Adaptations of the Metropolitan Landscape in Delta Regions is about environmental quality and the long term livability of urban areas. In decades to come, climate change will affect cities everywhere, but nowhere have the effects of climate change already been felt as strongly as in low-lying coastal cities, cities located in large river deltas and near tidal estuaries. This book reflects on the contribution that spatial planning and urban design can make to a complex discussion about how city form and landscapes will need to adapt within metropolitan areas. The book’s focus is on the urban form of three delta regions: the Pearl River Delta in Southern China; the Rhine, Maas, and Scheldt Delta in the Netherlands; and the San Francisco Bay Area in Northern California. The three regions differ greatly, but despite their different political systems, history, culture and locations in three different climate zones, all three regions will be forced to respond to similar issues that will trigger transformations and adaptations to their urban form. The idea of human dominion over nature has become entrenched by the dominant rights-based interpretation of private property. Accordingly, nature is not attributed any inherent value and becomes merely the matter of a human property relationship. This book introduces the concept of the Anthropocene and examines its importance for environmental legal thinking, research and practice. Two main arguments are explored. The first is that much of the scholarship in environmental law that addresses the Anthropocene does not respond to Earth systems science or the difference in scale as we move from local to global systems. Key examples include a focus on anthropocentrism, attempts to constitutionalise environmental protections, the prevalence of legal rights and the idea of ecological integrity. The second argument is that these points of focus derive from the prevalence of idealism in environmental legal scholarship. Idealism in this context does not refer to naivety or the presentation of unrealistic goals. Rather, this book is concerned with idealism as a philosophical commitment to the power of ideas to determine reality and drive future change. As expressed in legal scholarship, this book also argues that idealism involves an abstraction from material reality and a refusal to directly engage those forces that have given rise to the Anthropocene. In response, this book uses a method of critique to uncover the presumptions and presuppositions that underlie environmental scholarship. As a counter to idealism, it also sketches out a framework for materialism in the Anthropocene. This book’s engagement with these questions will appeal to undergraduate and postgraduate students in law, politics, philosophy or the ecological humanities. The study finds that the customary ‘no harm’ rule and Article IX of the Outer Space Treaty obligate States to prevent the generation of debris and that the international community as a whole has a legitimate interest in their compliance. A breach of these obligations entails the responsibility of a State and compensation must be provided for damage caused by space debris. The author treats responsibility and liability separately and thoroughly scrutinizes both legal regimes with the help of common analytical elements. Finally, Peter Stubbe argues that a comprehensive traffic management system is required so as to ensure the safe and sustainable use of outer space.

This book explores violence against the environment within the broad scope of transnational environmental crime (TEC): its extent, perpetrators, and responses. TEC has become one of the greatest threats to environmental and human security today, as well as a lucrative enterprise and a mode of life in many regions of the world. Transnational Spheres of Ecoviolence argues that we cannot seriously consider stopping TEC without also promoting environmental (and climate) justice. The spheres covered range from wildlife and plant crime to illegal fisheries to toxic waste and climate crime. These acts of violence against the environment are both localized in terms of event and impact, and globalized in terms of market drivers and internationalized responses. Because it is so often intimately linked to political violence, coerced labor, economic and physical displacement, and development opportunity costs, ecoviolence must be viewed primarily as a human security issue; the fight against it must derive legitimacy from impacts on local communities, and be twinned wth the protection of environmental activists. Reliance on the generosity of distant corporations or the effectiveness of legal structures will not be adequate; and militarized responses may do more harm to human security than good to nature. A transformative approach to transnational ecoviolence is a very complex task affected by the geopolitics of neoliberalism, authoritarian states, rebel factions and extremists, socio-economic patterns, and many other factors. In this challenging text, the authors capture this complexity in digestible form and offer a wide-ranging discussion of commensurate policy recommendations for governments and the general public.
