Across the social sciences and even in philosophy, trust is most often characterized in terms of expectations and probabilities. This book defends an alternative conception of trust as a moral phenomenon. When one person trusts another to do something, the first relies on the second’s commitment(s). So, trust reflects—and is a product of—agreement about the commitments and obligations that bind persons who live and work together. These commitments and obligations can be implicit, but building (or rebuilding) trust often requires making these commitments and obligations explicit, defining the terms of cooperation. Part 1 argues that this account of trust better captures our actual trust practices, and it draws out connections with both the philosophy and the social science literatures. It also describes the process of creating trust relationships with reference to trust invitations. Part 2 addresses practical applications of the account defended here, in the context of social relationships, economic systems, and within business organizations. These applications emphasize the material benefits of trust but, separate from those, Part 2 argues that trust is an intrinsic good—so we have moral reason to trust. Over recent decades corporate governance has developed an increasingly high profile in legal scholarship and practice, especially in the US and UK. But despite widespread interest, there remains considerable uncertainty about how exactly corporate governance should be defined and understood. In this important work, Marc Moore critically analyses the core dimensions of corporate governance law in these two countries, seeking to determine the fundamental nature of corporate governance as a subject of legal enquiry. In particular, Moore examines whether Anglo-American corporate governance is most appropriately understood as an aspect of 'private' (facilitative) law, or as a part of 'public' (regulatory) law. In contrast to the dominant contractarian understanding of the subject, which sees corporate governance as an institutional response to investors' market-driven private preferences, this book defines corporate governance as the manifestly public problem of securing the legitimacy – and, in turn, sustainability – of discretionary administrative power within large economic organisations. It emphasises the central importance of formal accountability norms in legitimating corporate managers' continuing possession and exercise of such power, and demonstrates the structural necessity of mandatory public regulation in this regard. Exile in Amsterdam is based on a rich, extensive, and previously untapped source for one of the most important and fascinating Jewish communities in early modern Europe: the sermons of Saul Levi Morteira (ca. 1596-1660). Morteira, the leading rabbi of Amsterdam and a master of Jewish homiletical art, was known to have published only one book of fifty sermons in 1645, until a collection of 550 manuscript sermons in his own handwriting turned up in the Rabbinical Seminary of Budapest. After years of painstaking study from microfilms and three trips to Budapest to consult the actual manuscripts, Marc Saperstein has written the first comprehensive analysis of the historical significance of these texts, some of which were heard by the young Spinoza. Saperstein reviews the broad outlines of Morteira's biography, his treatment by scholars, and his image in literary works. He then reconstructs the process by which the preacher produced and delivered his sermons. Morteira's sermons also provide a trove of information about individuals and institutions in Morteira's Amsterdam, enabling Saperstein to analyze the shortcomings of behavior and the lapses in faith criticized by the preacher. The sermons also presented an ongoing program of adult education that transmitted the Jewish tradition on a high yet accessible level to a congregation of new Jews-immigrants who had lived as Christians in Portugal and were now assuming a Jewish identity with minimal prior knowledge. Here Saperstein focuses on themes Morteira considered crucial: memories of the historical past, confrontations with Christianity, ideas of exile and messianic redemption, and attitudes toward the New Christians who remained in Portugal. While political history has plenty to say about the impact of Ronald Reagan’s election to the presidency in 1980, four Senate races that same year have garnered far less attention—despite their similarly profound political effect. Tuesday Night Massacre looks at those races. In examining the defeat in 1980 of Idaho’s Frank Church, South Dakota’s George McGovern, John Culver of Iowa, and Birch Bayh of Indiana, Marc C. Johnson tells the story of the beginnings of the divisive partisanship that has become a constant feature of American politics. The turnover of these seats not only allowed Republicans to gain control of the Senate for the first time since 1954 but also fundamentally altered the conduct of American politics. The incumbents were politicians of national reputation who often worked with members of the other party to accomplish significant legislative objectives—but they were, Johnson suggests, unprepared and ill-equipped to counter nakedly negative emotional appeals to the “politically passive voter.” Such was the campaign of the National Conservative Political Action Committee (NCPAC), the organization founded by several young conservative political activists who targeted these four senators for defeat. Johnson describes how such groups, amassing a great amount of money, could make outrageous and devastating claims about incumbents—“baby killers” who were “soft on communism,” for example—on behalf of a candidate who remained above the fray. While student voice has been well-defined in research, how to sustain youth-adult leadership work is less understood. Students are rarely invited to lead school reform efforts, and when they are, their voice is silenced by the structural arrangements and socio-cultural conditions found in schools. This volume investigates problems with the neoliberal school reform movement, and how youth-adult partnerships have resulted in more effective reforms within schools and community organizations nationally and internationally. Stemming from an eight-year ethnographic study at a civic-themed public high school, the volume highlights the process of creating a school governance structure which produces active and informed citizens. Made up of executive, legislative and judicial branches, the program gives students the power to make, implement and review school policies and practices—a model that has found to effectively distribute leadership and trigger organizational learning, and is thus at the forefront of civic education.
