Montana can trace its brewing roots back more than 150 years to when a barrel of beer was brewed in Virginia City and carried to the town saloon. Since then, Montana has seen breweries large and small erupt along cattle trails and at train stations and riverside trading posts. Some of the brewers and breweries set in Montana were the foundations of future, national-brand breweries, having unique ties to Olympia Brewing and Pabst Brewing Company. And like many other states across the country, Montana was not immune to Prohibition, though not every brewer laid down without a fight. The breweries in the Big Sky state showed resilience when needed, but more so, they were reflections of the diverse communities and economies the state fostered. Fortunately, when Montana's mines began to dry up, agriculture took over, and even in the early 20th century, state officials documented in the Seventh Annual Report 1900-1901 that Montana could be "one the chief beer producing states in the nation" because of the amount of barley growing on the land.

To win sovereign statehood, all secessionist movements have to maneuver on the same strategic playing field while varying their tactics according to local conditions. To obtain recognition, secessionist movements use tactics of electoral capture, nonviolent civil resistance, and violence. To persuade the home state and the international community, they appeal to normative arguments regarding earned sovereignty, decolonization, the right to choose, inherent sovereignty, and human rights. The pursuit of independence can be enormously disruptive and is quite often violent. By advancing a theory that explains how sovereign recognition has succeeded in the past and is working in the present, and by anticipating the practices of future secessionist movements, Secession and the Sovereignty Game also prescribes solutions that could make the sovereignty game less conflictual.

Drawing examples from Hurricane Katrina, climate governance, health care reform, and other problems of local and national authority, author Erin Ryan demonstrates how the Supreme Court's federalism jurisprudence can inhibit effective inter-jurisdictional governance by failing to navigate the tensions within federalism itself. The Constitution's dual sovereignty directive fosters an ideal set of good governance values, including checks and balances, accountability, local autonomy, and local and national synergy, that are nevertheless in constant competition. This inherent "tug of war" is responsible for the epic instability in the Court's federalism jurisprudence, but it is poorly understood. With new conceptual vocabulary to wrestle with old dilemmas, Ryan traces the development of federalism's tug of war, and proposes innovations to manage judicial, legislative, and executive efforts with more focus. Her analysis clarifies how the tug of war is already mediated through balancing, compromise, and negotiation. She proposes a Balanced Federalism model that mediates tensions on three separate planes: fostering balance among competing federalism values, leveraging the functional capacities of the three branches in interpreting federalism, and maximizing the wisdom of both state and federal actors in so doing. The new framework better harmonizes values that-though in tension-have made the American system of government so effective and enduring.
