Interpretation or construction is central to the operation of contract law. Despite the fundamental role it plays, there have been limited attempts to explain construction in holistic terms. This important book aims to fill that gap by offering a systematic exposition of the iterative process. It also goes further, suggesting practical solutions to disputes regarding questions of interpretation. The book argues that construction is not simply about establishing what words mean; it is a process through which objective intention is inferred from the choice of words in a contract. The interpretive process involves four steps: formulate the question of interpretation in dispute; explore competing answers to the question; analyse the admissible material supporting each interpretation; and weigh and balance the competing considerations. By so doing, the book offers a simple yet sophisticated framework for interpreting/constructing contracts.
Rooted in contemporary understandings of social action, informed by up-to-date research on writing program administration, and attentive to the needs of value-driven decision-making, Burnin’ Daylight enables writing program administrators (WPAs) to shape writing programs that help people create the lives they envision. This book guides WPAs through the rough terrain of running a writing program during a period of sustained social and economic upheaval—and through the process of making their programs more principle-driven and sustainable along the way. WPAs face a range of challenges on a regular basis: organizing class schedules, leading professional learning events, conducting program assessments, responding to student needs, meeting with deans and provosts, and more. Additionally, WPAs need to learn about and direct their programs strategically when considering the kind of program they currently have, the sort of program they envision, and how they can transition from one to another. Burnin’ Daylight acts as a roadmap for IRB-approved research and provides WPAs—specifically, new and returning WPAs—with a detailed yet flexible plan for understanding the inner workings of a writing program and how to develop a future trajectory for it. Burnin’ Daylight is for writing program administrators of all experience levels and other administrators interested in taking a “principled practices” approach to their work.

The Naval Research Laboratory (NRL) set out to develop ways to predict what determines the targets of suicide attacks. While the ultimate goal is to create a list of areas at risk for the U.S. environment, the first phase of development employed a data set from Israel. Initially, NRL focused on spatial attributes, creating its own risk index, but realized that this focus on the where ignored the broader social context, the why. The lab asked RAND to test, as a proof of principle, the ability of sociocultural, political, economic, and demographic factors to enhance the predictive ability of NRL's methodology. Again using Israel as a sample, RAND created a database that coded for these factors, then conducted both quantitative and qualitative analyses with an eye to determining what puts a given area at greater risk. The quantitative analysis established that these factors are related to the odds of attack within specific neighborhoods and that the relationships held even when controlling for geospatial factors, so they seem to confer risk for reasons beyond their association with geospatial features of neighborhoods. The specifics of the research are limited to the preferences of Palestinian suicide bombers in Israel; however, the methods used to assess target preferences in Israel could be transferred to the United States or other countries. Any results, if proven to be robust, could be used to develop recommendations for heightened public awareness in certain areas."--Page 4 of cover.
Degrowth is a planned economic contraction in wealthy countries that reduces production and consumption—and, by extension, greenhouse gas emissions and stresses on global ecosystems—to sustainable levels within ecological limits. This book explores the idea of degrowth as an economic alternative to offer a more sustainable and just future. A growing number of scientists and scholars now recognize that a system that continues to prioritize economic growth will prevent us from effectively addressing the dual environmental crises of climate change and biodiversity loss. To establish the case for degrowth, the text opens by posing critical questions about our current system and identifying its limitations, as well as discussing the ineffectiveness of "false solutions" that seem to offer something new but would actually preserve the status quo. The concept of degrowth is then fully introduced along with a discussion of core principles and goals as well as major critiques and questions. The book explores what living in a degrowth society would entail and the policies needed to support degrowth. Finally, the work concludes by examining the opportunities and challenges for degrowth and a successful transition to a sustainable steady-state economy. This book provides an advanced introduction to the environmental issues around degrowth for students, scholars and activists interested in economic alternatives, sustainability and the environment.

Many people today think of Satan as a little red demon with a pointy tail and a pitchfork—but this vision of the devil developed over many centuries and would be foreign to the writers of the Old Testament, where this figure makes his first appearances. The earliest texts that mention the Satan—it is always “the Satan” in the Old Testament—portray him as an agent of Yahweh, serving as an executioner of evildoers. But over the course of time, the Satan came to be regarded more as God’s enemy than God’s agent and was blamed for a host of problems. Biblical scholar Ryan E. Stokes explains the development of the Satan tradition in the Hebrew scriptures and the writings of early Judaism, describing the interpretive and creative processes that transformed an agent of Yahweh into the archenemy of good. He explores how the idea of a heavenly Satan figure factored into the problem of evil and received the blame for all that is wrong in the world.

