When you visit a website, check your email, or download music, you enter into a contract that you probably don't know exists. "Wrap contracts" - shrinkwrap, clickwrap and browsewrap agreements - are non-traditional contracts that look nothing like legal documents. Contrary to what courts have held, they are not "just like" other standard form contracts, and consumers do not perceive them the same way. Wrap contract terms are more aggressive and permit dubious business practices, such as the collection of personal information and the appropriation of user-created content. In digital form, wrap contracts are weightless and cheap to reproduce. Given their low cost and flexible form, businesses engage in "contracting mania" where they use wrap contracts excessively and in a wide variety of contexts. Courts impose a duty to read upon consumers but don't impose a duty upon businesses to make contracts easy to read. The result is that consumers are subjected to onerous legalese for nearly every online interaction. In Wrap Contracts: Foundations and Ramifications, Nancy Kim explains why wrap contracts were created, how they have developed, and what this means for society. She explains how businesses and existing law unfairly burden users and create a coercive contracting environment that forces users to "accept" in order to participate in modern life. Kim's central thesis is that how a contract is presented affects and reveals the intent of the parties. She proposes doctrinal solutions - such as the duty to draft reasonably, specific assent, and a reconceptualization of unconscionability - which fairly balance the burden of wrap contracts between businesses and consumers.

This book develops a care justice framework to critique and disrupt current policies and reframe a policy blueprint for elevating a just organization of care for unpaid family caregivers and underpaid home care workers assisting older adults. In doing so, Hooyman invites readers to envision a society that fully values the essential work of care. The book is distinctive in its analysis of the interrelationships among both types of care laborers, who often face structural constraints on their decision to care and whose work is devalued and marginalized. Their care work affects every member of society, but it is generally invisible to others, and its economic value is rarely recognized by policymakers. How care work is organized and unrewarded typically has the most financial, physical, and emotional costs for women, people of color, and immigrants across the life course. Inequities for care workers by race, immigrant status, class, and sexual orientation are rooted in systemic racism, sexism, classism, xenophobia, and homophobia. In this book, policy priorities and change strategies are reframed to attain the six core components of a care justice framework, which include fundamental structural changes to elevate care work, ensure meaningful choice to care, and reduce systemic inequities faced by care workers. This framework is informed by feminism, Black feminism, intersectionality, and care theory. By conceptualizing care justice, the author aims to stimulate new discourse and action related to the care of older adults – the most important work in society – and make the seemingly unattainable attainable. This timely book will be salient to anyone committed to diversity, equity, and inclusion and with an interest in policy, gerontology, disability studies, ethnic studies, feminist studies, social justice, social work, and social welfare.

Adolescence is often thought of as a period during which parent–child interactions can be relatively stressed and conflictual. There are individual differences in this regard, however, with only a modest percent of youth experiencing extremely conflictual relationships with their parents. Relatively little empirical research, however, addresses individual differences in the quality of parent–adolescent interactions concerning potentially conflictual issues. The research reported in this monograph examined dispositional and parenting predictors of the quality of parents’ and their adolescent children’s emotional displays and positive and negative verbalizations when dealing with conflictual issues. Of particular interest were patterns of continuity and discontinuity in the factors related to conflicts. A multimethod, multireporter (mother, teacher, and sometimes adolescent reports) longitudinal approach(over 4 years) was used to assess adolescents’ dispositional characteristics (control/regulation, resiliency, and negative emotionality), youths’ externalizing problems, and parenting variables (warmth, positive expressivity, discussion of emotion, positive and negative family expressivity). Parentadolescent conflicts appear to be influenced by both child characteristics and quality of prior and concurrent parenting, and child effects may be more evident than parent effects in this pattern of relations.

Chronic renal disease has received increasing attention and concern since the passage in 1972 of PL 92-603, which provided coverage for end-stage renal disease (ESRD) treatment by the federal government. The human and economic costs of the ESRD program serve to emphasize the need to prevent or to arrest those diseases resulting in chronic renal failure, since none of the available treatments is without complications and/or side effects. The ESRD program, the only federal one that provides coverage for a catastrophic illness for almost the entire population (those qualifying under Social Security), cost almost $2 billion in 1983. The escalating costs of the ESRD program are attributed to the increasing number of patients requiring treatment and have focused concerns of the United States Government, both Congress and the administration, on ESRD. The National Institutes of Health (NIH), especially the Kidney, Urology, and Hematology Division of the National Institutes of Arthritis, Diabetes, and Digestive and Kidney Diseases (NIADDK), supports a sizable research program that bears on chronic renal disease and in association with this has sponsored many conferences and workshops on research on and causes and complications of chronic renal failure. This book is an outgrowth of the issues addressed by participants at a number of NIH conferences held in the 1980s.
