This book evaluates the role played by statistical evidence in litigation. Despite the increasing prevalence of statistical evidence in modern litigation, how such evidence should be admitted and used by courts is often inconsistent and widely criticised. Accepting that statistical evidence can lead to more accurate decisions, the book proposes criteria that could allow courts to decide that statistical evidence is good for fact-finding. The many and varied scholarly debates regarding statistical evidence have by and large avoided judicial attention. Unlike previous works, this book contextualises those debates in the language and practice of evidence law, focusing principally on Australia, as well as the UK and the USA. It does so by identifying that the controversy around statistical evidence follows the three-tiered statistical syllogism underlying statistical inference: first, whether statistical evidence is capable of establishing an association between phenomena in a state of nature; second, inferring that phenomena to an individual from the general association; and third, whether statistical evidence can be sufficient for proof of contested facts. Objections are said to arise at each level of this syllogism and, by mapping these objections onto evidence law, the book argues that a pathway for the judicial evaluation of statistical evidence can be constructed.

The thesis of this book is threefold. First, contrary to the increasingly popular understanding that the nature of Ham's offense was sexual, we argue that this offense was nonsexual, despite the presence of the phrase ("to see the nakedness of") in Genesis 9:22. More specifically, Ham's offense had less to do with seeing his father naked--the seeing was accidental. Rather, his fault lay with his choice to disclose to his brothers what he had seen as opposed to covering the nakedness of his father. Second, the most probable fulfillment of the Noah's curse is (1) the servitude of the Gibeonites; (2) the enslavement of the Canaanites following the conquest; or (3) the dominance of Rome and Greece over Tyre and Carthage, respectively. the events or phenomena least associated with the curse, in our view, are the following: (1) the service of the four kings in Genesis 14 under Chedorlaomer and the king of Tidal; (2) the subjection of the Egyptians and Babylonians by the Persians; (3) the forced corvée service of the Egyptians by Pharaoh; (4) the triumph of Israel over Egypt during the Exodus; (5) the enslavement of the Africans; and (6) the African's dark skin color. Third, whereas none of the proposals offered in regards to the phrase ("let him dwell in the tents of Shem") correlate well with the exegesis of the blessing utterance, we did find a viable candidate among the proposals related to the enlargement of Japheth, viz "geographical expansion.

From the Author: My God is kind, compassionate, merciful, and he loves me. Yet, there are questions that arise; there are accounts of God that seem contradictory to my simplicity, and there are accusations against God that can leave me struggling for an explanation. At times I've been confused by the concept of God's love and the reality of life, and there often existed a dichotomy between the two. I wrote this book after numerous conversations with friends who, regardless of their spiritual journey have experienced similar thoughts, or have simply ignored some of the hard questions of life and faith. Common societal thinking in many areas is moving towards a position where people regard God as an outdated fairy-tale with a sinister undertone leading to apathy or resentment towards God. This is far removed from my notion of a living and loving God who is kind, compassionate and merciful. Embarking on my personal journey of discovering God's reputation, I have a hunch that I'm not alone. I need to explore God and find comfort with the answer. Would you join me on this journey of discovery? Maybe all the dots haven't been joined, and some of the joined dots remain open to interpretation, yet the line I've used to join the dots is what I know of the underlying nature and character of God.
