The history of Islamic thought is marked by a continuous tradition of internal revitalisation and reform embedded in the principles of islah, and tajdid. The ultimate purpose has been to bring existing realities and social change in line with the transcendant and universal standard of the Qur’an and Sunnah through a process of restoration and reform. The tradition of islah-tajdid has thus consistently challenged the Muslim status quo and prompted fresh interpretation of the Qur’an and Sunnah, understood and implemented through the methodologies of interpretation and ijtihad, as well as the rejection of unwarranted accretions to the original messages of Islam. The basic theme of the paper is that civilisational renewal is an integral part of Islamic thought. This book provides in-depth examination of the recent confrontation between Islamists and secularists in Egypt and Tunisia. Presenting a new approach to understand Islamism and secularism, the research addresses the variables that could affect the outcome of transitional negotiations. The secularist-Islamist conflict proved to be a major hindrance for democratisation and a main source of political instability in the Middle East. During the Arab Spring, disputes between both political trends sparked shortly after getting rid of their common enemy: the autocratic rulers. First, they disagreed on how to lead the transitional period. Then, polarisation grew deeper with the political competition in the parliamentary and presidential elections and the ideological disagreements during the drafting of the constitution. Eventually, this conflict put Tunisia at a verge of civil strife in the summer of 2013 and led to collapse of the transitional process in Egypt after the military coup. Examining the causes of the conflict between the secularists and the Islamists during the transitional period, the work provides new insights from the Arab Spring experience. In Crime and Punishment in Islamic Law: A Fresh Interpretation, Mohammad Kamali considers problems associated with and proposals for reform of the hudud punishments prescribed by Islamic criminal law, and other topics related to crime and punishment in Shariah. He examines what the Qur'an and hadith say about hudud punishments, as well as just retaliation (qisas), and discretionary punishments (ta'zir), and looks at modern-day applications of Islamic criminal law in 15 Muslim countries. Particular attention is given to developments in Malaysia, a multi-religious society, federal state, and self-described democracy, where a lively debate about hudud has been on-going for the last three decades. Kamali concludes that there is a significant gap between the theory and practice of hudud in the scriptural sources of Shariah and the scholastic articulations of jurisprudence of the various schools of Islamic law, arguing that literalism has led to such rigidity as to make Islamic criminal law effectively a dead letter. Exploring a new political phenomenon in the Middle East, this book studies the reconciliation of nationalism and Islamism by Islamic political parties in the context of nation states. Islamism in Kurdistan has become significantly framed by the politics of nationalism. Although the concept of religious nationalism has been discussed substantially before, this work highlights a new brand of religious nationalism that has emerged as a result of intertwining nationalism and Islamism. The focus of this study is on the development of religious nationalism in the continuously tumultuous region of the Middle East. The volume investigates whether Islamism in Kurdistan is limited by the politics of nationalism – which is an accentuated example for the whole Middle East region. By looking at the Kurdistan Islamic Union (KIU), the research studies Islamism in the Kurdistan Region to elaborate on this new type of politics. This is essentially due to the absence of a politically recognised nation state, which renders Kurds to be particularly susceptible to various manifestations of nationalism. The fraught relationship between Saudi Arabia and Iran is usually attributed to sectarian differences, even by the states' own elites. However, this book shows that in their official speeches, newspaper editorials and Friday sermons, these elites use sectarian and nationalist references and tropes to denigrate each other and promote themselves in the eyes of their respective constituencies in the region. Talal Mohammad, who is fluent in both Arabic and Persian, examines Saudi-Iranian rivalry using discourse analysis of these religious, political and journalistic sources. Tracing what has been produced since 1979 in parallel, he argues for a consistent pattern of mutual misrepresentation, whereby each frames its counterpart as the 'Other' to which a specific political agenda can be justified and advanced.
