The lawsuit is the cornerstone of the civil justice system in America, and an open court the foundation of American jurisprudence. In a public setting, we resolve disputes, determine liability, and compensate injuries. In recent decades, however, more civil disputes have been resolved out of court and the outcomes have been kept secret. Fewer than 5 percent of the tens of millions of injury claims annually are actually resolved through a public trial with a jury, and the vast majority are settled out of court or through private forums, such as mediation or arbitration, with undisclosed terms. Some argue that the confidentiality of the system keeps it working efficiently and fairly; others argue that the public is being denied information about hazards that may cause harm and that a public system with no data lacks oversight. This collection of essays by leading legal scholars is the first book to approach the issue in a multidisciplinary, nonpartisan, and empirical manner. The essays provide empirical analyses and case studies of the impact of greater disclosure on various aspects of the system, ranging from settlement values to fraud, and propose several novel prescriptions for reform. With special attention to the emergence of modern mass litigation, the authors identify a number of benefits to increasing access to information, including decreased fraud, improved public understanding and confidence in the system, and lower transactions costs. The authors make policy recommendations--such as expanding access to existing databases and using technology to create new databases--that increase transparency while protecting the need for privacy.

The Late Middle Ages (c.1300–c.1500) saw the development of many of the key economic institutions of the modern unitary nation-state in Europe. After the ‘commercial revolution’ of the thirteenth century, taxes on trade became increasingly significant contributors to government finances, and as such there were ever greater efforts to control the flow of goods and money. This book presents a case study of the commercial and financial links between the kingdom of England and the duchy of Aquitaine across the late-medieval period, with a special emphasis on the role of the English Plantagenet government that had ruled both in a political union since 1154. It establishes a strong connection between fluctuations in commodity markets, large monetary flows and unstable financial markets, most notably in trade credit and equity partnerships. It shows how the economic relationship deteriorated under the many exogenous shocks of the period, the wars, plagues and famines, as well as politically motivated regulatory intervention. Despite frequent efforts to innovate in response, both merchants and governments experienced a series of protracted financial crises that presaged the break-up of the union of kingdom and duchy in 1453, with the latter’s conquest by the French crown. Of particular interest to scholars of the late-medieval European economy, this book will also appeal to those researching wider economic or financial history.

His prior two editions have also served admirably as a reference text for clinicians and scientists. This new edition captures the extraordinary recent advances in our knowledge of the ultimate and proximal mechanisms underlying the phenomenon of aging. As a result, six important conceptual changes are included here: · Clarified distinctions between the biological mechanisms involved in longevity determination and those involved in senescent processes. · A new conceptual framework around which we can organize all the new facts about aging. This will assist readers to make sense of the information and use the data to form their own ideas. · Increased knowledge of aging cells has lead to new ideas on how a cell transits from a healthy state to a senescent state, while still allowing for high levels of intra- and inter-specific variability. · Discussion of senescent mechanisms assists the reader to understand that aging is a non-programmatic loss of function, likely arising from the loss of regulatory signals, and so is modifiable in the laboratory. · Because the standard evolutionary story does not fully explain the evolution of social organisms, this edition also includes recent work dealing with intergenerational resource transfers. · Lastly, if aging mechanisms are plastic, then the demand to move these anti-aging interventions into the human arena will inevitably grow. A discussion of the biological and ethical arguments on both sides of the question frames the question in an appropriate manner. The mass of data related to aging is summarized into fifteen focused chapters, each dealing with some particular aspect of the problem. The last two chapters integrate all this material into a coherent view of how the relevant biological processes change over the life span. Honor related violence is generally associated with crimes committed by people from the Middle East and adjacent areas. Perpetrators sometimes justify their deeds saying they ‘had to’ restore their honor. Theorists have argued that men from these populations exclusively correlate honor with the behaviour of their womenfolk, which they use as a pretext to further oppress and dominate women. Due to large-scale migration, western societies have become acquainted with honor related violence and honor killings. In this book, Robert Ermers addresses a number of questions related to honor related violence, including the use of predominantly negative frames regarding the cultural and social background of non-westerners and immigrants. In many publications, including the press, crimes committed by non-western individuals are often attributed to their cultural background rather than specific contexts or circumstances, in contrast to western cases. Vague and insufficiently defined concepts such as ‘honor’ and ‘culture’ strongly contribute to this bias. Honor Related Violence deals with honor and honor related violence, their background and contexts, what honor is, and what it is not. It examines stigma in relation to honor and based upon stigma research, reliably explains, analyses, and predicts honor related violence. The book argues that people all over the world can be stigmatized, excluded and ostracized when they commit misbehavior, and therefore find themselves in a state of dishonor which can lead to honor related violence. A timely intervention into the psychology of honor related violence, this is an essential resource for students and researchers in the fields of social psychology, sociology, law, criminology and anthropology.
