Two great themes dominate the book: (1) the origins, development, and pervasive influence of the jury system and judge/jury relations across eight centuries of Anglo-American civil and criminal justice; and (2) the law/equity division, from the emergence of the Court of Chancery in the fourteenth century down through equity's conquest of common law in the Federal Rules of Civil Procedure. The chapters on criminal justice explore the history of pretrial investigation, policing, trial, and sentencing, as well as the movement in modern times to nonjury resolution through plea bargaining. Considerable attention is devoted to distinctively American developments, such as the elective bench, and the influence of race relations on the law of criminal procedure. Other major subjects of this book include the development of the legal profession, from the serjeants, barristers, and attorneys of medieval times down to the transnational megafirms of twenty-first century practice; the literature of the law, especially law reports and treatises, from the Year Books and Bracton down to the American state reports and today's electronic services; and legal education, from the founding of the Inns of Court to the emergence and growth of university law schools in the United States.

Interorganizational Collaboration: Complexity, Ethics, and Communication centers around three key assertions: (1) interorganizational collaboration is complex and warrants study as a specific type of leadership and communication; (2) successful collaborative relationships are grounded in a principled ethic of democratic and egalitarian participation; and (3) interorganizational collaboration requires a specific communication language of practice. Interorganizational collaboration is influenced by increased interconnectedness, shifting organizational needs, and a changing workforce. Collaboration invokes ethical questions and ethical responsibilities that must be considered in communication practices and structures. Although there are many popular books and practitioner materials on collaboration, most are not focused on introducing foundational concepts to a novice audience. In addition, the subject of communication in collaboration has been somewhat underdeveloped. The authors focus on communication from a social constructionist stance. One of their primary goals is to develop a collaboration pedagogy based on existing communication scholarship. The authors present communicative practices vital to interorganizational participation, and they view collaboration as something beyond an exchange of resources and knowledge. Unlike group and organizational texts that approach collaboration from a functional or strategic perspective, this text anchors collaboration in the assumption that democratic and principled communication will foster creative and accountable outcomes for participants in collaborative problem solving. The authors articulate a collaborative ethic useful in all communicative contexts. Micropractices of communication are fundamental not only to collaborating across organizations but also to fostering just and trusting relationships. The book discusses the cornerstone assumptions and principled practices necessary for stakeholders to address problems—for example, recognizing and validating the needs of fellow stakeholders; separating people’s positions from underlying interests; listening for things that are never quite said; identifying overlapping commonalities; building trust while respecting difference; and constructively navigating conflict. The book also focuses on building collaborative praxis based on the assumption of contingency. It focuses upon significant medical and social changes in the transplantation of human organs and on the development and clinical testing of the Jarvik-7 artificial heart, with special emphasis on how these biomedical events were related to the political, economic, and social climate of American society. Part I examines the important biomedical advances and events in organ transplantation and their social and cultural concomitants. In Part II, the focus shifts to the story of the rise and fall of the Jarvik-7 artificial heart in the United States, its relation to American social institutions and cultural patterns, and its bearing on social control issues associated with therapeutic innovation and the patient-oriented clinical research it entails. Part III is a personal conclusion, which explains why the authors left the field of organ transplantation after so many years. Spare Parts is written in a narrative, ethnographic style, with thickly descriptive, verbatim, and atmospheric detail. The primary data it is based upon includes qualitative materials, collected via participant observation, interviews in a variety of medical milieu, and content analysis of medical journals, newspapers, and magazine articles, and a number of television transcripts. The new introduction provides an overview of some of the recent developments in transplantation and also underscores how tenacious many of the patterns associated with organ replacement have been. Spare Parts should be read by all medical professionals, sociologists, and historians.

A significant work of neotropical archaeology presenting evidence of early hunter-gatherers who produced fiber-tempered ceramics. Few topics in the development of humans have prompted as much interest and debate as those of the origins of pottery and agriculture. The first appearance of pottery in any area of the world is heralded as a new stage in the progress of humans toward a more complex arrangement of thought and society. Cultures are defined and separated by the occurrence of pottery types, and the association of pottery with mobility and agriculture continues to drive research in anthropology. For these reasons, the discovery of the earliest fiber-tempered pottery in the New World and carbonized remains identified as maize kernels is exciting. San Jacinto 1 is the archaeological site located in the savanna region of the north coast of Colombia, South America, where excavations by led by the authors have revealed evidence of mobile hunter-gatherers who made pottery and who collected and processed plants from 6000 to 5000 B.P. The site is believed to show an early human adaptation to the tropics in the context of significant environmental changes that were taking place at the time. This volume presents the data gathered and the interpretations made during excavation and analysis of the San Jacinto 1 site. By examining the social activities of a human population in a highly seasonal environment, it adds greatly to our contemporary understanding of the historical ecology of the tropics. Study of the artifacts excavated at the site allows a window into the early processes of food production in the New World. Finally, the data reveals that the origins of ceramic technology in the tropics were tied to a reduction in mobility and an increase in territoriality and are widely applicable to similar studies of sedentism and agriculture worldwide.
