What does the UK's exit from the EU mean for health and the NHS? This book explains the legal and practical implications of Brexit on the NHS: its staffing; especially on the island of Ireland; medicines, medical devices and equipment; and biomedical research. It considers the UK's post-Brexit trade agreements and what they mean for health, and discusses the effects of the COVID-19 pandemic on post-Brexit health law. To put the legal analysis in context, the book draws on over 400 conversations the authors had with people in the north of England and Northern Ireland, interviews with over 40 health policy stakeholders, details of a film about their research made with ShoutOut UK, the authors' work with Parliaments and governments across the UK, and their collaborations with key actors like the NHS Confederation, the British Medical Association, and Cancer Research UK. The book shows that the language people use to talk about hoped-for legitimate post-Brexit health governance suggests a great deal of faith in law and legal process among 'ordinary people', but the opposite from 'insider elites'. With the direct participation of partisan political staff in governance, the onset of permanent election campaigns heavily dependent on negative advertising, and the expectation that the public service will not only merely implement but enthusiastically support the agenda of the elected government, we are experiencing a new form of political governance. The late Peter Aucoin (1943-2011) has argued that traditional norms of impartial loyalty have been displaced by partisanship on the part of civil servants and that the political executive is keen on directly controlling all aspects of communication and interaction between government and citizens. When it was published in 2008, Richard Thaler and Cass Sunstein’s Nudge: Improving Decisions about Health, Wealth, and Happiness quickly became one of the most influential books in modern economics and politics. Scandals do not just happen. They are made. They are constructed out of such everyday tragedies as the small carelessnesses and institutional brutality of the long stay hospital, the abuse of children or the violent deaths of innocent bystanders. This book, by examining the landmark scandals of the post-war period, including more recent ones, such as the Victoria Climbie Inquiry, reveals how scandals are generated, to what purposes they are used and whose interests they are made to serve. In particular, it examines the role of the public inquiry, an increasingly familiar policy device, in the process whereby the 'story' of a particular scandal is told and its meaning fixed. Using transcripts, press coverage, materials from the Public Record Office and other contemporary sources each of the scandals described in the book is located in its own historical and policy context in order to explore the complex cause and effect relationship between public policy and scandal.
J. L. Austin is famous for writing as if he thought it a condition, on the adequacy of what we say while doing epistemology, that it accord faithfully with what we would say in ordinary circumstances. A durable consensus formed after Austin's death that his pursuit of epistemology faithful to 'ordinary language' was fundamentally misguided. While critics saw his methods as resulting from a failure properly to understand the nature of the epistemologist's project, Mark Kaplan argues that this consensus arose from a misreading of Austin. In Austin's Way with Skepticism: An Essay on Philosophical Method, he sets out his stance that both the condition of adequacy to which Austin was committed and his reason for being committed to it, have been misunderstood by his critics. Starting by carefully analysing what Austin said about knowledge in 'Other Minds,' examining the response to skeptical arguments, and taking seriously the methodological remarks Austin scattered in his corpus, Kaplan demonstrates that Austin's methods were not born of a misunderstanding of the project of epistemology. Rather, Austin was a powerful critique of how that project has been conceived though was not against epistemological theorizing itself. Kaplan concludes that Austin understood himself to be offering substantive answers to key epistemological questions and defending a way of doing epistemology that is fully capable of providing these important answers.

