Applying innovative interpretive strategies drawn from cultural studies, this book considers the perennial question of law and politics: what role do the founding fathers play in legitimizing contemporary judicial review? Susan Burgess uses narrative analysis, popular culture, parody, and queer theory to better understand and to reconstitute the traditional relationship between fatherhood and judicial review. Unlike traditional, top-down public law analyses that focus on elite decision making by courts, legislatures, or executives, this volume explores the representation of law and legitimacy in various sites of popular culture. To this end, soap operas, romance novels, tabloid newspapers, reality television, and coming out narratives provide alternative ways to understand the relationship between paternal power and law from the bottom up. In this manner, constitutional discourse can begin to be transformed from a dreary parsing of scholarly and juristic argot into a vibrant discussion with points of access and understanding for all.

Going to Market rethinks women’s contributions to the early modern commercial economy. A number of previous studies have focused on whether or not the early modern period closed occupational opportunities for women. By attending to women’s everyday business practices, and not merely to their position on the occupational ladder, this book shows that they could take advantage of new commercial opportunities and exercise a surprising degree of economic agency. Through an investigation of a broad range of primary sources - including popular literature, criminal records, and civil litigation depositions - the study reconstructs how women did business and negotiated with male householders, authorities, customers, and competitors.

The significance of Robert Boyle (1627-91) as the most influential English scientist in the generation before Newton is now generally acknowledged, but the complexity and eclecticism of his ideas has also become increasingly apparent. This volume presents an important group of studies of Boyle by Michael Hunter, the leading expert on Boyle’s life and thought. It forms a sequel to two previous books: Hunter’s Robert Boyle: Scrupulosity and Science (2000) and The Boyle Papers: Understanding the Manuscripts of Robert Boyle (2007). Like them, it conveniently brings together material otherwise widely scattered in essay volumes and academic journals, while nearly a third of the book’s content is hitherto unpublished. The collection opens with a substantial introduction that places the studies that follow in the context of existing studies of Boyle; appended to it is an annotated edition of Boyle’s telling list of desiderata for science. Together, these essays add greater depth to our understanding of Boyle, both as an individual and as a natural philosopher.
Born in 1900, Alan Bush, the English composer, conductor and pianist, studied with Corder and Matthay, and privately with John Ireland. He was appointed professor of harmony and composition at the Royal Academy of Music in 1925, a post he held until 1978. In 1929-31, he continued to study at Berlin University and had piano lessons with Moiseiwitsch and Schnabel. The present Source Book documents his works (many of which reflect his Communist sympathies) and the many arrangements of his music by other composers. A wealth of detail is provided, including printed scores, CD recordings, bibliographical material and manuscript scores and their locations, the majority of which have been deposited recently in the British Library by the Bush family. A chronology of the composer's life draws on many sources including letters and scrapbooks.
‘Fallen Among Reformers’ focuses on Stella Miles Franklin’s New Woman protest literature written during her time in Chicago with the National Women’s Trade Union League (1906-1915). This time away from literary pursuits enriched Franklin’s literary productivity and provided a feminist social justice ethics, which shaped her writing. Close readings of Franklin’s (mostly unpublished) short stories, plays, and novels contextualises them in the personal politics of her everyday life and historicises them in the socio-economic and literary realities of early twentieth-century Australia and United States: themes embedded in broader cultural patterns of socialism, pacifism, and feminism.

How did the arguments developed in the debate to abolish the slave trade help to construct a British national identity and character in the late eighteenth century? Srividhya Swaminathan examines books, pamphlets, and literary works to trace the changes in rhetorical strategies utilized by both sides of the abolitionist debate. Framing them as competing narratives engaged in defining the nature of the Briton, Swaminathan reads the arguments of pro- and anti-abolitionists as a series of dialogues among diverse groups at the center and peripheries of the empire. Arguing that neither side emerged triumphant, Swaminathan suggests that the Briton who emerged from these debates represented a synthesis of arguments, and that the debates to abolish the slave trade are marked by rhetorical transformations defining the image of the Briton as one that led naturally to nineteenth-century imperialism and a sense of global superiority. Because the slave-trade debates were waged openly in print rather than behind the closed doors of Parliament, they exerted a singular influence on the British public. At their height, between 1788 and 1793, publications numbered in the hundreds, spanned every genre, and circulated throughout the empire. Among the voices represented are writers from both sides of the Atlantic in dialogue with one another, such as key African authors like Ignatius Sancho, Phillis Wheatley, and Olaudah Equiano; West India planters and merchants; and Quaker activist Anthony Benezet. Throughout, Swaminathan offers fresh and nuanced readings that eschew the view that the abolition of the slave trade was inevitable or that the ultimate defeat of pro-slavery advocates was absolute.

