Although ideally a patent system for pharmaceuticals should serve to incentivize research into the development of new medicines, the COVID-19 pandemic has exposed the equal importance of drug access and affordability. This book, by focusing on the Brazilian rule which makes the grant of pharmaceutical patents dependent on the prior consent of the National Health Surveillance Agency (ANVISA), shows how the Brazilian model affords an example for other countries to follow in dealing with tensions between patent protection and the right to healthcare. Based on an empirical study in which the author examined 147 reports issued by ANVISA as a basis for its decisions, the book deals with such central questions concerning the interface of regulation and innovation in the patent system as the following: compatibility between ANVISA’s prior consent mechanism and the Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement; how “evergreening” and “trivial patents” undermine public health and access to medicines; ways of correcting abuses of patent rights and controlling quality of patents; and the discourse on health as a human right. Along with her examination of ANVISA reports, the author analyzes how Article 229-C LPI, which introduced the need of ANVISA’s prior consent to the patent grant of pharmaceuticals in Brazil, has been interpreted in Brazilian case law. Interviews with Brazilian experts are also included. In its commitment to harmonizing patent rights and the right to access of affordable medicines, Brazil’s patent system for pharmaceuticals stands out as a workable response to the basic problem of access to medicines in the developing world. By describing the successes and failures in the Brazilian policy of promoting drug access, this book helps policymakers in developing and emerging countries to better explore TRIPS flexibilities when dealing with similar problems, and provides practitioners in the law of the World Trade Organization, patent law, competition law, and health law with a guide to how a more equitable pharmaceutical patenting system could work in practice.

The possibility of stimulated light emission was discussed by Einstein in 1917, eight years before the quantum-mechanical description of energy levels of many-electron systems. Though it is imperative to use samples having optical properties greatly different from the stan dard continuous spectrum of opaque objects ("black body" radia tion) it is not always necessary to restrict the study to monatomic entities. Thus, spectral lines can be obtained (in absorption and in emission) from lanthanide compounds, containing from one to thir teen 4f electrons going from trivalent cerium to ytterbium, that are nearly as sharp as the ones from gaseous atoms. However, the presence of adjacent atoms modifies the simple picture of an isolated electron configuration, and in particular, it is possible to pump excited levels efficiently by energy transfer from species with intense absorption bands, such as the inter-shell transitions of other lanthanides and of thallium(I), lead(II) and bismuth(III) or the electron transfer bands of the uranyl ion or other complexes. On the other hand, it is possible to diminuish the mUlti-phonon relaxation (competing with sharp line luminescence) by selecting vitreous or crystalline materials with low phonon energies. Obviously, one cannot circumvent the conservation of energy by lasers, but they may have unprecedented consequences for the future by allowing nuclear fusion of light elements, effects of non-linear optics and time-resolved spectroscopy, besides the more conventional applications of coherent light beams with negligible angular extension.

Renata Viganò was an active member of the Italian Resistance during World War II, and, like many of her male counterparts, she depicted the actions of the brave people who contributed to and participated in the partisan movement. Unlike her counterparts, however, Viganò vividly portrayed the experiences of women, notably women on the front line, in her posthumously published Matrimonio in brigata, here translated for the first time in English as Partisan Wedding. "If it had not been for them, the women . . . who got used to `men's business,' . . . the partisan army would have lost a vital, necessary force." The women in Partisan Wedding joined the struggle for many reasons; some for their husbands, others for their fathers, brothers, or sons; some for a sense of justice and the desire to do what was right. Whatever the cause, Viganò demonstrates that women maintained the ability to nurture and to care, to preserve their female qualities in the face of war. Because of her own role as a partisan, the stories in Partisan Wedding are based on Viganò's personal experiences. Two stories in the collection are specifically autobiographical: "Acquitted" and "My Resistance." Relating her own plight to find her husband, a partisan commander, after his sudden arrest, "Acquitted" aptly conveys Viganò's struggle to maintain her strength in the face of complete helplessness. "My Resistance" is a personal account of her own experiences during the war and the women she met along the way. Partisan Wedding is an invaluable contribution to the literature of the Second World War, completing the picture of those involved in the struggle for freedom. Viganò's remarkable prose, equally beautiful and terrible in its description of the minute details of human suffering and sacrifice, opens a window to a world that has rarely been seen, and a world not easily forgotten.

Ačkoli probírá celou řadu dílčích témat, kniha se zabývá především třemi standardy textuality, a sice intertextualitou, koherencí a informativitou. V publikaci se všechny tyto standardy protínají v globálním tématu, které je zde jedinečně uchopeno jako soubor relevantních rysů – je ztvárněno v titulech, v klíčových slovech a jejich výskytu v samotném textu a rozvíjí se v jednotlivých odborných subžánrech, tématech odstavců a dále se prohlubuje zahrnutím relevantních citací. Tato monografie se věnuje výhradně psanému odbornému diskursu. Soustavně vychází z analýzy autentických dat diskursu humanitních věd. Publikaci profilují především stylistické, textově-lingvistické a diskursní analýzy, které čerpají z celé škály relevantních teorií včetně aktuálního členění větného, čímž nepřímo ověřují jejich nosnost. Všechny kapitoly předkládají kvantitativní i kvalitativní analýzu dat, mezi těmito pohledy usilují o rovnováhu a pokoušejí se vždy o funkční interpretaci zjištění. Z epistemologického hlediska jsou všechny studie zahrnuté do této publikace pevně spjaty s funkčně strukturalistickou tradicí Pražské školy, která je přirozeně obohacena o moderní přístupy ze světové lingvistiky. This monograph deals with English academic discourse and focuses on some of its constitutive features. Although a variety of particular topics are addressed, the volume is largely centred on three standards of textuality, namely intertextuality, coherence, and informativity. In this book, all these standards meet in the Global Theme, which is grasped here uniquely as a cluster of relevant features – embodied by the titles, lists of keywords and their in-text use, and further developed through diverse academic subgenres, through paragraph themes and enhanced by integrating relevant citations. This monograph explores written academic discourse exclusively. It is firmly established on the systematic investigation of authentic data drawn from the discourse of the humanities. The book profiles stylistic, text linguistic and discourse analyses, employing a range of relevant theories, including the Functional Sentence Perspective, and thus indirectly verifying their viability. All the chapters provide quantitative as well as qualitative analyses of data, striving to achieve an appropriate balance and to interpret the findings functionally. From the epistemological viewpoint, all of the studies involved in the monograph are rooted in the Prague functionalist tradition, naturally enriched by modern approaches from world linguistics.