A soldier obeys illegal orders, thinking them lawful. When should we excuse his misconduct as based in reasonable error? How can courts convincingly convict the soldier's superior officer when, after Nuremberg, criminal orders are expressed through winks and nods, hints and insinuations? Can our notions of the soldier's "due obedience," designed for the Roman legionnaire, be brought into closer harmony with current understandings of military conflict in the contemporary world? Mark J. Osiel answers these questions in light of new learning about atrocity and combat cohesion, as well as changes in warfare and the nature of military conflict. Sources of atrocity are far more varied than current law assumes, and such variations display consistent patterns. The law now generally requires that soldiers resolve all doubts about the legality of a superior's order in favor of obedience. It excuses compliance with an illegal order unless the illegality - as with flagrant atrocities - would be immediately obvious to anyone. But these criteria are often in conflict and at odds with the law's underlying principles and policies. Combat and peace operations now depend more on tactical imagination, self-discipline, and loyalty to immediate comrades than on immediate, unreflective adherence to the letter of superiors' orders, backed by threat of formal punishment. The objective of military law is to encourage deliberative judgment. This can be done, Osiel suggests, in ways that enhance the accountability of our military forces, in both peace operations and more traditional conflicts, while maintaining their effectiveness. Everyone wants to be virtuous, but recent psychological investigations suggest that this may not be possible. The development of non-binding new governance methods has challenged the traditional ideals of EU law by suggesting that soft norms and executive networks may provide a viable alternative. Rather than see law and new governance as oppositional projects, Mark Dawson argues that new governance can be seen as an example of legal 'transformation', in which soft norms and hard law institutions begin to cohabit and interact. He charts this transformation by analysing the Open Method of Coordination (OMC) for Social Inclusion and Protection. While this process illustrates some of the concrete advantages for EU social policy which new governance has brought, it also illustrates their extensive legitimacy challenges. Methods like the OMC have both excluded traditional institutions, such as Courts and Parliaments, and altered the boundaries of domestic constitutional frameworks. The book concludes with some practical suggestions for how a political 'constitutionalisation' of new governance could look.

Most democracies in Western Europe are diploma democracies - ruled by those with the highest formal qualifications. Citizens with low or medium educational qualifications currently make up about 70 percent of the electorates, yet they have become virtually absent from almost all political arenas. University graduates have come to dominate all political institutions and venues, from political parties, parliaments and cabinets, to organised interests, deliberative settings, and Internet consultations. This rise of a political meritocracy is part of larger trend. In the information society, educational background, like class or religion, is an important source of social and political divides. Those who are well educated tend to be cosmopolitans, whereas the lesser educated citizens are more likely to be nationalists. This book documents the context, contours, and consequences of this rise of a political meritocracy. It explores the domination of higher educated citizens in political participation, civil society, and political office in Western Europe. It discusses the consequences of this rise of a political meritocracy, such as descriptive deficits, policy incongruences, biased standards, and cynicism and distrust. This work breaks new ground by carefully distinguishing the concepts of belief, confirmation, and evidence and then integrating them into a better understanding of personal and scientific epistemologies. It outlines a probabilistic framework in which subjective features of personal knowledge and objective features of public knowledge have their true place. It also discusses the bearings of some statistical theorems on both formal and traditional epistemologies while showing how some of the existing paradoxes in both can be resolved with the help of this framework.This book has two central aims: First, to make precise a distinction between the concepts of confirmation and evidence and to argue that failure to recognize this distinction is the source of certain otherwise intractable epistemological problems. The second goal is to demonstrate to philosophers the fundamental importance of statistical and probabilistic methods, at stake in the uncertain conditions in which for the most part we lead our lives, not simply to inferential practice in science, where they are now standard, but to epistemic inference in other contexts as well. During the last decades of the twentieth century a seemingly endless stream of political scandals and policy fiascoes burst into the open in most Western countries. Each was characterized by intense politicization of government performance following allegations of ineffectiveness, mismanagement, and misconduct in public programs and projects. Their scope was large, encompassing the full range of contemporary governance from defense to social security policy. This open access book sets out to explain the reasons for the gap between "knowing" and "doing" in view of self-reliance, which is more and more often expected of citizens. In today's society, people are expected to take responsibility for their own lives and be self-reliant. This is no easy feat. They must be on constant high alert in areas of life such as health, work and personal finances and, if things threaten to go awry, take appropriate action without further ado. What does this mean for public policy? Policymakers tend to assume that the government only needs to provide people with clear information and that, once properly informed, they will automatically do the right thing. However, it is becoming increasingly obvious that things do not work like that. Even though people know perfectly well what they ought to do, they often behave differently. Why is this? This book sets out to explain the reasons for the gap between 'knowing' and 'doing'. It focuses on the role of non-cognitive capacities, such as setting goals, taking action, persevering and coping with setbacks, and shows how these capacities are undermined by adverse circumstances. By taking the latest psychological insights fully into account, this book presents a more realist perspective on self-reliance, and shows government officials how to design rules and institutions that allow for the natural limitations in people's 'capacity to act'.
