This study overturns twentieth-century thinking about pasticcio opera. This radical way of creating opera formed a counterweight, even a relief, to the trenchant masculinity of literate culture in the seventeenth century. It undermined the narrowing of nationalism in the eighteenth century, and was an act of gross sacrilege against the cult of Romantic genius in the nineteenth century. In the twentieth century, it found itself on the wrong side of copyright law. However, in the twenty-first century it is enjoying a tentative revival. This book redefines pasticcio as a method rather than a genre of opera and aligns it with other art forms which also created their works from pre-existing parts, including sculpture. A pasticcio opera is created from pre-existing music and text, thus flying in face of insistence on originality and creation by a solo genius.

From 1963 to 1965 roughly 6,000 families moved into Rochdale Village, at the time the world's largest housing cooperative, in southeastern Queens, New York. The moderate-income cooperative attracted families from a diverse background, white and black, to what was a predominantly black neighborhood. In its early years, Rochdale was widely hailed as one of the few successful large-scale efforts to create an integrated community in New York City or, for that matter, anywhere in the United States.Rochdale was built by the United Housing Foundation. Its president, Abraham Kazan, had been the major builder of low-cost cooperative housing in New York City for decades. His partner in many of these ventures was Robert Moses. This study is the first to assess the combined significance of the English-language newspapers of China, Japan and Korea in the period 1918-45. It not only frames the English-language press networks in the international media history of East Asia but also relates them to media developments in the ‘British world’ linking Fleet Street to the Empire and Dominions, and to the rise of the United States as a broker of international opinion on and in the Asia-Pacific. The English-language newspapers occupied a narrow but significant segment of the public sphere in East Asia in the inter-war years.As forums of opinion on Japanese, Chinese and Western interests in East Asia, they also served as vehicles of propaganda, particularly during the crisis-ridden 1930s and the Pacific War. With this examination of the media affiliations, editorial line, and access to official bodies in East Asia and theWest of most of the English-language newspapers published in East Asia in the period under review, the author demonstrates that these publications formed distinct networks in terms of the editorial positions they took vis-a-vis the key issues of the day, especially Japan’s imperial project in East Asia.

Among the many constitutional developments of the past century or so, one of the most significant has been the creation and proliferation of institutions that perform functions similar to those performed by courts but which are considered to be, and in some ways are, different and distinct from courts as traditionally conceived. In much of the common law world, such institutions are called 'administrative tribunals'. Their main function is to adjudicate disputes between citizens and the state by reviewing decisions of government agencies - a function also performed by courts in 'judicial review' proceedings and appeals. Although tribunals in aggregate adjudicate many more such disputes than courts, tribunals and their role as dispensers of 'administrative justice' receive relatively little scholarly attention. This wide-ranging book-length treatment of the subject compares tribunals in three major jurisdictions: Australia the UK and the US. It analyses and offers an account of the concept of 'administrative adjudication', and traces its historical development from the earliest periods of the common law to the twenty-first century. There are chapters dealing with the design of tribunals and tribunal systems and with what tribunals do, what they are for and how they interact with their users. The epic story of the Boer War and Harry 'Breaker' Morant: drover, horseman, bush poet - murderer or hero? Most Australians have heard of the Boer War and of Harry 'Breaker' Morant, a figure who rivals Ned Kelly as an archetypal Australian folk hero. But Morant was a complicated man. Born in England and immigrating to Queensland in 1883, he established a reputation as a rider, polo player and poet who submitted ballads to The Bulletin and counted Banjo Paterson as a friend. Travelling on his wits and the goodwill of others, Morant was quick to act when appeals were made for horsemen to serve in the war in South Africa. He joined up, first with the South Australian Mounted Rifles and then with a South African irregular unit, the Bushveldt Carbineers. The adventure would not go as Breaker planned. In October 1901 Lieutenant Harry Morant and two other Australians, Lieutenants Peter Handcock and George Witton, were arrested for the murder of Boer prisoners. Morant and Handcock were court-martialled and executed in February 1902 as the Boer War was in its closing stages, but the debate over their convictions continues to this day. With his masterful command of story, Peter FitzSimons takes us to the harsh landscape of southern Africa and into the bloody action of war against an unpredictable force using modern commando tactics. Canada, Australia and New Zealand inherited and adapted a monarchical framework of government, even in the absence of a resident monarch. Although steady transfer of the royal prerogative to a popularly elected executive has enabled these three former dominions to be sometimes described as "crowned republics" or "disguised republics", there was no popular drive to abandon monarchy until the 1990s, and even then the republican cause was based largely on issues of symbolism and national identity than on perceived core weaknesses in the political system. This book traces the long and sometimes subtle process of localising monarchy in the vice-regal office from the mid-twentieth century onwards, and compares the powers and functions of the Queen's surrogates with each other and with those of the monarch herself, including their recourse to the so-called "reserve powers". Among the key questions posed in this comparative study are: Can the current monarchical system be refined to the point of countering republican sentiment? Why has the republican argument gained more momentum in Australia than in Canada or New Zealand? Can a republican model retain residual monarchic elements? What is likely to be the lasting legacy of the Crown in these three strikingly similar political cultures? The author's underlying loyalties are neither firmly monarchist nor firmly republican. He is convinced, however, that the combined effects of a strong sense of national identity and an increasingly presidential style of political leadership within these three Westminster-derived systems make it difficult for contemporary governors-general (or their state and provincial colleagues)to fulfil two of their key roles-to unite and inspire the people on the one hand and to be a credible constitutional watchdog on the other.

