Backcountry Democracy and the Whiskey Insurrection treats the legal culture that informed the Whiskey Rebellion of 1794 and its trials. Linda Myrsiades examines conflicts between state and federal courts and the judicial philosophy of Federalist judges, as well as grand jury charges, law reports, judges’ bench notes, and defense notes for the trials, to develop a portrait of the hegemony of official interpretations of the law. At the same time, the book illuminates popular attitudes about the courts and the law and explores the nature of extralegal courts operated by the people. Myrsiades captures the agitation-propaganda efforts mounted by rebel communities and groups together with petitions and speeches in the rebel assemblies in demonstrating that popular culture offered a clear politico-legal justification within the rebel movement on the unofficial side of legal culture. Myrsiades thus presents a holistic picture of the legal culture of the rebellion. Her examination denies the common perception that the rebel movement was incoherent and chaotic and presents an alternative view that its perceptions are a necessary correlative to understanding how treason law functioned and what its critical elements were in the late-eighteenth century, serving as a lesson for democracy in the present era.
2021 Lambda Literary Awards Finalist Nepantla Squared maps the lives of two transgender mestiz@s, one during the turn of the twentieth century and one during the turn of the twenty-first century, to chart the ways race, gender, sex, ethnicity, and capital function differently in different times. To address the erasure of transgender mestiz@ realities from history, Linda Heidenreich employs an intersectional analysis that critiques monopoly and global capitalism. Heidenreich builds on the work of Gloria Anzaldúa's concept of nepantleras, those who could live between and embody more than one culture, to coin the term nepantla2, marking times of capitalist transition where gender was also in motion. Transgender mestiz@s, too, embodied that movement. Heidenreich insists on a careful examination of the multiple in-between spaces that construct lives between cultures and genders during in-between times of shifting empire and capital. In so doing, they offer an important discussion of race, class, nation, and citizenship centered on transgender bodies of color that challenges readers to rethink the way they understand the gendered social and economic challenges of today.
Historically, critics of interracial, interfaith, and most recently same-sex marriage have invoked conscience and religious liberty to defend their objections, and often they have been accused of bigotry. Although denouncing and preventing bigotry is a shared political value with a long history, people disagree over who is a bigot and what makes a belief, attitude, or action bigoted. This is evident from the rejoinder that calling out bigotry is intolerant political correctness, even bigotry itself. In Who's the Bigot?, the eminent legal scholar Linda C. McClain traces the rhetoric of bigotry and conscience across a range of debates relating to marriage and antidiscrimination law. Is "bigotry" simply the term society gives to repudiated beliefs that now are beyond the pale? The Democratic Courthouse examines how changing understandings of the relationship between government and the governed came to be reflected in the buildings designed to house the modern legal system from the 1970s to the present day in England and Wales. The magnitude of the Burger Court has been underestimated by historians. When Richard Nixon ran for president in 1968, "Impeach Earl Warren" billboards dotted the landscape, especially in the South. Nixon promised to transform the Supreme Court--and with four appointments, including a new chief justice, he did. This book tells the story of the Supreme Court that came in between the liberal Warren Court and the conservative Rehnquist and Roberts Courts: the seventeen years, 1969 to 1986, under Chief Justice Warren Burger. It is a period largely written off as a transitional era at the Supreme Court when, according to the common verdict, "nothing happened." How wrong that judgment is. The Burger Court had vitally important choices to make: whether to push school desegregation across district lines; how to respond to the sexual revolution and its new demands for women's equality; whether to validate affirmative action on campuses and in the workplace; whether to shift the balance of criminal law back toward the police and prosecutors; what the First Amendment says about limits on money in politics. The Burger Court forced a president out of office while at the same time enhancing presidential power. It created a legacy that in many ways continues to shape how we live today. From the United States' earliest days, African Americans considered education essential for their freedom and progress. Linda M. Perkins’s study ranges across educational and geographical settings to tell the stories of Black women and girls as students, professors, and administrators. Beginning with early efforts and the establishment of abolitionist colleges, Perkins follows the history of Black women's post–Civil War experiences at elite white schools and public universities in northern and midwestern states. Their presence in Black institutions like Howard University marked another advancement, as did Black women becoming professors and administrators. But such progress intersected with race and education in the postwar era. As gender questions sparked conflict between educated Black women and Black men, it forced the former to contend with traditional notions of women’s roles even as the 1960s opened educational opportunities for all African Americans. A first of its kind history, To Advance the Race is an enlightening look at African American women and their multi-generational commitment to the ideal of education as a collective achievement.
She also sets out how these roles served both whites and blacks; reminds the reader of Carver's personal and circumstantial reasons for not demurring; and reaffirms, in particular, his impact on individuals (prominent among whom was Southern radical Howard Kester--viz.
