This book contends that modern concerns surrounding the UK State’s investigation of communications (and, more recently, data), whether at rest or in transit, are in fact nothing new. It evidences how, whether using common law, the Royal Prerogative, or statutes to provide a lawful basis for a state practice traceable to at least 1324, the underlying policy rationale has always been that first publicly articulated in Cromwell’s initial Postage Act 1657, namely the protection of British ‘national security’, broadly construed. It further illustrates how developments in communications technology led to Executive assumptions of relevant investigatory powers, administered in conditions of relative secrecy. In demonstrating the key role played throughout history by communications service providers, the book also charts how the evolution of the UK Intelligence Community, entry into the ‘UKUSA’ communications intelligence-sharing agreement 1946, and intelligence community advocacy all significantly influenced the era of arguably disingenuous statutory governance of communications investigation between 1984 and 2016. The book illustrates how the 2013 ‘Intelligence Shock’ triggered by publication of Edward Snowden’s unauthorized disclosures impelled a transition from Executive secrecy and statutory disingenuousness to a more consultative, candid Executive and a policy of ‘transparent secrecy’, now reflected in the Investigatory Powers Act 2016. What the book ultimately demonstrates is that this latest comprehensive statute, whilst welcome for its candour, represents only the latest manifestation of the British state’s policy of ensuring protection of national security by granting powers enabling investigative access to communications and data, in transit or at rest, irrespective of location.

In June 1942 the Indian Army suffered a major defeat at the hands of the Japanese Army and subsequently endured its longest retreat ever. The Japanese forces had proved more mobile in tactics and more motivated and seasoned in warfare. As a result, the Indian Army assessed its mistakes to determine what changes were needed to rebuild itself into a more capable fighting force. Marston looks at the Indian Army as a reform-minded organization, one that was able to take lessons from this major defeat, implement the necessary reforms, and ultimately defeat the Japanese soundly in 1945. Army leaders instigated analysis of the defeat at all levels of command. Innovations in operational procedure, organization, and tactics were compared, discussed, then implemented. An ongoing reassessment continued both during and after subsequent engagements. By analyzing the changes made in tactical doctrine, reinforcement procedure, Indianization of the officer corps, and the quality of nonmartial race units, Marston demonstrates that the Indian Army of 1945 was vastly different from that of 1939. The Indian Army's transformation into a highly professional force contradicts the commonly held belief that it was too conservative a force to reform itself thoroughly in the face of new challenges.

In asymmetric interstate conflicts, great powers have the capability to coerce weak states by threatening their survival—but not vice versa. It is therefore the great power that decides whether to escalate a conflict into a crisis by adopting a coercive strategy. In practice, however, the coercive strategies of the U.S. have frequently failed. In Coercion, Survival and War Phil Haun chronicles 30 asymmetric interstate crises involving the US from 1918 to 2003. The U.S. chose coercive strategies in 23 of these cases, but coercion failed half of the time: most often because the more powerful U.S. made demands that threatened the very survival of the weak state, causing it to resist as long as it had the means to do so. It is an unfortunate paradox Haun notes that, where the U.S. may prefer brute force to coercion, these power asymmetries may well lead it to first attempt coercive strategies that are expected to fail in order to justify the war it desires. He concludes that, when coercion is preferred to brute force there are clear limits as to what can be demanded. In such cases, he suggests, U.S. policymakers can improve the chances of success by matching appropriate threats to demands, by including other great powers in the coercive process, and by reducing a weak state leader's reputational costs by giving him or her face-saving options.
