Applying innovative interpretive strategies drawn from cultural studies, this book considers the perennial question of law and politics: what role do the founding fathers play in legitimizing contemporary judicial review? Susan Burgess uses narrative analysis, popular culture, parody, and queer theory to better understand and to reconstitute the traditional relationship between fatherhood and judicial review. Unlike traditional, top-down public law analyses that focus on elite decision making by courts, legislatures, or executives, this volume explores the representation of law and legitimacy in various sites of popular culture. To this end, soap operas, romance novels, tabloid newspapers, reality television, and coming out narratives provide alternative ways to understand the relationship between paternal power and law from the bottom up. In this manner, constitutional discourse can begin to be transformed from a dreary parsing of scholarly and juristic argot into a vibrant discussion with points of access and understanding for all.
This book argues that the Constitution has a dual nature. The first aspect, on which legal scholars have focused, is the degree to which the Constitution acts as a binding set of rules that can be neutrally interpreted and externally enforced by the courts against government actors. This is the process of constitutional interpretation. But according to Keith Whittington, the Constitution also permeates politics itself, to guide and constrain political actors in the very process of making public policy. In so doing, it is also dependent on political actors, both to formulate authoritative constitutional requirements and to enforce those fundamental settlements in the future. Whittington characterizes this process, by which constitutional meaning is shaped within politics at the same time that politics is shaped by the Constitution, as one of construction as opposed to interpretation. Whittington goes on to argue that ambiguities in the constitutional text and changes in the political situation push political actors to construct their own constitutional understanding. The construction of constitutional meaning is a necessary part of the political process and a regular part of our nation's history, how a democracy lives with a written constitution. The Constitution both binds and empowers government officials. Whittington develops his argument through intensive analysis of four important cases: the impeachments of Justice Samuel Chase and President Andrew Johnson, the nullification crisis, and reforms of presidential-congressional relations during the Nixon presidency.

On December 13, 1937, the Japanese army attacked and captured the Chinese capital city of Nanjing, planting the rising-sun flag atop the city's outer walls. What occurred in the ensuing weeks and months has been the source of a tempestuous debate ever since. It is well known that the Japanese military committed wholesale atrocities after the fall of the city, massacring large numbers of Chinese during the both the Battle of Nanjing and in its aftermath. Yet the exact details of the war crimes--how many people were killed during the battle? How many after? How many women were raped? Were prisoners executed? How unspeakable were the acts committed?--are the source of controversy among Japanese, Chinese, and American historians to this day. In The Making of the "Rape of Nanking" Takashi Yoshida examines how views of the Nanjing Massacre have evolved in history writing and public memory in Japan, China, and the United States. For these nations, the question of how to treat the legacy of Nanjing--whether to deplore it, sanitize it, rationalize it, or even ignore it--has aroused passions revolving around ethics, nationality, and historical identity. In The Wild Irish Girl, the powerful Irish heroine's marriage to a heroic Englishman symbolizes the Anglo-Irish novelist Lady Morgan's re-imagining of the relationship between Ireland and Britain and between men and women. Using this most influential of pro-union novels as his point of departure, Thomas J. Tracy argues that nineteenth-century debates over what constitutes British national identity often revolved around representations of Irishness, especially Irish womanhood. He maps out the genealogy of this development, from Edgeworth's Castle Rackrent through Trollope's Irish novels, focusing on the pivotal period from 1806 through the 1870s. Tracy's model enables him to elaborate the ways in which gender ideals are specifically contested in fiction, the discourses of political debate and social reform, and the popular press, for the purpose of defining not only the place of the Irish in the union with Great Britain, but the nature of Britishness itself.
