Common morality—in the form of shame, outrage, and stigma—has always been society’s first line of defense against ethical transgressions. Social mores crucially complement the law, Mark Osiel shows, sparing us from oppressive formal regulation. Much of what we could do, we shouldn’t—and we don’t. We have a free-speech right to be offensive, but we know we will face outrage in response. We may declare bankruptcy, but not without stigma. Moral norms constantly demand more of us than the law requires, sustaining promises we can legally break and preventing disrespectful behavior the law allows. Mark Osiel takes up this curious interplay between lenient law and restrictive morality, showing that law permits much wrongdoing because we assume that rights are paired with informal but enforceable duties. People will exercise their rights responsibly or else face social shaming. For the most part, this system has worked. Social order persists despite ample opportunity for reprehensible conduct, testifying to the decisive constraints common morality imposes on the way we exercise our legal prerogatives. The Right to Do Wrong collects vivid case studies and social scientific research to explore how resistance to the exercise of rights picks up where law leaves off and shapes the legal system in turn. Building on recent evidence that declining social trust leads to increasing reliance on law, Osiel contends that as social changes produce stronger assertions of individual rights, it becomes more difficult to depend on informal tempering of our unfettered freedoms. Social norms can be indefensible, Osiel recognizes. But the alternative—more repressive law—is often far worse. This empirically informed study leaves little doubt that robust forms of common morality persist and are essential to the vitality of liberal societies.
A colleague recently recounted a conversation she had had with a group of graduate students. For reasons that she cannot recall, the discussion had turned to the topic of "old-fashioned" ideas in psychology-perspectives and beliefs that had once enjoyed widespread support but that are now regarded as quaint curiosities. The students racked their brains to outdo one ofthe historical trivia of psychology: Le Bon's another with their knowledge fascination with the "group mind," Mesmer's theory of animal magnetism, the short-lived popularity of "moral therapy," Descartes' belief that erec tions are maintained by air from the lungs, and so on. When it came his tum to contribute to the discussion, one student brought up an enigmatic journal he had seen in the library stacks: the Journal of Abnormal and Social Psychology. He thought that the inclusion of abnormal and social psychology within the covers of a single journal seemed an odd combination, and he wondered aloud what sort of historical quirk had led psychologists of an earlier generation to regard these two fields as somehow related. Our colleague then asked her students if they had any ideas about how such an odd combination had found its way into a single journal.
From 1840-57, Heinrich Ernst was one of the most famous and significant European musicians, and performed on stage, often many times, with Berlioz, Mendelssohn, Chopin, Liszt, Wagner, Alkan, Clara Schumann, and Joachim. It is a sign of his importance that, in 1863, Brahms gave two public performances in Vienna of his own and Ernst's music to raise money for the now mortally ill violinist. Berlioz described Ernst as 'one of the artists whom I love the most, and with whose talent I am most sympathetique', while Joachim was in no doubt that Ernst was 'the greatest violinist I ever heard; he towered above the others'. Many felt that he surpassed the expressive and technical achievements of Paganini, but Ernst, unlike his great predecessor, was also a tireless champion of public chamber music, and did more than any other early nineteenth-century violinist to make Beethoven's late quartets widely known and appreciated. Ernst was not only a great virtuoso but also an accomplished composer. He wrote two of the most popular pieces of the nineteenth century - the Elegy and the Carnival of Venice - and he is best known today for two solo pieces which represent the ne plus ultra of technical difficulty: the transcription of Schubert's Erlking, and the sixth of his Polyphonic Studies, the variations on The Last Rose of Summer. Perhaps he made his greatest contribution to music through his influence on Liszt's outstanding masterpiece, the B minor piano sonata. In 1849, Liszt conducted Ernst playing his own Concerto Path?que, a substantial single-movement work, in altered sonata form, using thematic transformation. Soon after this performance, Liszt wrote his Grosses Konzertsolo (1849-50), his first extended single-movement work, using altered sonata form, and thematic transformation. The "Beethoven Syndrome" is the inclination of listeners to hear music as the projection of a composer's inner self. This was a radically new way of listening that emerged only after Beethoven's death. Beethoven's music was a catalyst for this change, but only in retrospect, for it was not until after his death that listeners began to hear composers in general--and not just Beethoven--in their works, particularly in their instrumental music. The Beethoven Syndrome: Hearing Music as Autobiography traces the rise, fall, and persistence of this mode of listening from the middle of the eighteenth century to the present. Prior to 1830, composers and audiences alike operated within a framework of rhetoric in which the burden of intelligibility lay squarely on the composer, whose task it was to move listeners in a calculated way. But through a confluence of musical, philosophical, social, and economic changes, the paradigm of expressive objectivity gave way to one of subjectivity in the years around 1830. The framework of rhetoric thus yielded to a framework of hermeneutics: concert-goers no longer perceived composers as orators but as oracles to be deciphered. In the wake of World War I, however, the aesthetics of "New Objectivity" marked a return not only to certain stylistic features of eighteenth-century music but to the earlier concept of expression itself. Objectivity would go on to become the cornerstone of the high modernist aesthetic that dominated the century's middle decades. The state bounds politics: it constructs and enforces boundaries that separate what it controls from what lies outside its domain. However, states face a variety of threats that cross and challenge their geographical and conceptual boundaries. Transnational violent actors that transcend these boundaries also defy the state’s claims to political authority and legitimacy. Mark Shirk examines historical and contemporary state responses to transnational violence to develop a new account of the making of global orders. He considers a series of crises that plagued the state system in different eras: golden-age piracy in the eighteenth century, anarchist “propagandists of the deed” at the turn of the twentieth, and al-Qaeda in recent years. Every version of the argument from evil requires a premise concerning God's motivation - about the actions that God is motivated to perform or the states of affairs that God is motivated to bring about. The typical source of this premise is a conviction that God is, obviously, morally perfect, where God's moral perfection consists in God's being motivated to act in accordance with the norms of morality by which both we and God are governed. The aim of God's Own Ethics is to challenge this understanding by giving arguments against this view of God as morally perfect and by offering an alternative account of what God's own ethics is like. According to this alternative account, God is in no way required to promote the well-being of sentient creatures, though God may rationally do so. Any norms of conduct that favor the promotion of creaturely well-being that govern God's conduct are norms that are contingently self-imposed by God. This revised understanding of divine ethics should lead us to revise sharply downward our assessment of the force of the argument from evil while leaving intact our conception of God as an absolutely perfect being, supremely worthy of worship.
