This study explores the use of precedents in the case law of the Court of Justice of the European Union (CJEU). It argues that a strategic use of precedent-based discourses aids the Court in developing its jurisprudence autonomously; that is, independent of the political preferences of EU member states. The study is based on a long-term assessment of CJEU case law in the politically sensitive area of immigration law. It traces the Court’s rulings in this area from the 1970s up until the most recent period. The study identifies a series of consistent discursive patterns that slowly, but surely, moved EU immigration law beyond what member states had intended. The work takes an interdisciplinary approach, engaging with both political science and legal discussions on the Court of Justice and its role in processes of European integration.

Joan Marie Johnson examines an understudied dimension of women's history in the United States: how a group of affluent white women from the late nineteenth through the mid-twentieth centuries advanced the status of all women through acts of philanthropy. This cadre of activists included Phoebe Hearst, the mother of William Randolph Hearst; Grace Dodge, granddaughter of Wall Street "Merchant Prince" William Earle Dodge; and Ava Belmont, who married into the Vanderbilt family fortune. Motivated by their own experiences with sexism, and focusing on women's need for economic independence, these benefactors sought to expand women's access to higher education, promote suffrage, and champion reproductive rights, as well as to provide assistance to working-class women. In a time when women still wielded limited political power, philanthropy was perhaps the most potent tool they had. But even as these wealthy women exercised considerable influence, their activism had significant limits. As Johnson argues, restrictions tied to their giving engendered resentment and jeopardized efforts to establish coalitions across racial and class lines. As the struggle for full economic and political power and self-determination for women continues today, this history reveals how generous women helped shape the movement. And Johnson shows us that tensions over wealth and power that persist in the modern movement have deep historical roots.
Wives and Wanderers in a New Guinea Highlands Society brings to the reader anthropologist Marie Reay’s field research from the 1950s and 1960s on women’s lives in the Wahgi Valley, Central Highlands of Papua New Guinea. Dramatically written, each chapter adds to the main story that Reay wanted to tell, contrasting young girls’ freedom to court and choose partners, with the constraints (and violence) they were to experience as married women. This volume provides readable ethnographic material for undergraduate courses, in whole or in part. It will be of interest to students and scholars of gender relations, anthropology and feminism, Melanesia and the Pacific. The material in this book, which Reay had written by 1965 but never published, remains startlingly contemporary and relevant. Marie Olive Reay was a social anthropologist who did research in Australian indigenous communities and in the Wahgi Valley in the Central Highlands of Papua New Guinea. Employed at The Australian National University from 1959 to 1988 when she retired, Reay passed away in 2004. In 2011 this manuscript was found in her personal papers, reconstructed, and edited by Francesca Merlan, augmented here by an additional introduction by eminent anthropologist of the Highlands, and of gender, Marilyn Strathern. Had this manuscript appeared when Reay apparently completed it in its present form – around 1965 – it would have been the first published ethnography of women’s lives in the Central Highlands of Papua New Guinea. Its retrieval from Reay’s papers, and availability now, adds a new dimension to works on gender relations in Melanesian societies, and to the history of Australian and Pacific anthropology.

It focuses on the ‘scramble’ in Asia, when, in 1885, the British Raj incorporated Upper Burma and the French created a Protectorate in Annam-Tonkin, the Northern part of present-day Vietnam. The counterpoint between the discourses produced and the cartographical practices on the ground, in the longue durée, reveals the interacting processes of territory-building in all their unpredictability. In The Defoliation of America, Amy M. Hay profiles the attitudes, understandings, and motivations of grassroots activists who rose to fight the use of phenoxy herbicides (commonly known as the Agent Orange chemicals) in various aspects of American life during the post-WWII era. First introduced in 1946, these chemicals mimic hormones in broadleaf plants, causing them to, essentially, grow to death while grass, grains, and other monocots remain unaffected. By the 1950s, millions of pounds of chemicals were produced annually for use in brush control, weed eradication, other agricultural applications, and forest management. The herbicides allowed suburban lawns to take root and become iconic symbols of success in American life. The production and application of phenoxy defoliants continued to skyrocket in subsequent years, encouraged by market forces and unimpeded by regulatory oversight. By the late 1950s, however, pockets of skepticism and resistance had begun to appear. The trend picked up steam after 1962, when Rachel Carson's Silent Spring directed mainstream attention to the harm modern chemicals were causing in the natural world. But it wasn't until the Vietnam War, when nearly 40 million gallons of Agent Orange and related herbicides were sprayed to clear the canopy and destroy crops in Southeast Asia, that the long-term damage associated with this group of chemicals began to attract widespread attention and alarm. Using a wide array of sources and an interdisciplinary approach, The Defoliation of America is organized in three parts. Part 1 (1945-70) examines the development, use, and responses to the new chemicals used to control weeds and remove jungle growth. As the herbicides became militarized, critics increasingly expressed concerns about defoliation in protests over US imperialism in Southeast Asia. Part 2 (1965-85) profiles three different women who, influenced by Rachel Carson, challenged the uses of the herbicides in the American West, affecting US chemical policy and regulations in the process. Part 3 (1970-95) revisits the impact and legacies of defoliant use after the Vietnam War. From countercultural containment and Nixon's declaration of the "War on Drugs" to the toxic effects on American and Vietnamese veterans, civilians, and their children, it became increasingly obvious that American herbicides damaged far more than forest canopies. This book considers the governance of autistic defendants and offenders in the UK courts. Utilising the social model of disability, it considers the dominant strategies of governance, including 'vulnerability', which the author argues obscures the rights of disabled people in the criminal justice system. In doing so it sheds light on how this group should be governed. Drawing on rigorously-researched case studies of autistic adult defendants through the court process, the book brings together relevant legal and policy literature, criminological and criminal justice theory and disability studies to provide insight into the 'dividing practices' that affect the governance of disabled defendants' conduct. Using interviews with elites and practitioners, textual analysis, and court observation of eight autistic adult defendants through their court process, the book investigates why the status of autistic defendants as disabled under the Equality Act 2010 has been overlooked in criminal justice policy and criminal court decision-making. It explores the impact of the 'collateral' effects and 'symbiotic harm' of the criminal justice process on family members who support these defendants through the criminal justice process.
Investigating the emergence of a specific mestiza/mestizo whiteness that facilitates relations between the Philippines and Western nations, this book examines the ways in which the construction of a particular form of Philippine whiteness serves to deploy positions of exclusion, privilege and solidarity. Through Filipino, Filipino-Australian, and Filipino-American experiences, the author explores the operation of whiteness, showing how a mixed-race identity becomes the means through which racialised privileges, authority and power are embodied in the Philippine context, and examines the ways in which colonial and imperial technologies of the past frame contemporary practices such as skin-bleaching, the use of different languages, discourses of bilateral relations, secularism, development, and the movement of Filipino, Australian and American bodies between and within nations. Drawing on key ideas expressed in critical race and whiteness studies, together with the theoretical concepts of somatechnics, biopolitics and governmentality, The Somatechnics of Whiteness and Race sheds light on the impact of colonial and imperial histories on contemporary international relations, and calls for a 'queering' or resignification of whiteness, which acknowledges permutations of whiteness fostered within national boundaries, as well as through various nation-state alliances and fractures.
