This book is a study of the social transformation of criminal justice, its institutions, its method of case disposition and the source of its legitimacy. Focused upon the apprehension, investigation and adjudication of indicted cases in New York City's main trial tribunal in the nineteenth century - the Court of General Sessions - it traces the historical underpinnings of a lawyering culture which, in the first half of the nineteenth century, celebrated trial by jury as the fairest and most reliable method of case disposition and then at the middle of the century dramatically gave birth to plea bargaining, which thereafter became the dominant method of case disposition in the United States. The book demonstrates that the nature of criminal prosecutions in everyday indicted cases was transformed, from disputes between private parties resolved through a public determination of the facts and law to a private determination of the issues between the state and the individual, marked by greater police involvement in the processing of defendants and public prosecutorial discretion. As this occurred, the structural purpose of criminal courts changed - from individual to aggregate justice - as did the method and manner of their dispositions - from trials to guilty pleas. Contemporaneously, a new criminology emerged, with its origins in European jurisprudence, which was to transform the way in which crime was viewed as a social and political problem. The book, therefore, sheds light on the relationship of the method of case disposition to the means of securing social control of an underclass, in the context of the legitimation of a new social order in which the local state sought to define groups of people as well as actual offending in criminogenic terms. "At a moment when France is poised to adopt plea bargaining, McConville and Mirsky offer the best historical account of its emergence in mid-nineteenth century America, based upon exhaustive analysis of archival data. Their interpretation of the reasons for the dramatic shift from jury trials to negotiated justice offers no comfort for contemporary apologists of plea bargaining as more "professional." In the months that followed, they formed the Eighth Air Force – an organization that grew at an astonishing rate. To accommodate it, almost seventy airfields were hastily built across the eastern counties of England. At the heart of the Eighth Air Force was its bombardment groups, each equipped with scores of heavily armed, four-engine bombers. These Boeing B-17 Flying Fortresses and Consolidated B-24 Liberators were soon punching through the enemy's defenses to bomb targets vital to its war effort. They were crewed by thousands of young American airmen, most of whom were volunteers. This book tells the story of just one "Bomb Group" – the 381st, which crossed the Atlantic in May 1943. Arriving at RAF Ridgewell on the Essex-Suffolk border, its airmen quickly found themselves thrown into the hazardous and attritional air battle raging in the skies over Europe. The 381st’s path led from its formation in the Texan desert, to its 297th and final bombing mission deep into the heart of Hitler’s Third Reich. This is the remarkable story of one group and the part it played in the strategic bombing campaign of "The Mighty Eighth.

At least since the ancient Greeks, strategists have sought to direct organized activity through planned, rational decision-making, through the imaginative creation of vision, or through the assertion of will. In all cases, argue Holt and Zundel, strategy impoverishes, not because it only ever offers a partial view, but because it is dedicated to concealing these limits. The situation is exacerbated when machines and algorithms, not humans, organize. Holt and Zundel draw on philosophy, literature, media theory, art, mathematics, computing and military thinking in an attempt to rescue strategy by isolating what, they argue, remains its essence: strategy is a continual organizational struggle towards authenticity. This, too, is a condition of poverty, but one that sets in place an unhomely condition of questionability as opposed to one of efficient predictability. It is, argue Holt and Zundel, the sole gift of strategy to thoughtfully refuse the imperatives being generated by machine relations.

In the aftermath, this book revisits the main Frankfurt School theorists, Adorno, Horkheimer, Benjamin and Marcuse, who worked in the shadow of World War Two, during the rise of the culture industry. In examining their thoughts and drawing parallels with Fisher's Capitalist Realism, The Memeing of Mark Fisher aims to render the Frankfurt School as an incisive theoretical toolbox for the post-Covid digital age. Taking in the phenomena of QAnon, twitch streaming, and memes it argues that the dichotomy between culture and political praxis is a false one. Finally, as more people have access to the means for theoretical and cultural broadcasting, it is urged that the online left uses that access to build a real life cultural and political movement.
