In pre-emancipation Europe, most Jews followed Jewish law most of the time, but by the turn of the twentieth century, a new secular Jewish identity had begun to take shape. Homes Away From Home tells the story of Ashkenazi Jews as they made their way in European society in the late nineteenth and twentieth centuries, focusing on the Jewish communities of Paris, Berlin, and St. Petersburg. At a time of growing political enfranchisement for Jews within European nations, membership in the official Jewish community became increasingly optional, and Jews in turn created spaces and programs to meet new social needs. The contexts of Jewish life expanded beyond the confines of "traditional" Jewish spaces into sites of consumption and leisure, sometimes to the consternation of Jewish authorities. Sarah Wobick-Segev argues that the social practices that developed between 1890 and the 1930s—such as celebrating holydays at hotels and restaurants, or sending children to summer camp—fundamentally reshaped Jewish community, redefining and extending the boundaries of where Jewishness happened.

This book argues that moral rights provisions in copyright law rest on a misunderstanding, or romanticisation, of the role of the author. The Romantic conception of authorship, as a lone genius, creating from nothing, sensitive and vulnerable, has helped publishers push for strong copyright reform. But is this conception borne out in practice – especially in a world of meme culture, of artificial intelligence generated art and poetry, and of open source and fan fiction? This book probes the romantic vignette of the author through its legal adoption. Moral rights are rights that attach to the non-economic – for example, intellectual or emotional – interests of an author in their work. Much like defamation, moral rights see the right of reputation as superior to the right of freedom of expression. However, unlike defamation, moral rights are not protecting against defamatory actions against a person. In most jurisdictions, they are provisions set within copyright regimes; regimes whose purpose is to incentivise innovation. Challenging the way we think about authorship and how it should be protected by law, the book draws on a wide range of historical and contemporary examples to demonstrate how moral rights can constitute a barrier to transformative creativity. While authors and artists require strong rights to protect their ability to earn an income and incentivise creativity, moral rights, the book argues, may in turn actually harm their ability to do so. The software industry is regarded as one of the most creative and dynamic industries in the world. At the same time, sheltering software through copyright and patent law has been a major point of contention for the past 40 years. This doctoral thesis aims to provide new insights to this discussion. Through the use of sociological methodology, it supplies the necessary basic scientific reasearch regarding how software is developed and commercialized nowadays. Based on these findings, it then legally evaluates to what extent copyright and patent law are able to reflect these structures and determines how an optimal protection scope for computer programs could look like today. This doctoral thesis on one hand offers novel insights and points of view on existing legal doctrines. It further acknowledges as well as legally qualifies some prevailing trends in the software industry, such as Scrum and continuous delivery, that have so far been largely unaddressed by copyright and patent law.
This book explores and reveals the intricacies of Jewish heritage in contemporary Germany, the role it plays as a "moral heritage" in the symbolic representation of Jews and Judaism in the national landscape, and its relevance for the cultural sustainability of local Jewish communities. The practice of synagogue music in the past and present is a central case study in the discussions. This ethnographic study examines how Jewish liturgical music as the cultural heritage of minorities has been constructed, treated, discussed, appropriated, and passed on to different actors in different forms and for different purposes over time. It also examines the resulting moral and ethical questions and power imbalances. The author discusses how both Jewish and non-Jewish stakeholders utilize the music of 19th- and early 20th-century Reform Judaism and the Minhag Ashkenaz for a symbolic reconstruction of German Jewry. Furthermore, they repatriate it in local Jewish communities today. This is usually done for individual, sometimes commercial, rather than religious reasons. The Jewish-musical cultural heritage process is characterized by moral imperatives and complex negotiations about power and representation. It reveals problematic aspects of German-Jewish relations, cross-generational rifts, and denominational differences between the Jewish communities in post-war Germany.
