As a young lawyer in the late nineteenth and early twentieth centuries, Louis Brandeis, born into a family of reformers who came to the United States to escape European anti-Semitism, established the way modern law is practiced. He was an early champion of the right to privacy and pioneer the idea of pro bono work by attorneys. Brandeis invented savings bank life insurance in Massachusetts and was a driving force in the development of the Clayton Antitrust Act, the Federal Reserve Act, and the law establishing the Federal Trade Commission. Brandeis witnessed and suffered from the anti-Semitism rampant in the United States in the early twentieth century, and with the outbreak of World War I, became at age fifty-eight the head of the American Zionist movement. During the brutal six-month congressional confirmation battle that ensued when Woodrow Wilson nominated him to the Supreme Court in 1916, Brandeis was described as “a disturbing element in any gentlemen’s club.” But once on the Court, he became one of its most influential members, developing the modern jurisprudence of free speech and the doctrine of a constitutionally protected right to privacy and suggesting what became known as the doctrine of incorporation, by which the Bill of Rights came to apply to the states. In this award-winning biography, Melvin Urofsky gives us a panoramic view of Brandeis’s unprecedented impact on American society and law.

During the late nineteenth century rapid social and economic changes negated the prevailing conception of the city as a uniform whole. Confronted with this disparity between the old urban definition and the new city of the late nineteenth century, social thinkers searched for a new concept that would correspond more closely to the divided urban community around them. Borrowing an analogy from natural history, these thinkers conceived of the city as an organism composed of interdependent neighborhoods and sought to translate this concept into ways of dealing with the dislocations and problems in urban life. In this new study of American urban history Patricia Melvin traces the growth of the idea of the organic city and the developing emphasis on the neighborhood as the basic urban unit. An early expression of the idea was the settlement house movement, but the most effective application of the idea, Melvin shows, was the social unit organization scheme worked out by Wilbur C. Phillips. As a social planner and organizer, Phillips first tried his approach in New York, then in Milwaukee, and finally in Cincinnati. Although initially successful in dealing with specific issues, Phillips's efforts eventually foundered on friction among ethnic groups and on the opposition of city politicians. Finally, in the 1920s the whole concept of the organic city was supplanted by a new view of the city based not upon a cooperative but upon a competitive model. The Organic City contributes new understanding to an important period of American urban history. Moreover, it shows clearly how important is the role of concepts in shaping the perception of social realities and the attempts to deal with them.

Democracy is perhaps the defining characteristic of modern Western society, but even as late as the nineteenth century it was often viewed with suspicion by many who saw it as akin to anarchy and mob rule. It was not until the French and American revolutions of the eighteenth century that electoral democracy began to gain momentum as a serious force, which was eventually to shape political discourse on a broad, international scale. Taking as its focus the French Revolution, this book explores how the experience in France influenced the emergence of electoral democracy, arguing - contrary to recent revisionist studies - that it was indeed the progenitor of modern representative democracy. Rejecting the revisionist semiotic approach to political culture; it instead adopts a definition emphasizing the shared values that govern political behavior, arguing that the Revolution's essential contribution to modern political culture is its concept of citizenship, embracing widespread political participation. In a broader sense, the book studies the grass-roots democracy, focusing on participation in the primary and secondary electoral assemblies. It is primarily concerned with electoral behavior and practices: how can we explain the electoral process and its results? It analyzes electoral procedures and practices, and voter turnout, based on extensive quantitative data. While focused on political history, this work also examines political sociology, giving careful attention to the occupational composition of elected officials. While acknowledging the democratic shortcomings of the French Revolution (the absence of political parties, electoral campaigns, and declared candidates), the book’s comprehensive study of revolutionary elections concludes that, together with its American counterpart, the French Revolution did indeed give birth to modern electoral democracy.
