During the period from 1931 to 1967—thirty-six years—Kentuckians elected only one Republican as governor of the Commonwealth. Yet that man, a former justice of the state's highest court, seldom appears as other than a footnote in the standard histories. That is unfortunate, for Simeon Willis of Ashland made a fine record as governor, assuming the office during World War II and leaving it strengthened in a postwar world. In this new volume in the Public Papers of the Governors of Kentucky series, editor James C. Klotter has assembled 173 documents and public statements, so that the Willis administration may be examined in depth for the first time. Such an examination is long overdue, for Willis sought to accomplish much under difficult circumstances. Hindered by the opposition party's control of the legislature and operating under wartime restrictions, the Willis administration nevertheless made path-breaking moves in education, health care, transportation, and civil rights. Many of the same difficulties Kentucky has faced in more recent years also existed during Willis's term. How he dealt with those puzzles can be instructive for today's citizens and leaders. Willis faced budget problems, sought to increase aid to education, confronted a conflict over the presidency of what is now Morehead State University, and attempted to increase tourism in the state. His calls for change would be echoed by later governors.

Historically, revolution has been one of the principal means of founding a new state. But can this new state have any moral legitimacy, born as it is out of violence? That is the critical question for legal theorists. The late Hans Kelsen, arguably one of the leading legal theorists and philosophers of the twentieth century, in his Pure Theory of Law, articulated this theory of revolutionary legality as a part of his general theory of law. Kelsen in the Grenada Court: Essays on Revolutionary Legality examines revolutionary legality in the context of the Grenada coup d'etat of March 1979, which brought the People's Revolutionary Government (PRG) to power. The 1973 Constitution was suspended, the executive authority of the country changed, parliament was reconstituted and a new Supreme Court established. The governing principles of political life in Grenada were transformed. The PRG had established a new legality. The courts however, were confronted with questions of their validity and jurisdictional competence. Called upon to judge the validity of the PRG regime, the issue of the validity of the courts was also called into question. Following the demise of the PRG regime in sensational fashion, culminating in the invasion of Grenada by the US army in 1983, the validity of the court was again challenged. This collection of clear, readily understood essays, shows that the Court determined its own validity as a matter of necessity. Using examples from around the Commonwealth, the case of Bernard Coard & Ors. v. The Attorney General, known popularly as the Maurice Bishop murder trial, or the Grenada Thirteen, McIntosh criticizes the Grenada Court and its handling of the subject of revolutionary legality; while addressing Kelsen's theory of continuity and discontinuity of law and the doctrine of necessity.

Over the last decade, more than one hundred fifty thousand large enterprises in twenty seven transition countries have encountered revolutionary changes in every aspect of their political and economic environments. Some enterprises have responded to the challenge, entering world markets with great dynamism and becoming indistinguishable from their competitors in mature market economies. Others remain mired in their past, undergoing protracted deaths, delayed at times by their slippage into a netherworld of barter and ersatz money. Thus the revolutionary changes in transition countries have been matched by great variation in the degree to which enterprises have responded successfully to events. To assess the effectiveness of the different reform and privatization strategies, empirical research on transition countries has examined enterprise level data to ascertain whether enterprises have responded productively to changes in ownership and to other reform measures. This volume provides a general assessment of the evidence generated by these studies. In providing the assessment, it: discusses the general context of the studies; assesses the evidence on whether state-owned or privatized firms undertake more economic restructuring; studies the effects of restructuring on different types of owners; focuses on the role of managers; analyzes the effect of greater discipline in the government's reaction to enterprises in distress; examines how variations in product market competition affect enterprise restructuring; and examines the role of the institutional and legal framework. This publication will be of interest to policy makers and readers interested in gaining an overview of the current state of the evidence.
