Winner, Matei Calinescu Prize, Modern Language Association Winner, 2021 Modernist Studies Award, Modernist Studies Association Long before the US Supreme Court announced that corporate persons freely "speak" with money in Citizens United v. Federal Election Commission (2010), they elaborated the legal fiction of American corporate personhood in Santa Clara v. Southern Pacific Railroad (1886). Yet endowing a non-human entity with certain rights exposed a fundamental philosophical question about the possibility of collective intention. That question extended beyond the law and became essential to modern American literature. This volume offers the first multidisciplinary intellectual history of this story of corporate personhood. The possibility that large collective organizations might mean to act like us, like persons, animated a diverse set of American writers, artists, and theorists of the corporation in the first half of the twentieth century, stimulating a revolution of thought on intention. The ambiguous status of corporate intention provoked conflicting theories of meaning—on the relevance (or not) of authorial intention and the interpretation of collective signs or social forms—still debated today. As law struggled with opposing arguments, modernist creative writers and artists grappled with interrelated questions, albeit under different guises and formal procedures. Combining legal analysis of law reviews, treatises, and case law with literary interpretation of short stories, novels, and poems, this volume analyzes legal philosophers including Oliver Wendell Holmes, Jr., Frederic Maitland, Harold Laski, Maurice Wormser, and creative writers such as Theodore Dreiser, Muriel Rukeyser, Gertrude Stein, Charles Reznikoff, F. Scott Fitzgerald, and George Schuyler.
The Offenses Against the Person Act of 1828 opened magistrates’ courts to abused working-class wives. Newspapers in turn reported on these proceedings, and in this way the Victorian scrutiny of domestic conduct began. But how did popular fiction treat “private” family violence? Bleak Houses: Marital Violence in Victorian Fiction traces novelists’ engagement with the wife-assault debates in the public press between 1828 and the turn of the century. Lisa Surridge examines the early works of Charles Dickens and reads Dombey and Son and Anne Brontë’s The Tenant of Wildfell Hall in the context of the intense debates on wife assault and manliness in the late 1840s and early 1850s. Surridge explores George Eliot’s Janet’s Repentance in light of the parliamentary debates on the 1857 Divorce Act. Marital cruelty trials provide the structure for both Wilkie Collins’s The Woman in White and Anthony Trollope’s He Knew He Was Right. Locating the New Woman fiction of Mona Caird and the reassuring detective investigations of Sherlock Holmes in the context of late-Victorian feminism and the great marriage debate in the Daily Telegraph, Surridge illustrates how fin-de-siècle fiction brought male sexual violence and the viability of marriage itself under public scrutiny. Bleak Houses thus demonstrates how Victorian fiction was concerned about the wife-assault debates of the nineteenth century, debates which both constructed and invaded the privacy of the middle-class home.

This book explores why crime fiction so often alludes to Shakespeare. It ranges widely over a variety of authors including classic golden age crime writers such as the four ‘queens of crime’ (Allingham, Christie, Marsh, Sayers), Nicholas Blake and Edmund Crispin, as well as more recent authors such as Reginald Hill, Kate Atkinson and Val McDermid. From Sherlock Holmes onwards, fictional detectives use lenses: Ocular Proof and the Spectacled Detective in British Crime Fiction argues that these visual aids are metaphors for ways of seeing, and that they help us to understand not only individual detectives’ methods but also the kinds of cultural work detective fiction may do. It is sometimes regarded as a socially conservative form, and certainly the enduring popularity of ‘Golden Age’ writers such as Christie, Sayers, Allingham and Marsh implies a strong element of nostalgia in the appeal of the genre. The emphasis on visual aids, however, suggests that solving crime is not a simple matter of uncovering truth but a complex, sophisticated and inherently subjective process, and thus challenges any sense of comforting certainties. Moreover, the value of eye-witness testimony is often troubled in detective fiction by use of the phrase ‘the ocular proof’, whose origin in Shakespeare’s Othello reminds us that Othello is manipulated by Iago into misinterpreting what he sees. The act of seeing thus comes to seem ideological and provisional, and Lisa Hopkins argues that the kind of visual aid selected by each detective is an index of his particular propensities and biases.

In the 1920s, the US government passed legislation against undocumented entry into the country, and as a result the figure of the “illegal alien” took form in the national discourse. In this book, Lisa A. Flores explores the history of our language about Mexican immigrants and exposes how our words made these migrants “illegal.” Deportable and Disposable brings a rhetorical lens to a question that has predominantly concerned historians: how do differently situated immigrant populations come to belong within the national space of whiteness, and thus of American-ness? Flores presents a genealogy of our immigration discourse through four stereotypes: the “illegal alien,” a foreigner and criminal who quickly became associated with Mexican migrants; the “bracero,” a docile Mexican contract laborer; the “zoot suiter,” a delinquent Mexican American youth engaged in gang culture; and the “wetback,” an unwanted migrant who entered the country by swimming across the Rio Grande. The textile era was born of a perfect storm. When North Georgia's red clay failed farmers and prices fell during Reconstruction, opportunities arose. Beginning in the 1880s, textile industries moved south. Mill owners enticed an entire workforce to leave their farms and move their families into modern mill villages, encased communities with stores, theaters, baseball teams, bands and schools. To some workers, mill village life was idyllic. They had work, recreation, education, shopping and a home with the modern conveniences of running water and electricity. Most importantly, they got a paycheck. But after the New Deal, workers started to see the raw deal they were getting from mill owners and rebelled. Strikes and economic changes began to erode the era of mill villages, and by the 1960s, mill village life was all but gone. Author Lisa Russell brings these once-vibrant communities back to life.

Scholars have characterized the early decades of the Cold War as an era of rising militarism in the United States but most Americans continued to identify themselves as fundamentally anti-militaristic. To them, "militaristic" defined the authoritarian regimes of Germany and Japan that the nation had defeated in World War II--aggressive, power-hungry countries in which the military possessed power outside civilian authority. Much of the popular culture in the decades following World War II reflected and reinforced a more pacifist perception of America. This study explores military images in television, film, and comic books from 1945 to 1970 to understand how popular culture made it possible for a public to embrace more militaristic national security policies yet continue to perceive themselves as deeply anti-militaristic.

For decades, historians have primarily analyzed charges of black-on-white rape in the South through accounts of lynching or manifestly unfair trial proceedings, suggesting that white southerners invariably responded with extralegal violence and sham trials when white women accused black men of assault. Lisa Lindquist Dorr challenges this view with a careful study of legal records, newspapers, and clemency files from early-twentieth-century Virginia. White Virginians' inflammatory rhetoric, she argues, did not necessarily predict black men's ultimate punishment. While trials were often grand public spectacles at which white men acted to protect white women and to police interracial relationships, Dorr points to cracks in white solidarity across class and gender lines. At the same time, trials and pardon proceedings presented African Americans with opportunities to challenge white racial power. Taken together, these cases uncover a world in which the mandates of segregation did not always hold sway, in which whites and blacks interacted in the most intimate of ways, and in which white women and white men saw their interests in conflict. In Dorr's account, cases of black-on-white rape illuminate the paradoxes at the heart of segregated southern society: the tension between civilization and savagery, the desire for orderly and predictable racial boundaries despite conflicts among whites and relationships across racial boundaries, and the dignity of African Americans in a system dependent on their supposed inferiority. The rhetoric of protecting white women spoke of white supremacy and patriarchy, but its practice revealed the limits of both.
