is the tendency to read these narratives as transparent accounts of lay religion as if it were something susceptible to static, 'ethnographic' treatment in isolation from wider social and political activities. The second issue is the challenge of explaining the miraculous as a credible part of cultural experience, without appealing to reductionist notions of a 'medieval mindset'. The third issue is the problem of how to take full account of the fact that these sources are representations of lay experience by monastic authors. The author argues that miracle narratives were the product of and helped to foster lay notions of Christian practice and identity centred on the spiritual patronage of certain enshrined saints. The six main chapters provide fully contextualized studies of selected miracle collections. Yarrow looks at when these collections were made, who wrote them, the kinds of audiences they are likely to have reached, and the messages they were intended to convey. He shows how these texts served to represent specific cults in terms that articulated the values and interests of the institutions acting as custodians of the relics; and how alongside other programmes of textual production, these collections of stories can be linked to occasions of uncertainty or need in the life of these institutions. A concluding chapter argues the case for miracle collections as evidence of the attempt by traditional monasteries to reach out to the relatively affluent peasantry, and to urban communities in society, and their rural hinterlands with offers of protection and opportunities for them to express their social status with reference to tomb-centred sanctity.

When I started this book, the word 'Assassination' in the title referred to the homicide of a powerful military and political individual whose elimination could alter the course of world history. The word 'Preparations' included the choice of an assassin, the plans for the actual deed, those involved in the planning and those who desired that it take place and succeed. The word 'Consequences' included an elaborate scheme to silence the assassin, and to cover up those involved in his elimination. The cover-up would initiate a domino sequence with repercussions that continue up to the present time. However, the title could also be applied to the assassinations that were carried out - by the millions - in the Nazi Holocaust. The preparations were clearly documented in the detailed archives of 'Kristallnacht' and those of the 'Wannsee Conference'. The consequences included the Nuremberg Trials, in which the evidence against the assassins, and those guilty of aiding and abetting the crime, was taken from the very Nazi archives of which they were so proud. Then came those who aligned themselves with the Holocaust Denial, and the neoNazi resurgence was alive and well across the world. Finally, when even such mass slaughter of defenceless noncombatants could be denied, defended or even ignored, the world was ready for a new wave of terrorism on a massive scale. Such documented horrors required an antidote, and this has been provided in the book by the personal stories of a retired surgeon and his wife. These are stories of determination and happiness in facing the varied challenges of daily life. -Simon Marinker

International Arbitration Law Library, Volume 63 [IALL-63] Many corporations engage in treaty shopping – or ‘nationality planning’ – to procure investment treaty protection by attainment of a nationality of convenience. This book is the first in-depth exploration of a substantive legal basis by which to assess the bona fides of a corporate investor’s identity in a convenient jurisdiction: i.e., examination of the purpose for which a corporate exists in the ownership structure of the relevant investment. In a comprehensive review of the concept of treaty shopping, the author examines the degree to which manipulation of corporate nationality is consistent with the objects and purposes of the investment treaty regime, and analyses its effect on the legitimacy of investor-state dispute mechanisms. To evaluate a substantive test for a bona fide investor, the book looks to analogous areas of international law such as the law of diplomatic protection and double tax treaties, and reviews in detail the relevance in investment treaty law of such pertinent issues and topics as the following: the concept of separate legal personality; abuse of the corporate form at municipal law; the role of Article 25 of the ICSID Convention; the approach to the nationality of natural persons; the approach to the jurisdictional concept of an ‘investment’; criteria used to connote corporate nationality; the concept of the commercial purpose of the corporate investor claimant; the concept and limits of the principle of abuse of right at international law; and the application of, and the relationship between, the four tenets of Article 31(1) of the Vienna Convention: ordinary meaning, good faith, context, and object and purpose. The effectiveness of substantive criteria presently used to mitigate illegitimate or undesirable treaty shopping are examined and compared with the ‘purpose to exist’ test, and the prospective legal mechanisms that may be utilised to implement a substantive approach are canvassed in detail. In the mid-nineteenth century, Jacob Grimm published a collection of late medieval records of local law—called Weistümer—that was scarcely less comprehensive than his famous collection of fairy tales. As with the fairy tales, Grimm assumed that before their transcription, people had handed these down orally from time immemorial. His interest in these customary laws arose from their seemingly folkloristic notions of custom and from their poetic narratives about ritualized encounters between lords and peasants, capturing an oral tradition from an unsophisticated time. Grimm's readings are still used today as a basis for theories about oral societies in the premodern West and contemporary non-Western societies and the modernizing effects of writing. As Simon Teuscher contends, however, those aspects of legal texts that have been considered since Grimm to be vestiges of a traditional preliterate popular culture were eventually rooted in relatively advanced and learned techniques of writing, jurisprudence, and administration. Lords' Rights and Peasant Stories uses examples from German- and French-speaking Switzerland to investigate what legal order meant to individuals and to a society at the eve of the early modern period. Teuscher deals with legal documents not only as texts, but also as objects. The book takes the materiality of documents seriously and reconstructs cultural techniques of their production and social practices of their use. Lords' Rights and Peasant Stories suggests the need to rethink master narratives about transitions from oral to literate societies. It explores the local dimensions of processes of state-formation and the emergence of modern notions of law in western Europe. Students of rural society and village organization will find here a discussion of local power distribution that is inspired by social anthropology, that looks beyond simple antagonisms between lords and peasants, and that insists on the role of state servants and the unconscious effects of their writing practices.

Across the country and around the world, people avidly engage in the cultural practice of hunting. Children are taken on rite-of-passage hunting trips, where relationships are cemented and legacies are passed on from one generation to another. Meals are prepared from hunted game, often consisting of regionally specific dishes that reflect a community’s heritage and character. Deer antlers and bear skins are hung on living room walls, decorations and relics of a hunter’s most impressive kills. Only 5 percent of Americans are hunters, but that group has a substantial presence in the cultural consciousness. Hunting has spurred controversy in recent years, inciting protest from animal rights activists and lobbying from anti-cruelty demonstrators who denounce the custom. But hunters have responded to such criticisms and the resulting legislative censures with a significant argument in their defense—the claim that their practices are inextricably connected to a cultural tradition. Further, they counter that they, as representatives of the rural lifestyle, pioneer heritage, and traditional American values, are the ones being victimized. Simon J. Bronner investigates this debate in Killing Tradition: Inside Hunting and Animal Rights Controversies. Through extensive research and fieldwork, Bronner takes on the many questions raised by this problematic subject: Does hunting promote violence toward humans as well as animals? Is it an outdated activity, unnecessary in modern times? Is the heritage of hunting worth preserving? Killing Tradition looks at three case studies that are at the heart of today’s hunting debate. Bronner first examines the allegedly barbaric rituals that take place at deer camps every late November in rural America. He then analyzes the annual Labor Day pigeon shoot of Hegins, Pennsylvania, which brings animal rights protests to a fever pitch. Noting that these aren’t simply American concerns (and that the animal rights movement in America is linked to British animal welfare protests), Bronner examines the rancor surrounding the passage of Great Britain’s Hunting Act of 2004—the most comprehensive and divisive anti-hunting legislation ever enacted. The practice of hunting is sure to remain controversial, as it continues to be touted and defended by its supporters and condemned and opposed by its detractors. With Killing Tradition, Bronner reflects on the social, psychological, and anthropological issues of the debate, reevaluating notions of violence, cruelty, abuse, and tradition as they have been constructed and contested in the twenty-first century.
