The mark showed who the possession belonged to or where the cattle or goods originated from. This tradition still lives on in the logos, names, symbols and designs companies give to their products and services to distinguish their offers from the others the competitors. From a simple marking of possessions and origin, branding has come a long way. Nowadays, companies invest a great amount of resources into building, maintaining and nurturing their brands. In acquisitions, companies pay a huge amount of money for a brand. Take Nestlé s acquisition of Rowntree, which owns brands like Kit Kat and Smarties, as an example. Nestlé paid five times the net asset value of Rowntree in order to acquire stable brands. Why do companies pay such large sums of money for an invisible asset like a brand? The answer is simple: consumers do the same. Studies showed that consumers pay a far higher price for a product or service of a well-known brand they trust than for a comparable offer from a less well-know brand. Brands make up for a big chunk of a firm s revenues today and make sales predictable. As Internet and mobile communication grows in terms of users and becomes more important in their users lives, brands are unsure of how to handle this new medium in the digital age, since market dynamics have changed. Competition is more fierce, rumours spread worldwide in no time and brands lose emotional touch with their target segment. This change has been facilitated by online and mobile communication of peers. People have always formed peer networks, but today these networks are much more powerful and quicker. Networks of consumers take over and steal power from established brands. Shell witnessed a worldwide protest against its plans of sinking the oil platform Brent Spar into the North Sea. Consumers avoided Shell stations and supported Greenpeace. Rumours of sweat shops in Asia run by Nike and Reebok have led to loss of face as a result of worldwide protests. On top of these threats, brands have to face the fact that they have no chance fighting these networks of consumers. Acknowledging this prevalent situation, this book is the first to study in depth the available international arbitral awards that have applied good faith, thus providing detailed guidance on how this notion is (and can be) applied by tribunals in international commercial arbitration. Moreover, the author proposes a set of deeply informed guidelines for the future application of good faith by arbitral tribunals to both the parties’ contract and the arbitration agreement. This book provides a comprehensive description of the role and scope of good faith under governing laws in key jurisdictions (England, New York, Switzerland, France, Germany, China, Singapore, Hong Kong, Australia, and Canada) as well as under the CISG, the UNIDROIT Principles, and other uniform law and soft law instruments. The book greatly clarifies the source and role of good faith with respect to the following issues surrounding the arbitration agreement: formal validity of the arbitration agreement; incorporation of the arbitration agreement by reference; interpretation of the arbitration agreement; capacity and power of the parties to arbitrate; extension of an arbitration agreement to a non-signatory party; pre-arbitration requirements to negotiate or mediate; and performance of the arbitration agreement. Proposed guidelines for the application of good faith to each of these issues are included, along with useful figures summarizing the content of the obligations to negotiate or mediate in good faith prior to resorting to arbitration as well as the obligation to arbitrate in good faith. By analysing the role and scope of good faith under different national and non-national laws, this book will prove of inestimable value not only by providing invaluable insight into the recourse to good faith by arbitral tribunals but also by providing guidance on how good faith should be applied to the parties’ contract in international commercial arbitration. Sabrina Feldman manages the Planetary Science Instrument Development Office at the NASA Jet Propulsion Laboratory. Born and raised in Riverside, California, she attended college and graduate school at the University of California at Berkeley, where she enjoyed the wonderful performances of the Berkeley Shakespeare Company, studied Shakespeare's works for a semester with Professor Stephen Booth, and received a Ph.D. in experimental physics in 1996. She has worked on many different instrument development projects for NASA, and is the former deputy director of JPL's Center for Life Detection. Her scientific training, combined with a lifelong love of literature and all things Shakespearean, gives her a unique perspective on the Shakespeare authorship mystery. Dr. Feldman lives in Pasadena, California with her husband and two children. This is her first book. If William Shakespeare wrote the Bard's works... Who wrote the Shakespeare Apocrypha? During his lifetime and for many years afterwards, William Shakespeare was credited with writing not only the Bard's canonical works, but also a series of 'apocryphal' Shakespeare plays. Stylistic threads linking these lesser works suggest they shared a common author or co-author who wrote in a coarse, breezy style, and created very funny clown scenes. He was also prone to pilfering lines from other dramatists, consistent with Robert Greene's 1592 attack on William Shakespeare as an "upstart crow." The anomalous existence of two bodies of work exhibiting distinct poetic voices printed under one man's name suggests a fascinating possibility. Could William Shakespeare have written the apocryphal plays while serving as a front man for the 'poet in purple robes, ' a hidden court poet who was much admired by a literary coterie in the 1590s? And could the 'poet in purple robes' have been the great poet and statesman Thomas Sackville (1536-1608), a previously overlooked authorship candidate who is an excellent fit to the Shakespearean glass slipper? Both of these scenarios are well supported by literary and historical records, many of which have not been previously considered in the context of the Shakespeare authorship debate.

However, James does not simply narrow down his novella to a plain adventurous story à la Indiana-Jones, he rather embellishes it with ingenuity and brilliancy. In order to reveal this brilliancy, the attentive reader will soon realize that it is important for this novella to read between the lines, rather than being just impressed by the artful acting of the narrator. As Gargano once stated: "James' narrator prepares the reader for the 'big' scenes, for James himself the small and transitional scenes tell the fuller truth [...]". Hence, even the spaces within the novella seem to be fraught with tension. When analysing James' novella, one will soon realize that there is a quite significant complexity within the text. Indeed, it seems that the characters of the story are so close connected in their thinking and their action that it becomes quite difficult for the reader to distinguish between the person who dupes and the one who is duped at the end of the story. This complexity becomes clear by analysing the story of Juliana's niece, Miss Tina. Although Miss Tina is not presented as the typical mighty heroine right at the outset of the story, and is often initially seen as a simple-minded minor character, whose only function is to serve as a tool for the narrator to achieve his goal, there is so much more about her. This book empirically examines health care financing reforms and popular responses in three major cities in East Asia: Shanghai, Singapore, and Hong Kong. It adopts a new revised version of the theory of historical institutionalism to compare and explain the divergent reform paths in these three places over the past three decades. It also examines forces that propel institutional change. The book provides three detailed case studies on the development of health care financing reforms and the politics of implementing them. It shows that health care systems in Shanghai, Singapore, and Hong Kong were the products of Western presence in the nineteenth century. It illustrates how greater attention is paid to the roles played by ideas, actors, and environmental triggers without abandoning the core assumptions that political institutions and policy feedback remain central to impact health care financing reforms. It shows that health care financing reform is shaped by a complex interplay of forces over time. It also provides the most updated material about health care financing reforms in Shanghai, Singapore, and Hong Kong. The central argument of this book is that health care financing reform is both an evolving process responding to changing circumstances and a political process revealing an intricate interplay of power relationships and diverse interests. It shows that institutional changes in health care financing system can be incremental but transformative in nature. It argues that social policies will continue to develop and welfare states will continue to adapt and evolve in order to cope with new risks and needs.
