This book provides a detailed survey of the law relating to public interest disclosure. It examines how the new system has developed since the coming into force of the Public Interest Disclosure Act 1998 (PIDA), and provides up-to-date practical guidance on the key issues that arise in practice. Analysing the legal framework in the area, both under PIDA and the disparate sources of law that can apply, it provides in-depth commentary on case law and legislative developments. It examines the structure of PIDA, litigation procedure and remedies under the Act, data protection, confidentiality, copyright, defamation issues, and the Human Rights Act 1998, as well as the contractual and fiduciary duties of employees, statutory obligations (both regulatory and criminal), and the Corporate Governance Codes. Since the publication of the first edition, there have been substantial developments in the area, including those regarding whether a disclosure tends to show a Public Interest Disclosure, the burden of proof, remedies, and alternative dispute resolution. This new edition also covers the employment tribunals' new powers to pass PIDA claims to the appropriate regulator, where the claimant consents, and provides extensive coverage of a number of important decisions emerging from the Court of Appeal and the Employment Appeal Tribunal, including Babula v Waltham Forest College, Ezsias v North Glamorgan NHS Trust and Fecitt and others v NHS Manchester. Written by an author team with extensive experience in the area, and making use of checklists and worked examples, the book is an essential reference work for employment practitioners dealing with cases involving public interest disclosure issues. Berlin was bombed by four Allied air forces between 1940 and 1945. British bombers alone dropped 45,517 tons of bombs, while the Americans a further 23,000 tons. By 1944, some 1.2 million people, 790,000 of them women and children, about a quarter of Berlin’s population, had been evacuated to rural areas. An effort was made to evacuate all children from Berlin, but this was defeated by parents and many evacuees who soon made their way back to the city. However, by May 1945, 1.7 million people—40% of the population—had fled the city. This fitting tribute to those who died in the relentless struggle to knock Berlin, and hopefully Germany, out of the war resonates with eyewitness accounts and background information which the author has painstakingly investigated and researched. The result is a hugely fascinating and highly readable narrative containing very real and unique observations by British and Commonwealth aircrew and, equally importantly, the long-suffering citizens of Berlin, and well as the capital’s defenders. How was the law used to control sex in Tudor England? What were the differences between secular and religious practice? This major study reveals that - contrary to what historians have often supposed - in pre-Reformation England both ecclesiastical and secular (especially urban) courts were already highly active in regulating sex. They not only enforced clerical celibacy and sought to combat prostitution but also restrained the pre- and extramarital sexual activities of laypeople more generally. Initially destabilising, the religious and institutional changes of 1530–60 eventually led to important new developments that tightened the regime further. There were striking innovations in the use of shaming punishments in provincial towns and experiments in the practice of public penance in the church courts, while Bridewell transformed the situation in London. Allowing the clergy to marry was a milestone of a different sort. Together these changes contributed to a marked shift in the moral climate by 1600.
