Personal property security is an important subject in commercial practice, as it is the key to much of the law of banking and sale. This second edition has been fully updated and expanded to cover all important issues and changes within this highly complex area of law. It explains traditional methods of securing debts (such as mortgages, charges, and pledges) on property other than land, describing how these are created, how they must be registered (or otherwise 'perfected') if they are to be valid, the rights and duties of the parties, and how the security is enforced if the debt is not paid. The new edition includes an expanded section on priorities in which it explains how 'priority' disputes between competing interests over the same property are resolved. In addition the book covers the law governing other transactions that perform a similar economic function (such as finance leases, retention of title clauses, and sales of a company's book debts). These are not currently treated by the law as security and are therefore subject to different rules on perfection, priority, and enforcement. There is much expansion of the discussion relating to enforcement including the issue of 'right of use' following Lehman, more analysis on administration and all forms of non-possessory security and quasi-security, and a new chapter on enforcement of security addressing the right of appropriation under FC/FCAR and the Cukurova case. The conflict of laws section includes developments under the Rome I Regulation affecting assignment issues, the UNIDROIT Convention 2009 in relation to tiered holdings and the Cape Town Convention's extensions made to coverage of asset-backed security over equipment. It also addresses the changes brought about by the abolition of Slavenburg registration. This edition contains relevant points from the Banking Act 2009 concerning its impact on security, such as the power to protect certain interests on a transfer of property, and also considers amendments regarding liquidators' expenses under the Insolvency Rules. The authors additionally deal with the role of step-in rights and why they are part of the statutory definition of project finance in the Enterprise Act. First emerging in North America and Europe in the late 1920s, contemporary percussion practices have transitioned from the fringes of contemporary music to the forefront over the past 90 years. In the 1960s contemporary percussion practices reached Australian shores and a new generation of artists added their voices to this narrative. The role of Australian activity is not yet embedded in the wider narrative of international contemporary percussion, nor is the significance of developments in contemporary percussion practices fully realised in the context of Australian music history. In this monograph, political, social and cultural influences on this art form will be examined for the first time in a historical survey of contemporary percussion music in Australia over a 50-year period, from 1960 to 2010. The rise of the percussion ensemble in the twentieth century to a standard chamber music ensemble is now recognised as one of the major advances in western art music practice internationally. A focus will be placed on ensemble activity via definitive documentation and analysis of ensembles that are amongst the most pioneering and longest established of Australian contemporary music organisations, including the Australian Percussion Ensemble, Synergy Percussion, Adelaide Percussions, Nova Ensemble, Tetrafide Percussion, Taikoz, Clocked Out and Speak Percussion amongst others. It analyses the development of his epistolary style; the links between his own letter-writing practice and that of his fictional protagonists; how his correspondence is highly conscious of the spectrum of publicity; and how he constructed his letter collections to form an epistolary archive for posterity. Looking backwards to earlier epistolary traditions, and forwards, to the emergence of the lives-in-letters mode of biography, the book places Richardson's correspondence in a historical continuum. It explores how the eighteenth century witnesses a transition, from a period in which an author would rarely preserve personal papers to a society in which the personal lives of writers become privileged as markers of authenticity in the expanded print market. This book considers the place of deification in the writings of Julian of Norwich and Richard Rolle, two of the fourteenth-century English Mystics. It argues that, as a consequence of a belief in deification, both produce writing that is helpfully viewed as sacred eloquence. The book begins by discussing the nature of deification, employing Norman Russell’s typology. It explores the realistic and ethical approaches found in the writings of several Early Greek Fathers, including Irenaeus of Lyons, Cyril of Alexandria, Origen, and Evagrius Ponticus, as well as engaging with the debate around whether deification is a theological idea found in the West across its history. The book then turns its attention to Julian and Rolle, arguing that both promote forms of deification: Rolle offering a primarily ethical approach, while Julian’s approach is more realistic. Finally, the book addresses the issue of sacred eloquence, arguing that both Rolle and Julian, in some sense, view their words as divinely inspired in ways that demand an exegetical response that is para-biblical. Offering an important perspective on a previously understudied area of mysticism and deification, this book will be of interest to scholars of mysticism, theology, and Middle English religious literature.
