This textbook presents a range of classical philosophical approaches in order to show that they are unsuitable as a foundation for human rights. Only the conception of human dignity –based on the Kantian distinction between price and dignity – can provide a sufficient basis. The derivation of human rights from the principle of human dignity allows us to identify the most crucial characteristic of human rights, namely the protection of personhood. This in turn makes it possible (1) to distinguish between real moral human rights and spurious ones, (2) to assess the scope of protection for many codified human rights according to the criteria of “core” and “yard,” and (3) offers a point of departure for creating new, unwritten human rights. This philosophical basis supports a substantial reassessment of the case law on human rights, which will ultimately allow us to improve it with regard to legal certainty, clarity and cogency. In the second edition, errors have been corrected in numerous places, the text has been made clearer and easier to understand. In addition, more recent human rights issues have been newly included, especially those related to the Corona epidemic and climate change. The textbook is primarily intended for advanced law students who are interested in a deeper understanding of human rights. It is also suitable for humanities students, and for anyone in the political or social arena whose work involves human rights and their enforcement. Exploring the experiments in individual and national self-consciousness conducted during the Romantic period, this essential comparative study of European literature, philosophy and politics makes original and often surprising connections and contrasts to reveal how personal and social identities were re-orientated and disorientated from the French Revolution onwards. Reviving a contested moment in the history of aesthetic theory, this study shows how the growing awareness of irresolution in Kant's third Kritik allowed Romantic writers to put the aesthetic to radical uses not envisaged by its parent philosophy. It also recounts how they would go on to force philosophy to revise received notions of authority, empowering women and subordinated ethnic groups to re-orientate existing hierarchies. The sheer range and variety of writers covered is testament both to the breadth of writing that Kant's philosophy so rashly legitimated and to the wider importance of philosophy to the understanding of Romantic literature.

This study offers an intercultural theory of interpretation and religion. It does so by bringing Western and East Asian traditions into dialogue regarding the nature of interpretation. The result of this innovative study is a theory of interpretation which integrates the socially embodied dimension of human life with the study of hermeneutics and religion in post-foundational and cross-cultural perspective. Toward this end, Paul Chung offers a constructive theology of divine speech-acts in a manner more amenable to the social-public sphere than other proposals. In all of this he deeply considers intercultural horizon of interpretation between West and East and its implications for a theology of interpretation. The result is a truly theological theory of interpretation that takes seriously the issues of intercultural studies and their intersection with Christian doctrine.

Following Hegel's analysis of art's increasing difficulty to both engage and extricate itself from prosaic reality, Paul Fleming investigates the strategies employed by German literature from 1750 to 1850 for increasingly attuning itself to quotidian life—common heroes, everyday life, non-extraordinary events—while also avoiding all notions of mediocrity. He focuses on three sites of this tension: the average audience (Lessing), the average artist (Goethe and Schiller), and the everyday, or average life (Grillparzer and Stifter). The book's title, Exemplarity and Mediocrity, describes both a disjunctive and a conjunctive relation. Read disjunctively, modern art must display the "exemplary originality" (Kant) that only genius can provide and is thus fundamentally opposed to mediocrity as that which does not stand out or lacks distinctiveness; in the conjunctive sense, modern art turns to non-exceptional life in order to transform it—without forsaking its commonness—thereby producing exemplary forms of mediocrity that both represent the non-exceptional and, insofar as they stand outside the group they represent, are something other than mediocre.

Samuel Taylor Coleridge frequently bridged the gap between British and European Romantic thought. This study sets Coleridge's mode of thinking within a German Romantic philosophical context as the place where his ideas can naturally extend themselves, stretch and find speculations of comparable ambition. It argues that Coleridge found his philosophical adventures in the dominant idiom of his times exciting and as imaginatively engaging as poetry. Paul Hamilton situates major themes in Coleridge's prose and poetic writings in relation to his passion for German philosophy. He argues that Coleridge's infectious attachment to German (post-Kantian) philosophy was due to its symmetries with the structure of his Christian belief. Coleridge is read as an excited and winning expositor of this philosophy's power to articulate an absolute grounding of reality. Its comprehensiveness, however, rendered redundant further theological description, undermining the faith it had seemed to support. Thus arose Coleridge's anxious disguising of his German plagiarisms, aspersions cast on German originality, and his claims to have already experienced their insights within his own religious sensibility or in the writings of Anglican divines and neo-Platonists. This book recovers the extent to which his ideas call to be expanded within German philosophical debate.

