Why do states protect refugees? In the past twenty years, states have sought to limit access to asylum by increasing their border controls and introducing extraterritorial controls. Yet no state has sought to exit the 1951 Refugee Convention or the broader international refugee regime. This book argues that such international policy shifts represent an ongoing process whereby refugee protection is shaped and redefined by states and other actors. Since the seventeenth century, a mix of collective interests and basic normative understandings held by states created a space for refugees to be separate from other migrants. However, ongoing crisis events undermine these understandings and provide opportunities to reshape how refugees are understood, how they should be protected, and whether protection is a state or multilateral responsibility. Drawing on extensive archival and secondary materials, Phil Orchard examines the interplay among governments, individuals, and international organizations that has shaped how refugees are understood today.
Phil Gioia grew up an army brat during the decades after World War II. Drawn to the military, he attended the Virginia Military Institute, then was commissioned in the U.S. Army, where he completed Jump School and Ranger School. Not even a year after college graduation, he landed in Vietnam in early 1968—in the first weeks of the Tet offensive, which marked a major escalation of the war. Leading a platoon in the 82nd Airborne Division, Gioia took his paratroopers into the lifting of the siege of Hué—where death was always just around the corner—and the grisly discovery of mass graves of those executed by the Vietcong, during their occupation of the city. Wounded, he was sent home in April. Released from hospital, he commanded a paratroop company in the 82nd Airborne in 1968, returning to Vietnam with the hard-hitting First Air Cavalry Division a year later, this time leading a rucksack company of light infantry. Inserted into far-flung landing zones, Gioia and his men patrolled the jungles and rubber plantations along the Cambodian border, looking for a furtive enemy who preferred ambushes to set-piece battles and nighttime raids to daylight attacks. In the mid-1970s, a long wave of contentious radicalism swept through Italy. ‘Proletarian youth’, ‘metropolitan Indians’, ‘the area of Autonomy’: a shifting galaxy of groups and movements practised new forms of activism. Factories and universities were occupied; rent and utility payments were withheld; neo-Fascists and drug pushers were attacked on sight. The movements were at once creative and brutal, intransigent and playful. A particular target for mockery was the parliamentary Left, and above all the Italian Communist Party (PCI). An earlier wave of radical activism had culminated in the Hot Autumn of 1969; then, the PCI had managed to ‘ride the tiger’ of industrial militancy, emerging with its credibility enhanced. Now, however, the PCI was committed to compromise with the ruling Christian Democrats. The second cycle of contention thus ended in a hostile engagement: rather than adopt their policies, the PCI labelled the movements Fascists, criminals and hooligans. By the end of 1977 the movements were broken, while the PCI had moved sharply to the Right. The main beneficiaries were left-wing ‘armed struggle’ groups such as the Red Brigades. Building on Sidney Tarrow’s ‘cycle of contention’ model and drawing on a wide range of Italian materials, Phil Edwards has told the story of a unique and fascinating group of political movements, and of their disastrous engagement with the mainstream Left. As well as shedding light on a neglected period of twentieth century history, this book offers lessons for understanding today’s contentious movements (‘No Global’, ‘Black Bloc’) and today’s ‘armed struggle’ groups.