Spencer Bower: Reliance-Based Estoppel, previously titled Estoppel by Representation, is the highly regarded and long established textbook on the doctrines of reliance-based estoppel, by which a party is prevented from changing his position if he has induced another to rely on it such that the other will suffer by that change. Since the fourth edition in 2003 the House of Lords has decided two proprietary estoppel cases, Cobbe v Yeoman's Row Property Management Ltd and Thorner v Major, whose combined effect is identified as helping to define a criterion for a reliance-based estoppel founded on a representation, namely that the party estopped actually intends the estoppel raiser to act in reliance on the representation, or is reasonably understood to intend him so to act. Other developments in the doctrine of proprietary estoppel have required a complete revision of the related chapter, Chapter 12, in this edition. Thorner v Major confirms too the submission in the fourth edition that unequivocality is a requirement for any reliance-based estoppel founded on a representation. Other views expressed in the fourth edition are also noted to have been upheld, such as the recognition that an estoppel may be founded on a representation of law (Briggs v Gleeds), that a party may preclude itself from denying a proposition by contract as well as another's reliance (Peekay Intermark Ltd v Australia and New Zealand Banking Group Ltd and Springwell Navigation Corp v JP Morgan Chase Bank) and that an estoppel by deed binds by agreement or declaration under seal rather than by reason of reliance (Prime Sight Ltd v Lavarello). With the adjustment reflected in the change of title, and distinguishing the foundation of estoppels that bind by deed and by contract, the editors adopt Spencer Bower's unificatory project by the identification of the reliance-based estoppels as aspects of a single principle preventing a change of position that would be unfair by reason of responsibility for prejudicial reliance. From this follow the views: that reliance-based estoppels have common requirements of responsibility, causation and prejudice; that estoppel by representation of fact is, like the other reliance-based estoppels, a rule of law; that the result of estoppel by representation of fact may, accordingly, be mitigated on equitable grounds to avoid injustice; that the result of an estoppel by convention depends on whether its subject matter is factual, promissory or proprietary; that a reliance-based estoppel (other than a proprietary estoppel, which uniquely generates a cause of action) may be deployed to complete a cause of action where, absent the estoppel, a cause of action would not lie, unless it would unacceptably subvert a rule of law (in particular the doctrine of consideration); that an estoppel as to a right in or over property generates a discretionary remedy; and that the prohibition on the deployment of a promissory estoppel as a sword should be understood as an application of the defence of illegality, viz that an estoppel may not unacceptably subvert a statute or rule of law.
