The traditional view of the Scottish nation holds that it first arose during the Wars of Independence from England in the thirteenth and fourteenth centuries. Although Scotland was absorbed into Britain in 1707 with the Treaty of Union, Scottish identity is supposed to have remained alive in the new state through separate institutions of religion (the Church of Scotland), education, and the legal system. Neil Davidson argues otherwise. The Scottish nation did not exist before 1707. The Scottish national consciousness we know today was not preserved by institutions carried over from the pre-Union period, but arose after and as a result of the Union, for only then were the material obstacles to nationhood – most importantly the Highland/Lowland divide – overcome. This Scottish nation was constructed simultaneously with and as part of the British nation, and the eighteenth century Scottish bourgeoisie were at the forefront of constructing both. The majority of Scots entered the Industrial Revolution with a dual national consciousness, but only one nationalism, which was British. The Scottish nationalism which arose in Scotland during the twentieth century is therefore not a revival of a pre-Union nationalism after 300 years, but an entirely new formation. Davidson provides a revisionist history of the origins of Scottish and British national consciousness that sheds light on many of the contemporary debates about nationalism.
This book deals with the contractual platform for arbitration and the application of contractual norms to the parties' dispute. Arbitration and agreement are inter-linked in three respects: (i) the agreement to arbitrate is itself a contract; (ii) there is scope (subject to clear consensual exclusion) in England for monitoring the arbitral tribunal's fidelity and accuracy in applying substantive English contract law; (iii) the subject-matter of the arbitration is nearly always a ‘contractual’ matter. These three elements underlie this work. They appear as Part I (arbitration is founded on agreement), Part II (monitoring accuracy), Part III (synopsis of the English contractual rules frequently encountered within arbitration). This book examines the effect of the adoption of the United Nations Committee on International Trade Law (UNCITRAL) Model Law on Cross-Border Insolvency in five common law jurisdictions, namely Australia, Canada, New Zealand, the United Kingdom, and the United States of America. It examines how each of those states has adopted, interpreted and applied the provisions of the Model Law, and highlights the effects of inconsistencies by examining jurisprudence in each of these countries, specifically how the Model Law affects existing principles of recognition of insolvency proceedings. The book examines how the UNCITRAL Guide to enactment of the Model Law has affected the interpretation of each of its articles and, in turn, the courts’ ability to interpret and hence give effect to the purposes of the Model Law. It also considers the ability of courts to refer to amendments made to the Guide after enactment of the Model Law in a state, thereby questioning whether the current inconsistencies in interpretation can be overcome by UNCITRAL amending the Guide.

On the way it covers the inter-war period when the first turrets were used in this way, the Second World War, when tank turrets were used on every front in the European Theatre of Operations, and the post-war period, when tank turrets were used even more widely. The book also details the decline of the idea as countries reassessed the threats they faced and slowly dismantled all their fixed fortifications. Widely used during World War Two and since, tank turret fortifications deserve a history, and Neil Short has spent several years writing this, the first proper study.

In the mid-1950s, Sri Lanka’s majority Sinhalese politicians began outbidding one another on who could provide the greatest advantages for their community, using the Sinhala language as their instrument. The appeal to Sinhalese linguistic nationalism precipitated a situation in which the movement to replace English as the country’s official language with Sinhala and Tamil (the language of Sri Lanka’s principal minority) was abandoned and Sinhala alone became the official language in 1956. The Tamils’ subsequent protests led to anti-Tamil riots and institutional decay, which meant that supposedly representative agencies of government catered to Sinhalese preferences and blatantly disregarded minority interests. This in turn led to the Tamils’ mobilizing, first politically then militarily, and by the mid-1970s Tamil youth were bent on creating a separate state.
This volume explores the development of literary culture in sixteenth-century England as a whole and seeks to explain the relationship between the Reformation and the literary renaissance of the Elizabethan period. Its central theme is the 'common' in its double sense of something shared and something base, and it argues that making common the work of God is at the heart of the English Reformation just as making common the literature of antiquity and of early modern Europe is at the heart of the English Renaissance. Its central question is 'why was the Renaissance in England so late?' That question is addressed in terms of the relationship between Humanism and Protestantism and the tensions between democracy and the imagination which persist throughout the century. Part One establishes a social dimension for literary culture in the period by exploring the associations of 'commonwealth' and related terms. It addresses the role of Greek in the period before and during the Reformation in disturbing the old binary of elite Latin and common English. It also argues that the Reformation principle of making common is coupled with a hostility towards fiction, which has the effect of closing down the humanist renaissance of the earlier decades. Part Two presents translation as the link between Reformation and Renaissance, and the final part discusses the Elizabethan literary renaissance and deals in turn with poetry, short prose fiction, and the drama written for the common stage.