The history of the British working class has until recently been written with a focus on the workplace or on such male organizations as clubs, unions or national political parties. Listening to what she terms 'unruly pirate voices' in early modern English literature, in this study Claire Jowitt offers an original and compelling analysis of the cultural meanings of 'piracy'. By examining the often marginal figure of the pirate (and also the sometimes hard-to-distinguish privateer) Jowitt shows how flexibly these figures served to comment on English nationalism, international relations, and contemporary politics. She considers the ways in which piracy can, sometimes in surprising and resourceful ways, overlap and connect with, rather than simply challenge, some of the foundations underpinning Renaissance orthodoxies-absolutism, patriarchy, hierarchy of birth, and the superiority of Europeans and the Christian religion over other peoples and belief systems. Jowitt's discussion ranges over a variety of generic forms including public drama, broadsheets and ballads, prose romance, travel writing, and poetry from the fifty-year period stretching across the reigns of three English monarchs: Elizabeth Tudor, and James and Charles Stuart. Among the early modern writers whose works are analyzed are Heywood, Hakluyt, Shakespeare, Sidney, and Wroth; and among the multifaceted historical figures discussed are Francis Drake, John Ward, Henry Mainwaring, Purser and Clinton. What she calls the 'semantics of piracy' introduces a rich symbolic vein in which these figures, operating across different cultural registers and appealing to audiences in multiple ways, represent and reflect many changing discourses, political and artistic, in early modern England. The first book-length study to look at the cultural impact of Renaissance piracy, The Culture of Piracy, 1580-1630 underlines how the figure of the Renaissance pirate was not only sensational, but also culturally significant. Despite its transgressive nature, piracy also comes to be seen as one of the key mechanisms which served to connect peoples and regions during this period.
Seventeenth-century England was a country obsessed with property rights. For only those who owned property were considered to have a vested interest in the maintenance of law, order and social harmony. As such, establishing the ownership of 'things' was a constant concern for all people, and nowhere is this more evident than in the cases of disputed wills. Based on a wealth of surviving evidence from the Prerogative Court of Canterbury, the probate jurisdiction which probated wills of the more wealthy English property owners as well as some of those with a more modest quantity of property, this book investigates what litigation over the validity of wills reveals about the interplay between society and law. The volume investigates, catalogs, and systematizes the legal issues that were raised in will disputes in the Canterbury Court in the last half of the seventeenth century. However, this is not just a book about law and legal practice. The records from which it draws plunge us into deeply personal and often tragic situations, revealing how the last requests of the dead and dying were often ignored or misinterpreted by family, friends and creditors for their own benefit. By focusing on property law as reflected in cases of disputed wills, the book provides a glimpse at a much fuller spectrum of society than is often the case. Even people of relatively modest means were concerned to pass on their possessions, and their cases provide a snapshot of the type of objects owned and social relationships revealed by patterns of bequests. This too is true for women, who despite being denied full participation in many areas of civic life, are frequently encountered as key players in court cases over disputed wills. What emerges from this study is a picture of a society for which notions of law and private property were increasingly intertwined, yet in which courts were less concerned with formality than with ensuring that the intentions of will-makers were properly carried out.
Police departments across the country are busily "reinventing" themselves, adopting a new style known as "community policing". This approach to policing involves organizational decentralization, new channels of communication with the public, a commitment to responding to what the community thinks their priorities ought to be, and the adoption of a broad problem-solving approach to neighborhood issues. Police departments that succeed in adopting this new stance have an entirely different relationship to the public that they serve. Chicago made the transition, embarking on what is now the nation's largest and most impressive community policing program. This book, the first to examine such a project, looks in depth at all aspects of the program--why it was adopted, how it was adopted, and how well it has worked.

