A look at First Amendment coverage of music, non-representational art, and nonsense The Supreme Court has unanimously held that Jackson Pollock’s paintings, Arnold Schöenberg’s music, and Lewis Carroll’s poem “Jabberwocky” are “unquestionably shielded” by the First Amendment. Nonrepresentational art, instrumental music, and nonsense: all receive constitutional coverage under an amendment protecting “the freedom of speech,” even though none involves what we typically think of as speech—the use of words to convey meaning. As a legal matter, the Court’s conclusion is clearly correct, but its premises are murky, and they raise difficult questions about the possibilities and limitations of law and expression. Nonrepresentational art, instrumental music, and nonsense do not employ language in any traditional sense, and sometimes do not even involve the transmission of articulable ideas. How, then, can they be treated as “speech” for constitutional purposes? What does the difficulty of that question suggest for First Amendment law and theory? And can law resolve such inquiries without relying on aesthetics, ethics, and philosophy? Comprehensive and compelling, this book represents a sustained effort to account, constitutionally, for these modes of “speech.” While it is firmly centered in debates about First Amendment issues, it addresses them in a novel way, using subject matter that is uniquely well suited to the task, and whose constitutional salience has been under-explored. Drawing on existing legal doctrine, aesthetics, and analytical philosophy, three celebrated law scholars show us how and why speech beyond words should be fundamental to our understanding of the First Amendment.

Since the Colombo Plan in the early 1950s, food aid has been an important and highly visible component of the Canadian development assistance program. Until the early 1970s, however, the Canadian food aid program was little more than a loosely connected collection of disparate programs designed to meet a host of sometimes conflicting objectives. In the wake of the world food crisis of 1972-75, a growing number of groups began to question the developmental effectiveness of food aid. In response, the Canadian government undertook an extensive review and assessment of its food aid program, which resulted in a series of new policy initiatives designed to change both the substance of food aid programs and the manner in which they were administered. These changes marked a watershed in the history of the Canadian food aid program, setting out the fundamental policy themes that have been consolidated and refined in the 1980s and early 1990s. Mark Charlton examines the evolution of the Canadian food aid program during this critical period of policy reform. Focusing on the rationale of the food aid program, the nature of the planning and programming process, the selection of delivery channels, the make-up of the food aid commodity basket, and the nature of donor-recipient relations, Charlton provides useful insights into the overall objectives and priorities of Canadian foreign policy in the developing world. Although nineteenth-century legislation had tried to ensure a precise separation between genre and institution for Parisian music in the theatre, it had inadvertently laid out a field on which the politics of genre could be played out as agents and actors of all types deployed various forms of artistic power. During the Second Empire, from 1854 until 1870, the state took over day-to-day control of the Opéra in ways that were without precedent. Every element of the Opéra's activity was subjugated to the exigency of Empire; the selection or artists, works and more general questions of artistic policy were handed over to politicians. The Opéra effectively became a branch of government. The result was a stagnation of the Opéra's repertory, and beneficiaries were the composers of larger-scale works for competing organisations: the Opéra Comique and the Théâtre Lyrique.

Nineteenth-century Paris attracted foreign musicians like a magnet. The city boasted a range of theatres and of genres represented there, a wealth of libretti and source material for them, vocal, orchestral and choral resources, to say nothing of the set designs, scenery and costumes. All this contributed to an artistic environment that had musicians from Italian- and German-speaking states beating a path to the doors of the Académie Royale de Musique, Opéra-Comique, Théâtre Italien, Théâtre Royal de l'Odéon and Théâtre de la Renaissance. This book both tracks specific aspects of this culture, and examines stage music in Paris through the lens of one of its most important figures: Giacomo Meyerbeer. The early part of the book, which is organised chronologically, examines the institutional background to music drama in Paris in the nineteenth century, and introduces two of Meyerbeer's Italian operas that were of importance for his career in Paris. Meyerbeer's acculturation to Parisian theatrical mores is then examined, especially his moves from the Odéon and Opéra-Comique to the opera house where he eventually made his greatest impact - the Académie Royale de Musique; the shift from Opéra-Comique is then counterpointed by an examination of how an indigenous Parisian composer, Fromental Halévy, made exactly the same leap at more or less the same time. The book continues with the fates of other composers in Paris: Weber, Donizetti, Bellini and Wagner, but concludes with the final Parisian successes that Meyerbeer lived to see - his two opéras comiques.

Brexit, populism, and Euroscepticism seem to have challenged old assumptions about European integration and raised the prospect of disintegration. This book re-examines why the European Union and its forerunners were created and investigates how and why they have changed. It links contemporary events to historical explanation, arguing that there were long-term sets of conditions, dating back to the 1920s, which pushed European governments to cooperate economically and to try to resolve their diplomatic differences. The failure of the French and German governments to create what Aristide Briand had called a 'European federal union' demonstrated both the precariousness of the enterprise and its connection to the domestic politics of European states. After 1945, the unexpected advent of a 'Cold War' and the military, diplomatic and economic presence of the United States in Europe facilitated the gradual development of habits of cooperation and institutional 'integration', but they also placed limits on European governments' activities, as did disagreements between political parties and the expectations of citizens. As a consequence, supranational bodies such as the European Commission have been accompanied - and often overshadowed - by intergovernmental institutions such as the European Council, with the EU as a whole functioning in important respects as a type of confederation. The volume addresses a series of large-scale historical questions which are integral to an understanding of the European Union. It asks how and why citizens of member states have identified with the EU; how matters of 'security' affected the development of the European Community during and after the Cold War; whether economic and social convergence have taken place, and with what consequences; and why European institutions have come to function as they have. The study is thematic, focusing on the most important aspects of European integration and explaining why member states have decided to carry out - or have consented to - the unique experiment of the European Union.
