Cet ouvrage explore, à travers l’exemple de la réglementation environnementale, le droit applicable à cette notion controversée. Il montre que l’approche traditionnelle – reposant sur une dilution du concept d’expropriation – n’est nullement appropriée et il contribue à clarifier l’étendue de la protection de l’investisseur sur le fondement du droit de la responsabilité internationale de l’Etat. In international investment law, the prism of indirect expropriation includes a broad range of measures – such as regulatory measures – which do not involve a transfer of property but result in a serious interference with an investment. The definition of compensable taking is a very sensitive issue situated at the crossroads between the protection of investors' private rights and the safeguarding of the state's sovereign prerogatives. This book explores, through the example of environmental regulation, the law applicable to this controversial topic. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.

These, as Lynn Margulis pointed out in Volume 1, are the colonial posterity of migrant prokaryotes, probably primitive bacteria that swam into the ancestral precursors of all eukaryotic cells and remained as symbionts. They have maintained themselves and their ways ever since, replicating their own DNA and transcribing an RNA quite different from that of their hosts. In a similar manner, the chloroplasts in all plants are self-replicating organelles presumably derived from the blue-green algae, with their own nucleic acids and ribosomes. Four chapters are devoted to the nucleic acids and the ribosomal components of both classes of these semi-independent lodgers. Finally, data from various sources on genetic variants of enzymes are tabulated for ready reference, and an evaluation of this information is attempted.

U'Ren was the national architect of the direct democracy movement. Little was a leading antivaccinationist. The Radical Middle Class further explores the Portland Ku Klux Klan and concludes with a national overview of the American middle class from the Progressive Era to the present. Shadow of Liberation explores the intricate twists, turns, contestations and compromises of ANC economic and social policymaking with a focus on the transition era of the 1990’s and the early years of democracy With the damning revelations by the Zondo Commission of Inquiry into State Capture on the massive corruption of the South African body politic, the timing of this book could not be more relevant. South Africans need to confront the economic and social policy choices that the liberation movement made and to see how these decisions may have facilitated the conditions for corruption to emerge and flourish. Answers are needed. Padayachee and van Niekerk focus their attention on the primary question of how and why the ANC, given its historical anti-inequality, re-distributive stance, come in the 1990s, to such a dramatic turn around and move towards an essentially market-dominated approach. Were they pushed or did they go willingly? What role if any did Western governments and international financial institutions play? And what of the role of the late apartheid state and South African business? Did leaders and comrades ‘sell out’ the ANC’s emancipatory policy vision? Shadow of Liberation tries to provide answers to these questions drawing on the best available primary archival evidence as well as extensive interviews with key protagonists across the political, non-government and business spectrum. The authors argue that the ANC’s emancipatory policy agenda was broadly to establish a social democratic welfare state upholding rights of social citizenship. However its economic policy framework to realise this emancipatory mission was either non-existent or egregiously misguided.
