How did authors control the literary fates of fictional characters before the existence of copyright? Could a second author do anything with another author's character? Situated between the decline of the privilege system and the rise of copyright, literary borrowing in eighteenth-century Germany has long been considered unregulated. This book tells a different story. Characters before Copyright documents the surprisingly widespread eighteenth-century practice of writing fan fictionliterary works written by readers who appropriate preexisting characters invented by other authorsand reconstructs the contemporaneous debate about the literary phenomenon. Like fan fiction today, these texts took the form of sequels, prequels, and spinoffs. Analyzing the evolving reading, writing, and consumer habits of late-eighteenth-century Germany, Characters before Copyright identifies the social, economic, and aesthetic changes that fostered the rapid rise of fan fiction after 1750. Based on archival work and an ethnographic approach borrowed from legal anthropology, this book then uncovers the unwritten customary norms that governed the production of these works. Characters before Copyright thus reinterprets the eighteenth-century literary commons, arguing that what may appear to have been the free circulation of characters was actually circumscribed by an exacting set of rules and conditions. These norms translated into a unique type of literature that gave rise to remarkable forms of collaborative authorship and originality. Characters before Copyright provides a new perspective on the eighteenth-century book trade and the rise of intellectual property, reevaluating the concept of literary property, the history of moral rights, and the tradition of free culture.
In recent years, there has been an explosion of writing on the topic of human dignity across a plethora of different academic disciplines. Despite this explosion of interest, there is one group – critical legal scholars – that has devoted little if any attention to human dignity. This book argues that these scholars should attend to human dignity, a concept rich enough to support a whole range of progressive ambitions, particularly in the field of international law. It synthesizes certain liberal arguments about the good of self-authorship with the critical legal philosophy of Roberto Unger and the capabilities approach to agency of Amartya Sen, to formulate a unique conception of human dignity. The author argues how human dignity flows from an individual’s capacity for self-authorship as defined by the set of expressive capabilities s/he possesses, and the book demonstrates how this conception can enrich our understanding of international human rights law by making the amplification of human dignity its fundamental orientation.
Against Empire analyzes the relationship between Christian theology and radical democracy by exploring how black prophetic thought, feminist theology, Latin American liberation theology, and peaceable theology offer plural forms of ekklesial resistance to empire: the black church (Cornel West), the ekklesia of wo/men (Elisabeth Schüssler Fiorenza), the church of the poor (Ignacio Ellacuría, Jon Sobrino), and the peaceable church (Stanley Hauerwas). These approaches to Christian political engagement differ in their specific focus but share common resistance to neoliberalism, nationalism, and militarism as networks of power that intersect with racism, sexism, and neo-colonialism to form what they refer to as empire. In diverse ways, West, Schüssler Fiorenza, Ellacuría and Sobrino, and Hauerwas reimagine Christian witness as a form of radical democratic resistance to empire in the face of political formations that not only block the expansion of democracy (neoliberal-neoconservative hegemony) but also attempt to retrench its achievements (authoritarian populism).
Scholarship on Irenaeus has long acknowledged the centrality of creation to his theology, yet without fitting this theme securely into the Christological vision of Christ the ‘Recapitulator’. Studies have considered elements of Irenaeus’ cosmology and anthropology in extraction; but without seeing creation as an intrinsic part of his Christocentric vision, these have only partially been able to capture the intricacy and significance of his embrace of the creation saga. Drawing on the most recent Irenaean scholarship, the present volume explores in detail the Christocentric cosmology of one of the second century’s greatest writers, setting him in the context of the theological currents of his day. The result is a volume that offers new insights into the trinitarian articulation of early Christianity, the full significance of humanity as bearing God’s ‘image’, and a fuller reading of the details behind the title, ‘Irenaeus the creationist’.
An account of conflicts within engineering in the 1960s that helped shape our dominant contemporary understanding of technological change as the driver of history. In the late 1960s an eclectic group of engineers joined the antiwar and civil rights activists of the time in agitating for change. The engineers were fighting to remake their profession, challenging their fellow engineers to embrace a more humane vision of technology. In Engineers for Change, Matthew Wisnioski offers an account of this conflict within engineering, linking it to deep-seated assumptions about technology and American life. The postwar period in America saw a near-utopian belief in technology's beneficence. Beginning in the mid-1960s, however, society—influenced by the antitechnology writings of such thinkers as Jacques Ellul and Lewis Mumford—began to view technology in a more negative light. Engineers themselves were seen as conformist organization men propping up the military-industrial complex. A dissident minority of engineers offered critiques of their profession that appropriated concepts from technology's critics. These dissidents were criticized in turn by conservatives who regarded them as countercultural Luddites. And yet, as Wisnioski shows, the radical minority spurred the professional elite to promote a new understanding of technology as a rapidly accelerating force that our institutions are ill-equipped to handle. The negative consequences of technology spring from its very nature—and not from engineering's failures. “Sociotechnologists” were recruited to help society adjust to its technology. Wisnioski argues that in responding to the challenges posed by critics within their profession, engineers in the 1960s helped shape our dominant contemporary understanding of technological change as the driver of history.

The rise—and fall—of research into the therapeutic potential of LSD. After LSD arrived in the United States in 1949, the drug's therapeutic promise quickly captured the interests of psychiatrists. In the decade that followed, modern psychopharmacology was born and research into the drug's perceptual and psychological effects boomed. By the early 1960s, psychiatrists focused on a particularly promising treatment known as psychedelic therapy: a single, carefully guided, high-dose LSD session coupled with brief but intensive psychotherapy. Researchers reported an astounding 50 percent success rate in treating chronic alcoholism, as well as substantial improvement in patients suffering from a range of other disorders. Yet despite this success, LSD officially remained an experimental drug only. Research into its effects, psychological and otherwise, dwindled before coming to a close in the 1970s. First, to provide a critical legal examination of the liberal state and liberal rights in the law, and secondly, to present a systematic alternative to liberal approaches to both the law and rights, grounded in a left wing conception of human dignity. At the opening of the 21st century a remarkable thing happened. Liberalism, once considered the only doctrine left standing at the end of history, began to face renewed competition from both the political left and the post-modern conservative right. This book argues that the way forward is not to abandon, but to radicalize, the potential of the liberal project. Analysing major theoretical positions in order to build a critical genealogy of liberal rights, McManus lucidly develops a left wing alternative to the classic liberal approach to rights drawing on the traditions of liberal egalitarians and deliberative democracy theory. The Palestinian national movement gestated in the early decades of the twentieth century, but it was born in the Great Revolt of 1936–39, a period of sustained Arab protest against British policy in the Palestine mandate. In The Crime of Nationalism, Matthew Kraig Kelly makes the unique case that the key to understanding the Great Revolt lies in what he calls the crimino-national domain—the overlap between the criminological and the nationalist dimensions of British imperial discourse, and the primary terrain upon which the war of 1936–39 was fought. Was the Apostle reacting against the Jews' good works done to earn salvation, or the Mosaic Law's practices that identified the Jewish people? Matthew J. Thomas examines how Paul's second century readers understood these points in conflict, how they relate to 'old' and 'new' perspectives, and what their collective witness suggests about the Apostle's own meaning. Surprisingly, these early witnesses align closely with the 'new' perspective, though their reasoning often differs from both viewpoints. They suggest that Paul opposes these works neither due to moralism, nor primarily for experiential or social reasons, but because the promised new law and covenant, which are transformative and universal in scope, have come in Christ.