Franz Joseph Gall (1758-1828) was always a controversial figure, as was his doctrine, later called phrenology. Although often portrayed as a discredited buffoon, who believed he could assess a person's strengths and weaknesses by measuring cranial bumps, he was, in fact, a serious physician-scientist, who strove to answer timely questions about the mind, brain, and behavior. In many ways a remarkable visionary, his seminal ideas would become tenets of modern behavioral neuroscience. Among other things, he was the first scientist to promote publicly the idea of specialized cortical areas for diverse higher functions, while taking metaphysics out of his new science of mind. Moreover, although he obviously placed too much emphasis on "tell-tale" skull features (mistakenly believing that the cranium faithfully reflects the features of underlying brain areas), he fully understood the strength of "convergent operations," conducting neuroanatomical, developmental, cross-species, gender-comparison, and brain-damage studies on both humans and animals in his attempts to unravel the mysteries of brain organization. Rather than looking upon Gall's "organology" as one of science's great mistakes, this book provides a fresh look at the man and his doctrine. The authors delve into his motives, what was known about the brain during the 1790s, and the cultural demands of his time. Gall is rightfully presented as an early-19th-century biologist, anthropologist, philosopher, and physician with an inquisitive mind and a challenging agenda--namely, how to account for species and individual differences in behavior. In this well-researched book, readers learn why, starting as a young physician in Vienna and continuing his life's work in Paris, he chose to study the mind and the brain, why he employed his various methods, why he relied so heavily on cranial features, and why he wrote what he did in his books. In the early twentieth century, hygiene encompassed the myriad attempts to create healthy spaces for life and work amid the pollution, disease, accidents, and noise of industrial modernity. Examining classic films—including The Last Laugh, Faust, and Kuhle Wampe—as well as documentaries, cinema architecture, and studio practices, Paul Dobryden demonstrates how cinema envisioned and interrogated hygienic concerns about environmental disorder. Framing hygiene within the project of national reconstruction after World War I, The Hygienic Apparatus explores cinema’s material contexts alongside its representations of housework, urban space, traffic, pollution, disability, aging, and labor. Reformers worried about the health risks associated with moviegoing but later used film to popularize hygienic ideas, encouraging viewers to see the world and themselves in relation to public health objectives. Modernist architecture and design fashioned theaters into regenerative environments for fatigued spectators. Filmmakers like F. W. Murnau and Slatan Dudow, meanwhile, explored the aesthetic and political possibilities of dirt, contagion, intoxication, and disorder. Dobryden recovers a set of ecological and biopolitical concerns to show how the problem of environmental disorder fundamentally shaped cinema’s relationship to modernity. Immanuel Kant famously said that he was awoken from his "dogmatic slumbers," and led to question the possibility of metaphysics, by David Hume's doubts about causation. Because of this, many philosophers have viewed Hume's influence on Kant as limited to metaphysics. More recently, some philosophers have questioned whether even Kant's metaphysics was really motivated by Hume. In Knowledge, Reason, and Taste, renowned Kant scholar Paul Guyer challenges both of these views. The anxieties and resentments produced by this new world order among those left behind are oft en manifested in assertions of xenophobia and particularity. Romantic authors and composers developed a unique perspective on the myth, emphasizing its themes of rebellion, punishment for transgression and creative autonomy, in great contrast to artists of the preceding era, who more characteristically ignored the tribulations of Prometheus and depicted him as the animator of a na?, Arcadian mankind who, when awakened from their spiritual dormancy, expressed astonishment at the wonders of nature and paid homage to the Titan as a new god. Paul Bertagnolli charts the progress of the myth during the nineteenth century, as it articulates an extraordinary variety of issues pertaining to culture, society, aesthetics, and philosophy. This volume trace ways in which time is represented in reverse forms throughout modernist culture, from the beginning of the twentieth century until the decade after World War II. Though modernism is often associated with revolutionary or futurist directions, this book argues instead that a retrograde dimension is embedded within it. By juxtaposing the literature of Europe and North America with that of Australia and New Zealand, it suggests how this antipodean context serves to defamiliarize and reconceptualize normative modernist understandings of temporal progression. Backgazing thus moves beyond the treatment of a specific geographical periphery as another margin on the expanding field of 'New Modernist Studies'. Instead, it offers a systematic investigation of the transformative effect of retrograde dimensions on our understanding of canonical modernist texts. The title, 'backgazing', is taken from Australian poet Robert G. FitzGerald's 1938 poem 'Essay on Memory', and it epitomizes how the cultural history of modernism can be restructured according to a radically different discursive map. Backgazing intellectually reconfigures US and European modernism within a planetary orbit in which the literature of Australia and the Southern Hemisphere, far from being merely an annexed margin, can be seen substantively to change the directional compass of modernism more generally. By reading canonical modernists such as James Joyce and T. S. Eliot alongside marginalized writers such as Nancy Cunard and others and relatively neglected authors from Australia and New Zealand, this book offers a revisionist cultural history of modernist time, one framed by a recognition of how its measurement is modulated across geographical space.

What are these people so angry about? Thus begins a journey into a world where the details of poetic form and vagaries of Latin translation are caught up in the dynamics of gender, sexuality, class, and race, and power, where too much alliteration, for example, could destabilize your gender or pose a threat to national security. Situated in the crucial final two decades of the sixteenth century, What Rosalind Likes takes three figures named "Rosalind" in works by Spenser (The Shepheardes Calender), Lodge (Rosalynde), and Shakespeare (As You Like It) to create a new approach to literary history and feminist criticism. The development and emergence of Rosalind as one of the most famous and beloved characters in the Shakespeare canon is thus connected to the troubled history of Virgilian reception, to tensions between aesthetics and sexual empowerment and powerlessness, to methodology associated with postcritique, including surface reading and the valorization of negative emotions, and to queer theology. The book ends by thinking about Rosalind with respect to the poetry of Mary Wroth, and examining depictions of Rosalind on stage and screen by Dora Jordan and Katharine Hepburn.

Paul Betts first came to my attention through his pioneering article on the post-1945 Bauhaus myth as a joint German-American venture.