Until the Chace Act in 1891, no international copyright law existed between Britain and the United States, which meant publishers were free to edit text, excerpt whole passages, add new illustrations, and substantially redesign a book's appearance. In spite of this ongoing process of transatlantic transformation of texts, the metaphor of the book as a physical embodiment of its author persisted. Jessica DeSpain's study of this period of textual instability examines how the physical book acted as a major form of cultural exchange between Britain and the United States that called attention to volatile texts and the identities they manifested. Focusing on four influential works—Charles Dickens's American Notes for General Circulation, Susan Warner's The Wide, Wide World, Fanny Kemble's Journal of a Residence on a Georgian Plantation, and Walt Whitman's Democratic Vistas—DeSpain shows that for authors, readers, and publishers struggling with the unpredictability of the textual body, the physical book and the physical body became interchangeable metaphors of flux. At the same time, discourses of destabilized bodies inflected issues essential to transatlantic culture, including class, gender, religion, and slavery, while the practice of reprinting challenged the concepts of individual identity, personal property, and national identity.

The greater part of the fourteen volumes of his collected writings concerns the history, the colonial development, and increasingly the threat presented by the Orient in all its manifestations--human, animal, and microbiological. This remarkable book, which is an account of De Quincey's fears of all things oriental, is also an extraordinary analysis of the psychopathology of mid-Victorian imperialist culture. John Barrell paints a picture of De Quincey as a happy family man, apparently at ease with himself and with the rest of the world, but in fact harboring and expressing the most ferocious and brutal denunciation of Orientals of all kinds and dreaming of exacting from them a terrible retribution. Barrell shows that throughout De Quincey's writings there is a repeated story of the murder or violation of a female victim--either within or outside De Quincey's family--by an oriental criminal This story finds its way into almost everything he wrote: the various versions of his autobiography, his novels and short stories, his biographical and critical writings, his essays on politics, history, and science. Barrell attempts to understand this European terror of the East by an approach that is both historical and psychoanalytic. In particular, he explores the relation between childhood anxiety and imperial guilt in a body of writing in which the fear of violence within the family is imaged as a fear of the oriental, and the private and the public, the sexual and the imperial, the feminine and the exotic are endlessly intertwined. This book will be fascinating reading for those interested in Victorian literature, in psychoanalysis and its relation to literature, in the history of imperialism, and in debates about the characteristics and effects of colonial discourse.

Common women" in medieval England were prostitutes, whose distinguishing feature was not that they took money for sex but that they belonged to all men in common. Common Women: Prostitution and Sexuality in Medieval England tells the stories of these women's lives: their entrance into the trade because of poor job and marriage prospects or because of seduction or rape; their experiences as streetwalkers, brothel workers or the medieval equivalent of call girls; their customers, from poor apprentices to priests to wealthy foreign merchants; and their relations with those among whom they lived. Common Women crosses the boundary from social to cultural history by asking not only about the experiences of prostitutes but also about the meaning of prostitution in medieval culture. The teachings of the church attributed both lust and greed, in generous measure, to women as a group. Stories of repentant whores were popular among medieval preachers and writers because prostitutes were the epitome of feminine sin. Through a sensitive use of a wide variety of imaginative and didactic texts, Ruth Karras shows that while prostitutes as individuals were marginalized within medieval culture, prostitution as an institution was central to the medieval understanding of what it meant to be a woman. This book investigates how and why the criminal law differentiates between different types of body alterations, with particular reference to how they are conceptualised within legal discourse. The body alterations that are addressed include sadomasochistic injuries; female genital modification and male circumcision; cosmetic surgery, body modification and healthy limb amputation; and sex reassignment surgery and genital ‘normalisation’ surgery. The author analyses the techniques and processes by which some body alterations are discursively constructed as legitimate and legally approved whilst other body alterations are discursively constructed as illegitimate and legally sanctioned.

In this original study, Jamie Mayerfeld undertakes a careful inquiry into the meaning and moral significance of suffering. Understanding suffering in hedonistic terms as an affliction of feeling, he addresses difficulties associated with its identification and measurement. He then turns to an examination of the duty to relieve suffering: its content, its weight relative to other moral considerations, and the role it should play in our lives. Among the claims defended in the book are that suffering needs to be distinguished from both physical pain and the frustration of desire, that interpersonal comparisons of the intensity of happiness and suffering are possible, that several psychological processes hinder our awareness of other people's suffering, and that the prevention of suffering should often be pursued indirectly.