The first comprehensive study of this war helps us understand how each country to defend the frontier, and the political issues which drove the Anglo-Scottish wars of the 1520s. The Anglo-Scottish War of 1522-1524 saw the mobilisation of tens of thousands of men and vast amounts of resources in both England and Scotland. Beyond its British context, the war had a European significance: it formed an element in the wider Valois-Habsburg struggles over Italy, with the complex systems of alliances spreading the repercussions of this struggle far across the continent and to the borders of England and Scotland. Recent years have seen the emergence of a renewed debate around the status of the Anglo-Scottish frontier and the wider political and social conditions which predominated in the borderlands of each kingdom. Although there has been a move to present the Anglo-Scottish border as a porous frontier where the populations on either side were closely connected, these neighbourly links imploded rapidly in wartime when frontier populations were co-opted into a national struggle. It is significant that borderers were responsible for inflicting the heaviest violence on each other during the war. Drawing on an unprecedented access to English and Sottish sources of the conflict, this book offers an important new contribution to both Scottish and English history as well as the wider military history of late medieval and early modern Europe. Aspects of military mobilisation, logistics, the defence of frontiers, the use of violence against civilians and wartime espionage feature prominently.

Shortlisted for the Saltire Society History Book of the Year The legendary Scottish king Máel Coluim III, also known as 'Malcolm Canmore', is often held to epitomise Scotland's 'ancient Gaelic kings'. But Máel Coluim and his dynasty were in fact newcomers, and their legitimacy and status were far from secure at the beginning of his rule. Máel Coluim's long reign from 1058 until 1093 coincided with the Norman Conquest of England, a revolutionary event that presented great opportunities and terrible dangers. Although his interventions in post-Conquest England eventually cost him his life, the book argues that they were crucial to his success as both king and dynasty-builder, creating internal stability and facilitating the takeover of Strathclyde and Lothian. As a result, Máel Coluim left to his successors a territory that stretched far to the south of the kingship's heartland north of the Forth, similar to the Scotland we know today. The book explores the wider political and cultural world in which Máel Coluim lived, guiding the reader through the pitfalls and possibilities offered by the sources that mediate access to that world. Our reliance on so few texts means that the eleventh century poses problems that historians of later eras can avoid. Nevertheless Scotland in Máel Coluim's time generated unprecedented levels of attention abroad and more vernacular literary output than at any time prior to the Stewart era.
On July 14th, 1790, a key figure in the French Revolution honoured Milton as a founding father of the French republic. In the light of this connection, it was appropriate that the 8th International Milton Symposium (7-11 June 2005) was held in Grenoble, cradle of the French Revolution. But the connection of Milton and Rights takes us well beyond the specific link with France, and the fascinating selection of essays assembled in this volume, many by leading Milton scholars, addresses the question in the poetry as well as the prose. Milton's fervent but changing attitude to liberties is debated from various points of view, so that the volume contains essays on topics ranging from the musical adaptations of Samson Agonistes to its angrily argued parallel with contemporary terrorism, from air pollution in Paradise Lost to Milton's supposed Puritanism and putative parallels with a French pornographer.
This is the first historical monograph to demonstrate settler colonialism’s significance for Early America. Based on a nuanced reading of the archive and using a comparative approach, the book treats settler colonialism as a process rather than a coherent ideology. Spady shows that learning was a central site of colonial struggle in the South, in which Native Americans, Africans, and European settlers acquired and exploited each other’s knowledge and practices. Learned skills, attitudes, and ideas shaped the economy and culture of the region and produced challenges to colonial authority. Factions of enslaved people and of Native American communities devised new survival and resistance strategies. Their successful learning challenged settler projects and desires, and white settlers gradually responded. Three developments arose as a pattern of racialization: settlers tried to prohibit literacy for the enslaved, remove indigenous communities, and initiate some of North America's earliest schools for poorer whites. Fully instituted by the end of the 1820s, settler colonization’s racialization of learning in the South endured beyond the Civil War and Reconstruction.
