In this book, one of our country’s most distinguished scholar-judges shares with us his vision of the law. For the past two thousand years, the philosophy of law has been dominated by two rival doctrines. One contends that law is more than politics and yields, in the hands of skillful judges, correct answers to even the most difficult legal questions; the other contends that law is politics through and through and that judges wield essentially arbitrary powers. Rejecting these doctrines as too metaphysical in the first instance and too nihilistic in the second, Richard Posner argues for a pragmatic jurisprudence, one that eschews formalism in favor of the factual and the empirical. Laws, he argues, are not abstract, sacred entities, but socially determined goads for shaping behavior to conform with society’s values. Examining how judges go about making difficult decisions, Posner argues that they cannot rely on either logic or science, but must fall back on a grab bag of informal methods of reasoning that owe less than one might think to legal training and experience. Indeed, he reminds us, the greatest figures in American law have transcended the traditional conceptions of the lawyer’s craft. Robert Jackson did not attend law school and Benjamin Cardozo left before getting a degree. Holmes was neither the most successful of lawyers nor the most lawyerly of judges. Citing these examples, Posner makes a plea for a law that frees itself from excessive insularity and takes all knowledge, practical and theoretical, as grist for its mill. The pragmatism that Posner espouses implies looking at problems concretely, experimentally, without illusions, with an emphasis on keeping diverse paths of inquiry open, and, above all, with the insistence that social thought and action be evaluated as instruments to desired human goals rather than as ends in themselves. In making his arguments, he discusses notable figures in jurisprudence from Antigone to Ronald Dworkin as well as recent movements ranging from law and economics to civic republicanism, and feminism to libertarianism. All are subjected to Posner’s stringent analysis in a fresh and candid examination of some of the deepest problems presented by the enterprise of law.

Almost all US cities are controlled by real estate and development interests, but Santa Cruz, California, is a deviant case. An unusual coalition of socialist-feminists, environmentalists, social-welfare liberals, and neighborhood activists has stopped every growth project proposed by landowners and developers since 1969, and controlled the city council since 1981. Even after a 1989 earthquake forced the city to rebuild its entire downtown, the progressive elected officials prevailed over developers and landowners. Drawing on hundreds of primary documents, as well as original, previously unpublished interviews, The Leftmost City utilizes an extended case study of Santa Cruz to critique three major theories of urban power: Marxism, public-choice theory, and regime theory. Santa Cruz is presented within the context of other progressive attempts to shape city government, and the authors' findings support growth-coalition theory, which stresses the conflict between real estate interests and neighborhoods as the fundamental axis of urban politics. The authors conclude their analysis by applying insights gleaned from Santa Cruz to progressive movements nationwide, offering a template for progressive coalitions to effectively organize to achieve political power.

Not another textbook for neuropathology! Yes, Our publishers helped us with this last problem by we hear you and feel your pain. In fact, that was our insisting on black and white photographs. We ini initial response when we were approached to write tially protested, noting that many recent textbook the book you are now holding. In surveying the reviews seemed to be primarily guided by whether expanse of currently available neuropathology illustrations were in color (good) or black and white textbooks, however, we came to feel that there was (bad). However, upon further reflection we accepted a place for a book that could combine our career this mandate as a blessing in disguise, allowing the experiences of trying to discern what is known (and reader to focus on differences in morphology, rather knowable) with the perennially proposed question, than tincture, as a guide to correct diagnosis. In fact, "What do we need to know?" Together we tried to one of us (M. e. ) has always been a fan of black and produce a book that would be practical, understand white photography, both in histologic atlases as well able, and to the point (minimizing reading time as in the immortal photographs of artists ranging from during intraoperative consultation). We have con Ansel Adams to Diane Arbus.

Extensive archival evidence discloses how apostolic principles formed the basis for Allen's missionary theology. Although it is well-known that Allen's hermeneutical ideas were born of Pauline principles, Steven Richard Rutt expounds the ways in which Allen's missionary experiences had profoundly impacted Allen's theological beliefs. Allen wrote about his findings in letters, sermons, articles and books, some of which were never published. Allen's writings tenaciously challenged the methodology of colonial missionary societies and exposed the causes hindering Church expansion: failures occurred in missions due to the imposition of Western missionary paternalism and institutional devolution. Allen advocated the empowerment of indigenous churches to apply the principles of self-government andself-support. He asserted the importance of the Pauline concept of 'Spirit and order', which encompasses both the doctrine of the Holy Spirit as well as that of the Church. Allen's diagnosis of the missionary situation and the proposed ways to restore apostolic order presented contemporary controversy but since his death, we have seen the importance of Allen's ideas in Mission studies grow steadily. With an expert evaluation of Allen's theological insight, Roland Allen: A Theology of Mission also offers a superb contribution to the discipline of historical theology and historical missiology as Rutt delves into a contextual assay into the missionary landscape of the nineteenth and the twentieth centuries.

Official portraits are composed of demographic data, socioeconomic data, and test results. Unofficial counterportraits offer different views of children, schools, and communities. The big ideas of official and unofficial portraits are presented, then each chapter offers data (the children’s and teachers’ processes and products) and facets of the theoretical construct of counterportraits, as a response to official portraits. The counterportraits are built slowly in order to base them in evidence and to articulate their complexity. Many teachers and soon-to-be teachers facing the dilemmas and complexities of teaching in diverse classrooms have serious questions about how to honor students’ lives outside of school, making school more relevant. This book offers evidence to present to the public, legislators, and the press as a way of talking back to official portraits, demonstrating that officially failing schools are not really failing - evidence that is crucial for the survival of public schools.

Continental philosophy, as it has emerged in the twentieth century, is less a seamless fabric than a patchquilt of diverse strands. Phenomenology, hermeneutics, existentialism, structuralism, critical theory, deconstruction - these are some of the salient movements which have developed in continental Europe between 1900 and the 1990's, though their influence is by no means confined to geographic location. Continental thought has proved highly exportable, circulating far beyond the frontiers of Europe to provoke strong responses in the intellectual world at large. The fifteen articles in this volume outline and assess some of the issues and experiments of continental philosophy. The first five span the twin movements of phenomenology and existentialism, running from Husserl and Heidegger to Sartre, Merleau-Ponty and Levinas. Subsequent essays deal with specific currents of continental thought in such areas as science, Marxism, linguistics, politics, aesthetics, feminism and hermeneutics. A final chapter on postmodernism highlights the manner in which so many concerns of continental thought culminate in a radical anti-foundationalism. This volume provides a broad, scholarly introduction to this period for students of philosophy and related disciplines, as well as some original interpretations of these authors. It includes a glossary of technical terms and a chronological tube of philosophical, scientific and other cultural events.