This book looks at an allegation of betrayal made against a young Foreign Office clerk, Victor Buckley, who, it was claimed, leaked privileged information to agents of the southern States during the American Civil War. As a consequence, the CSS Alabama narrowly escaped seizure by the British government and proceeded to wage war on American shipping. Victor Buckley’s background is examined against the hitherto erroneous belief that he was an insignificant member of the foreign office staff. The American minister Charles Francis Adams oversees a network of spies endeavoring to prove contravention of The Foreign Enlistment Act. The South’s agents, Captain James D. Bulloch and Major Caleb Huse, are the prime targets, and a battle of wits ensues as Bulloch oversees construction of his ships on Merseyside. A member of a prominent City family offers to enlist the help of a relative who, he claims, holds a confidential position in the Foreign Office. The Confederate agents are soon receiving information about the status of Anglo-American diplomacy and are able to outwit the Union spies and dispatch arms and supplies to the South. Their coup d'état is achieved with the arrival of a message that hurries the Confederate’s most formidable warship out of British waters. After the escape of the Alabama, the government moves to curtail Bulloch’s operations. When the war ends in 1865, investigations begin into the circumstances surrounding the Alabama’s departure. As America demands reparation, evidence apparently incriminating Victor Buckley is acquired, but before the claim reaches its hearing in Geneva, diplomatic moves (some involving Anglo-American Masonic influence) result in a treaty and ensure that no allegation is made against any individual member of foreign office staff. Queen Victoria, anxious to see the Alabama claims settled, is spared embarrassment. A scandal erupts in the foreign office in 1878 as a freelance clerk, Charles Marvin, leaks sensitive information to the press and subsequently writes of his experiences, revealing much of the ethos of the office pertinent to Buckley’s story. The writer Arthur Conan Doyle becomes fascinated by Anglo-American diplomacy and the Alabama question, and, soon after joining a London gentlemen’s club where Buckley’s alleged contact is a member, writes a Sherlock Holmes story involving a Foreign Office clerk’s apparent betrayal. Coincidentally, Conan Doyle has been acquainted with Buckley’s associate some years earlier, and he soon makes a thinly veiled appearance in a fictional work by England’s most famous crime writer.

I wake up in the middle of the night, reach for my writing pad and start writing in the dark. It is difficult to figure out all the scribbling the next morning. If I would turn on the light, these thoughts would disappear in a hurry, reality will set in. My best thoughts are at night, my brain is clear and I can remember the smallest details. Mostly about my early childhood, my war experiences and the struggles that accompanied that period of my life. During the daytime these thoughts are tucked away, deep in my brain and I avoid remembering those years. It’s now all in the past, but it should be remembered, because if I don’t remember my past, I cannot enjoy my future.

This book examines the (in)visibility of romantic love in the legal discourse surrounding modern Australian marriage. It looks at how romantic love has become a core part of modernity, and a dominant part of the Western marriage discourse, and considers how the ideologies of romantic love are (or are not) replicated in the legal meaning of marriage. This examination raises two key issues. If love has become central to people’s understanding of marriage, then it is important for the legitimacy of law that love is reflected in both the content and application of the law. More fundamentally, it requires us to reconsider how we understand law, and to ask whether it is engaged with emotions, or separate from them. Along the way this book also considers the meaning of love itself in contemporary society, and asks whether love is a radical force capable of breaking down conservative meanings embedded in institutions like marriage, or whether it simply mirrors them. This is the first full-length explicitly identified autoethnographic text on African American motherhood. It shows the lived experiences of Black motherhood, when mothering is shaped by race, gender, and class, and mothers must navigate not only their own, but also their children's positions in society. Ferdinand takes an intimate look at her mothering strategies spanning ten years (from 2007 to 2017), preparing her daughter to traverse a racist and sexist society. It is a multi-generational text that blends the author’s experience with that of her own mother, grandmother, and her daughter, to engage in a larger discussion of African American/Black mother/womanhood. It is grounded within Black Feminist Theory, which centers the experiences of Black women within the domains of intersecting oppressions. It is from a very personal position that Ferdinand provides a glimpse into the minutiae of mothering that reveal the everyday intricacies of Black women as mothers. It highlights specific strategies Black mothers use to combat discrimination and oppression, from teaching their children about the n-word to choosing positive representations of Black identity in movies, books, dolls, daycares, elementary schools, and even extra-curricular activities. It shows the impact that stereotypical manifestations of Black femininity have on Black women’s experience of motherhood, and how this affects Black women and girls' understanding of themselves, especially their skin color, body shape, and hair texture. As an interdisciplinary text, this book will be reading for academics and students in a broad range of fields, including Education, African American Studies, Communication Studies, Women Studies, Psychology and Health Studies. It is also a handbook of lived experience for Black mothers, grandmothers, and daughters, and for all mothers, grandmothers, and daughters irrespective of color.
