Cartel activity is prohibited under EU law by virtue of Article 101(1) of the Treaty on the Functioning of the European Union. Firms that violate this provision face severe punishment from those entities responsible for enforcing EU competition law: the European Commission, the national competition authorities, and the national courts. Stiff fines are regularly imposed on firms by these entities; such firm-focused punishment is an established feature of the antitrust enforcement landscape within the EU. In recent years, however, focus has also been placed on the individuals within the firms responsible for the cartel activity. It is increasingly recognized that punishment for cartel activity should be individual-focused as well as firm-focused. Accordingly, a growing tendency to criminalize cartel activity can be observed in the EU Member States. The existence of such criminal sanctions within the EU presents a number of crucial challenges that need to be met if the underlying enforcement objectives are to be achieved in practice without violating prevailing legal norms. For a start, given the severe consequences of a custodial sentence, the employment of criminal antitrust punishment must be justifiable in principle: one must have a robust normative framework rationalizing the existence of criminal cartel sanctions. Second, for it to be legitimate, antitrust criminalization should only occur in a manner that respects the mandatory legalities applicable to the European jurisdiction in question. These include the due process rights of the accused and the principle of legal certainty. Finally, the correct practical measures (such as a criminal leniency policy and a correctly defined criminal cartel offence) need to be in place in order to ensure that the employment of criminal antitrust punishment actually achieves its aims while maintaining its legitimacy. These three particular challenges can be conceptualized respectively as the theoretical, legal, and practical challenges of European antitrust criminalization. This book analyses these three crucial challenges so that the complexity of the process of European antitrust criminalization can be understood more accurately. In doing so, this book acknowledges that the three challenges should not be considered in isolation. In fact there is a dynamic relationship between the theoretical, legal, and practical challenges of European antitrust criminalization and an effective antitrust criminalization policy is one which recognizes and respects this complex interaction.
By the mid-1930s the obstacles to high speed that aircraft designers faced included the question of cooling the engine. This was a big challenge that those working on the new fast aeroplanes entering service as the war clouds gathered over Europe had to consider, as the drag from the system increased as a square of the speed. Ducted systems were designed which lowered drag, but these were based on the assumption that the system was cold. This ignored the potential energy from the air, heated by the radiator, for liquid-cooled aircraft, and from the discharged engine exhaust gases. It took a profoundly lateral thinker to harness the possibilities of the paradox that heat could cut the cost of cooling. That thinker was the British engineer Frederick William Meredith. A researcher at the Royal Aircraft Establishment at Farnborough until 1938, F.W. Meredith a key player in the UK’s development of the autopilot and remote-controlled aircraft. His contribution to Allied success in the Second World War was enormous – but, incredibly, he was also a known a Soviet agent. Few would doubt that the Supermarine Spitfire was a pioneering aeroplane – not because it was an all metal, monoplane with retractable undercarriage and enclosed cockpit as these were not unique – but because it was the first to incorporate a Meredith designed ducted cooling system. This was intended from the beginning to use heat to create ‘negative drag’. In practice the Spitfire’s design was flawed, as Meredith himself pointed out, and did not fully use what became known as the ‘Meredith Effect’. Meredith also made entirely overlooked but extremely important contributions to resolving the problem of how to induce air smoothly into cooling ducts at high speeds without which, as the Spitfire demonstrated, ducted cooling systems worked sub-optimally. The first aeroplane properly to exploit the ‘Meredith Effect’ was the North American P-51 Mustang, this being a very significant factor as to why it was 30mph faster than the Spitfire when both had the same Rolls-Royce Merlin engine. These papers come from a conference on Neolithic Causewayed Enclosures in Europe held in London in 1999. They present a series of snapshots of some of the sites and regions at the forefront of current research on causewayed enclosures in Europe, and as such are a complement to the Royal Commission on the Historical Monuments of England (RCHME) project which has systematically recorded all known Neolithic enclosures in England by both analytical topographic survey techniques and aerial transcription. The detailed regional data collected by the RCHME project has allowed a radical reinterpretation of these sites and the recognition that there are regional groups of enclosures. This series of papers serves to broaden the discussion about the structure and form of causewayed monuments beyond lowland England, looking at a wide geographical range of sites across central Europe, as well as considering some sites which do not conform to the traditional type but which have been proved by excavation to have a Neolithic context. I Was Gone Long Before I Left is the story about my interior struggle to leave the monastery after living this lifestyle for over twenty-five years. It explores the reasons why I went to the monastery, why I stayed, why I eventually left, and what I have learned. Maybe more importantly, it describes the many years of mental anguish, confusion, and depression that I went through to finally make this decision. It has brought back many painful memories and experiences and called for an honesty and vulnerability that I found daunting. For over thirty-eight years, I have been unable to write about my experience of life in the monastery because I felt ashamed. It was in the closing year of the First World War, on 1 April 1918, that the Royal Air Force was born from the amalgamation of the Royal Flying Corps and Royal Naval Air Service. Since then, the RAF has helped lead the world in the development of aviation and air warfare. This new title in the acclaimed Prehistoric Society Research Papers series focuses on the introduction of Neolithic extraction practices across Europe through to the Atlantic periphery of Britain and Ireland. The key research questions are when and why these practices were adopted, and what role extraction sites played in Neolithic society. Neolithic mines and quarries have frequently been seen as fulfilling economic roles linked to the expansion of the Neolithic economy. However, this ignores the fact that many communities chose to selectively dig for certain types of stone in preference to others, and why the products from these sites were generally deposited in special places such as wetlands. To address this question, 168 near-global ethnographic studies were analysed to identify common trends in traditional extraction practises to produce robust statistics about their motivations and material signatures. Repeated associations emerged between storied locations, the organisation of extraction practises, long-distance distribution of products, and the material evidence such activities left behind. This suggests that we can now probably identify mythologised/storied sites, seasonality, ritualised extraction, and the uselife of extraction site products. The ethnographic model was tested against data from 223 near-global archaeological extraction sites which confirmed a similar patterning in both material records, suggesting it can be used to interpret broad trends in many cross-cultural contexts and time periods. Finally, the new ethnoarchaeological model has been used to analyse the social context of 79 Neolithic flint mine and 51 axe quarry excavations in Britain and Ireland, and to review their European origins. The evidence which emerges confirms the pivotal role played by Neolithic extraction practices in European Neolithisation, and that the interaction of indigenous foragers with migrant miner/farmers in Britain, Ireland and elsewhere was fundamental to the adoption of the new agro-pastoral lifestyle.
