Third country nationals (TCNs) play an important part in the economy of the European Union, reflected in the rights granted to them under European Union Law. Political expediency is however shaped by world, regional and domestic influences that in turn determine policy towards third country nationals and their legal rights to freedom of movement. This book examines the concept of political legitimacy within the European Union through the principles of legal rationality, focusing in particular on the European Union’s policy towards third country nationals. Richard Ball argues that for legal doctrine to be rational it must display the requirements of formal, instrumental and substantive rationality, each mutually exclusive and essential. In taking this position of legal rationality, the book focuses on free movement rights of TCNs within EU treaties and implementing legislation, the Area of Freedom Security and Justice, and Association Agreements. Ball concludes that the stance of European Union Law towards third country nationals lacks legitimacy, and suggests possible new directions that EU policy should take in the future.

The third volume of this invaluable sourcebook covers three main subject areas. First, the metaphysics of Aristotle's logical works: the concepts of universal and particular underwent surprising transformations in this period, which gave rise to debates, still raging today, on personal survival after an interruption such as death. Second, logic in a more conventional sense: perhaps the most impressive debate was on the existence of the subject in singular and universal statements. There was also debate about the very different Aristotelian and Stoic conceptions of syllogism, of modal logic, of induction, of the nature of mathematics, and of philosophy of language. Third, the higher metaphysics of the Neoplatonists taught Augustine, and indirectly Descartes, to look for truth within themselves. The Neoplatonists struggled with the question whether our higher intellectual selves have distinct individuality, and thus they fed both sides in the great medieval debate between Aquinas and the followers of Averroes on individual human immortality. All sources appear in English translation and are carefully linked and cross-referenced by editorial comment and explanation. Bibliographies are provided throughout.

Separation and divorce have become an inevitable factor in American society. Even those of us who have not experienced these events di rectly have been touched by them through association with parents, friends, neighbors, or co-workers. Frequently, we have observed these individuals express a variety of negative emotions, including insecurity, anxiety, depression, fear, and anger. If children are involved, their par ents' decisions and often dysfunctional maneuvers in this matter will most likely have a profound affect on them. One such decision will be with whom they will live. Although the great majority of children will live with their mothers following a divorce, this arrangement is no longer accepted as inevitable. Changes such as an ever-increasing num ber of mothers with full-time out of home employment and research supporting the significance and competence of fathers in child rearing have led many observers to challenge the assumption of maternal supe riority. These changes, as well as those related to the law and child cus tody, for example the increased acceptability of a joint custody arrange ment, have complicated the process of deciding where a child should live after his or her parents' divorce. Consequently, others are fre quently called upon to assist in the decision making and render an opin ion concerning custody and visitation. By and large these individuals will be members of the mental health profession.