The Filth of Progress explores the untold side of a well-known American story. For more than a century, accounts of progress in the West foregrounded the technological feats performed while canals and railroads were built and lionized the capitalists who financed the projects. This book salvages stories often omitted from the triumphant narrative of progress by focusing on the suffering and survival of the workers who were treated as outsiders. Ryan Dearinger examines the moving frontiers of canal and railroad construction workers in the tumultuous years of American expansion, from the completion of the Erie Canal in 1825 to the joining of the Central Pacific and Union Pacific railroads in 1869. He tells the story of the immigrants and Americans—the Irish, Chinese, Mormons, and native-born citizens—whose labor created the West’s infrastructure and turned the nation’s dreams of a continental empire into a reality. Dearinger reveals that canals and railroads were not static monuments to progress but moving spaces of conflict and contestation.

A Journey through Boston Irish History, the first comprehensive photographic record of Boston's most conspicuous immigrant group, is the fruit of years of tireless research by prize-winning author Dennis P. Ryan. Within these pages are rare and handsome images unearthed from innumerable local libraries, historical societies and museums, parish rectories and Catholic charitable institutions, the archives of religious congregations, major Boston and diocesan newspapers, private family collections, and the Library of Congress in Washington, D.C. Beginning with the horrifying famine of the 1840s in Ireland and concluding four generations later with the election of John F. Kennedy as president, A Journey through Boston Irish History is a sweeping, poignant portrait of the children of the Gael and the city they transformed politically, socially, and culturally. Ryan takes us through the corridors and wards of hospitals and orphanages that were established by the Irish to care for their own. Powerful images supplied by the Mathew Brady Collection at the Library of Congress recount the exploits of the celebrated Massachusetts Ninth Irish Regiment during the American Civil War. Within these pages, we are also invited to discover the vibrant personalities of pugilist John L. Sullivan, William Henry Cardinal O'Connell, as well as the irrepressible Mayor James Michael Curley.
Arc-continent collision has been one of the important tectonic processes in the formation of mountain belts throughout geological time, and it continues to be so today along tectonically active plate boundaries such as those in the SW Pacific or the Caribbean. Arc-continent collision is thought to have been one of the most important process involved in the growth of the continental crust over geological time, and may also play an important role in its recycling back into the mantle via subduction. Understanding the geological processes that take place during arc-continent collision is therefore of importance for our understanding of how collisional orogens evolve and how the continental crust grows or is destroyed. Furthermore, zones of arc-continent collision are producers of much of the worlds primary economic wealth in the form of minerals, so understanding the processes that take place during these tectonic events is of importance in modeling how this mineral wealth is formed and preserved. This book brings together seventeen papers that are dedicated to the investigation of the tectonic processes that take place during arc-continent collision. It is divided into four sections that deal firstly with the main players involved in any arc-continent collision; the continental margin, the subduction zone, and finally the volcanic arc and its mineral deposits. The second section presents eight examples of arc-continent collisions that range from being currently active through to Palaeoproterozoic in age. The third section contains two papers, one that deals with the obduction of large-slab ophiolites and a second that presents a wide range of physical models of arc-continent collision. The fourth section brings everything that comes before together into a discussion of the processes of arc-continent collision.

This book considers the challenges and opportunities of the Anthropocene Age from the perspective of pastoral theology/care. The fundamental question and concern with regard to the Anthropocene Age for human beings and other species is, how are we to dwell together on this one earth. Care, LaMothe argues, is the central concept in answering this question. Effective care requires pastoral theologians to make use of multiple interpretive frameworks (e.g., theology, philosophy, human sciences, etc.) in the analytic pursuit of understanding and responding effectively to the realities of climate change. At the same time, it is also important for pastoral theologians to examine critically the theologies and philosophies that give rise to and impede pastoral interventions and, in the case of the Anthropocene Age, to be clear about how theologies and philosophies have contributed to ideologies that undergird both exploitation of the earth and other-than-human beings, while also contributing to climate change and obstructing climate action. These are necessary steps in developing pastoral responses aimed at caring for persons, communities, and other-than-human beings in need of a viable dwelling.
