Nestled deep in the Surrey countryside stands the Brookwood 1939-1945 Memorial. Maintained by the Commonwealth War Graves Commission, its panels contain the names of nearly 3,500 men and women of the land forces of Britain and the Commonwealth who died in the Second World War and who have no known grave. Among the men and women who names are carved on the memorial are Special Operations Executive agents who died as prisoners or while working with Allied underground movements, servicemen killed in the various raids on enemy occupied territory in Europe, such as Dieppe and Saint-Nazaire, men and women who died at sea in hospital ships and troop transports, British Army parachutists, and even pilots and aircrew who lost their lives in flying accidents or in aerial combat. But the panels also hide a dark secret. Entwined within the names of heroes and heroines are those of nineteen men whose last resting place is known, and whose deaths were less than glorious. All were murderers who, following a civil or military trial, were executed for the heinous offence they had committed. The bodies of these individuals, with the exception of one, lay buried in un-consecrated ground. As Paul Johnson reveals, the cases of the ‘Brookwood Killers’ are violent, disturbing and often brutal in their content. They are not war crimes, but crimes committed in a time of war, for which the offender has their name recorded and maintained in perpetuity. In his best-selling travel memoir, The Innocents Abroad, Mark Twain punningly refers to the black man who introduces him to Venetian Renaissance painting as a “contraband guide,” a term coined to describe fugitive slaves who assisted Union armies during the Civil War. By means of this and similar case studies, Paul H. D. Kaplan documents the ways in which American cultural encounters with Europe and its venerable artistic traditions influenced nineteenth-century concepts of race in the United States. What is early modern philosophy? Two interpretative trends have predominated in the related literature. One, with roots in the work of Hegel and Heidegger, sees early modern thinking either as the outcome of a process of gradual rationalization (leading to the principle of sufficient reason, and to “ontology” as distinct from metaphysics), or as a reflection of an inherent subjectivity or representational semantics. The other sees it as reformulations of medieval versions of substance and cause, suggested by, or leading to, early modern scientific developments. This book proposes a rather different kind of explanation. It suggests that the concept of relation, specifically that of dyadic, anti-symmetrical relations, can throw light on a wide variety of developments in early modern thought, such as those concerning causality, sense perception, temporality, and the mereological approach to substance. The book argues that these relations are grounded in an interpretation of causal influence, and not in semantic theories or subjectivity. Furthermore, if it is correct that the problem of unity was, for most of classical antiquity, what the problems of motion, causality and perception were for early modern thinkers, then early modern thought is much closer to the thought of Aristotle than is commonly supposed. The genesis of early modern thought might instead be taken to have occurred in opposition to one aspect of the thought of Duns Scotus (an aspect that lives on in contemporary Neo-Aristotelianism), and that can be explained once the relational perspective examined here is taken into account.

This study contextualizes the achievement of a strategically crucial figure in Byzantium's turbulent seventh century, the monk and theologian Maximus the Confessor (580-662). Building on newer biographical research and a growing international body of scholarship, as well as on fresh examination of his diverse literary corpus, Paul Blowers develops a profile integrating the two principal initiatives of Maximus's career: first, his reinterpretation of the christocentric economy of creation and salvation as a framework for expounding the spiritual and ascetical life of monastic and non-monastic Christians; and second, his intensifying public involvement in the last phase of the ancient christological debates, the monothelete controversy, wherein Maximus helped lead an East-West coalition against Byzantine imperial attempts doctrinally to limit Jesus Christ to a single (divine) activity and will devoid of properly human volition. Blowers identifies what he terms Maximus's "cosmo-politeian" worldview, a contemplative and ascetical vision of the participation of all created beings in the novel politeia, or reordered existence, inaugurated by Christ's "new theandric energy". Maximus ultimately insinuated his teaching on the christoformity and cruciformity of the human vocation with his rigorous explication of the precise constitution of Christ's own composite person. In outlining this cosmo-politeian theory, Blowers additionally sets forth a "theo-dramatic" reading of Maximus, inspired by Hans Urs von Balthasar, which depicts the motion of creation and history according to the christocentric "plot" or interplay of divine and creaturely freedoms. Blowers also amplifies how Maximus's cumulative achievement challenged imperial ideology in the seventh century--the repercussions of which cost him his life-and how it generated multiple recontextualizations in the later history of theology.

This is a groundbreaking application of contemporary philosophy to human rights law that proposes significant innovations for the progressive development of human rights. Drawing on the works of prominent 'philosophers of the Other' including Emmanuel Levinas, Gayatri Chakravorti Spivak, Judith Butler and, most centrally, the Argentine philosopher of liberation Enrique Dussel, this book develops an ethics based on concrete face-to-face relationships with the Marginalized Other. It proposes that this should inspire a human rights law that is grounded in transcendental justice and framed from the perspective of marginalized groups. This would continuously deconstruct the original violence found in all human rights treaties and tribunals and promote preferential treatment for the marginalized. It would be especially attentive to such issues as access to justice, voice, representation, agency and responsibility. This differs markedly from more conventional theories that prioritize the autonomy of the ego, state sovereignty, democracy and/or equality.

In tracing the evolution of federal imprisonment, Paul W. Keve emphasizes the ways in which corrections history has been affected by and is reflective of other trends in the political and cultural life of the United States. The federal penal system has undergone substantial evolution over two hundred years. Keve divides this evolutionary process into three phases. During the first phase, from 1776 through the end of the nineteenth century, no federal prisons existed in the United States. Federal prisoners were simply boarded in state or local facilities. It was in the second phase, starting with the passage of the Three Prison Act by Congress in 1891, that federal facilities were constructed at Leavenworth and Atlanta, while the old territorial prison at McNeil Island in Washington eventually became, in effect, the third prison. In this second phase, the federal government began the enormous task of providing its own prison cells. Still, there was no effective supervisory force to make a prison system. In 1930, the Federal Bureau of Prisons was created, marking the third phase of the prison system’s evolution. The Bureau, in its first sixty years of existence, introduced numerous correctional innovations, thereby building an effective, centrally controlled prison system with progressive standards. Keve details the essential characteristics of this now mature system, guiding the reader through the historical process to the present day.
