In order to be confirmed to a lifetime appointment on the federal bench, all district and circuit court nominees must appear before the Senate Judiciary Committee for a confirmation hearing. Despite their relatively low profile, these lower court judges make up 99 percent of permanent federal judgeships and decide cases that relate to a wide variety of policy areas. To uncover why senators hold confirmation hearings for lower federal court nominees and the value of these proceedings more generally, the authors analyzed transcripts for all district and circuit court confirmation hearings between 1993 and 2012, the largest systematic analysis of lower court confirmation hearings to date. The book finds that the time-consuming practice of confirmation hearings for district and circuit court nominees provides an important venue for senators to advocate on behalf of their policy preferences and bolster their chances of being re-elected. The wide variation in lower court nominees’ experiences before the Judiciary Committee exists because senators pursue these goals in different ways, depending on the level of controversy surrounding a nominee. Ultimately, the findings inform a (re)assessment of the role hearings play in ensuring quality judges, providing advice and consent, and advancing the democratic values of transparency and accountability.

In Sex Difference in Christian Theology Megan DeFranza explores such questions in light of the Bible, theology, and science. During the first decades of the 21st century, a critical re-assessment of the reenactment as a form of historical representation has taken place in the disciplines of history, art history and performance studies. Engagement with the reenactment in film and media studies has come almost entirely from the field of documentary studies and has focused almost exclusively on non-fiction, even though reenactments are being employed across fiction and non-fiction film and television genres. Working with an eclectic collection of case studies from Milk, Monster, Boys Don't Cry, and The Battle of Orgreave to CSI and the video of police assaulting Rodney King, this book examines the relationship between the status of theatricality in the reenactment and the ways in which its relationships to reference are performed. Carrigy shows that while the practice of reenactment predates technically reproducible media, and continues to exist in both live and mediated forms, it has been thoroughly transformed through its incorporation within forms of technical media.

A key concern in postwar America was “who's passing for whom?” Analyzing representations of passing in Hollywood films reveals changing cultural ideas about authenticity and identity in a country reeling from a hot war and moving towards a cold one. The potent, imagined fear of passing linked the language and anxieties of identity to other postwar concerns, including cultural obsessions about threats from within. Passing created an epistemological conundrum that threatened to destabilize all forms of identity, not just the longstanding American color line separating white and black. In the imaginative fears of postwar America, identity was under siege on all fronts. Not only were there blacks passing as whites, but women were passing as men, gays passing as straight, communists passing as good Americans, Jews passing as gentiles, and even aliens passing as humans (and vice versa). Fears about communist infiltration, invasion by aliens, collapsing gender and sexual categories, racial ambiguity, and miscegenation made their way into films that featured narratives about passing. N. Megan Kelley shows that these films transcend genre, discussing Gentleman's Agreement, Home of the Brave, Pinky, Island in the Sun, My Son John, Invasion of the Body-Snatchers, I Married a Monster from Outer Space, Rebel without a Cause, Vertigo, All about Eve, and Johnny Guitar, among others. Representations of passing enabled Americans to express anxieties about who they were and who they imagined their neighbors to be. By showing how pervasive the anxiety about passing was, and how it extended to virtually every facet of identity, Projections of Passing broadens the literature on passing in a fundamental way. It also opens up important counter-narratives about postwar America and how the language of identity developed in this critical period of American history.
The Rhetorical Invention of America’s National Security State examines the rhetoric and discourse produced by and constitutive of America’s national security state. Hasian, Lawson, and McFarlane illustrate the importance of rhetoric to the expansion of the American national security state in the post-9/11 era through their examination of the global war on terrorism, enhanced interrogation techniques, drone crew stress, activities of Edward Snowden, rise of Special Forces, and popular representations of counterterrorism. The coauthors contend this expansion was not the result of lone, imperial executives or a nefarious state within a state, but was co-produced by elite and non-elite Americans alike who not only condoned, but also in many cases demanded, the expansion of the national security state. This work will be of interest to scholars in communication studies and political science.
The western American landscape has always had great significance in American thinking, requiring an unlikely union between frontier mythology and the reality of a fragile western environment. Additionally it has borne the burden of being a gendered space, seen by some as the traditional "virgin land" of the explorers and pioneers, subject to masculine desires, and by others as a masculine space in which the feminine is neither desired nor appreciated. Both Wallace Stegner and Cormac McCarthy focus on this landscape and environment; its spiritual, narrative, symbolic, imaginative, and ideological force is central to their work. In this study, McGilchrist shows how their various treatments of these issues relate to the social climates (pre- and post-Vietnam era) in which they were written, and how despite historical discontinuities, both Stegner and McCarthy reveal a similar unease about the effects of the myth of the frontier on American thought and life. The gendering of the landscape is revealed as indicative of the attempts to deny the failure of the myth, and to force the often numinous western landscape into parameters which will never contain it. Stegner's pre-Vietnam sensibility allows the natural world to emerge tentatively triumphant from the ruins of frontier mythology, whereas McCarthy's conclusions suggest a darker future for the West in particular and America in general. However, McGilchrist suggests that the conclusion of McCarthy's Border Trilogy, upon which her arguments regarding McCarthy are largely based, offers a gleam of hope in its final conclusion of acceptance of the feminine.
In Infrahumanisms Megan H. Glick considers how conversations surrounding nonhuman life have impacted a broad range of attitudes toward forms of human difference such as race, sexuality, and health. She examines the history of human and nonhuman subjectivity as told through twentieth-century scientific and cultural discourses that include pediatrics, primatology, eugenics, exobiology, and obesity research. Outlining how the category of the human is continuously redefined in relation to the infrahuman—a liminal position of speciation existing between the human and the nonhuman—Glick reads a number of phenomena, from early twentieth-century efforts to define children and higher order primates as liminally human and the postwar cultural fascination with extraterrestrial life to anxieties over AIDS, SARS, and other cross-species diseases. In these cases the efforts to define a universal humanity create the means with which to reinforce notions of human difference and maintain human-nonhuman hierarchies. In foregrounding how evolving definitions of the human reflect shifting attitudes about social inequality, Glick shows how the consideration of nonhuman subjectivities demands a rethinking of long-held truths about biological meaning and difference.
