Comprehensive Criminal Procedure, Fifth Edition is perfect for all introductory courses in criminal procedure law (including both investigation and adjudication courses, as well as comprehensive and survey courses). The casebook focuses primarily on constitutional criminal procedure law, but also covers relevant statutes and court rules. The casebook is deliberately challenging—it is designed for teachers who want to explore deeply not only the contemporary state of the law, but also its historical and theoretical foundations. The casebook incorporates a particular emphasis on empirical knowledge about the real-world impacts of law-in-action; the significance of race and class; the close relationship between criminal procedure law and substantive criminal law; the cold reality that hard choices sometimes must be made in a world of limited criminal justice resources; and, finally, the recognition that criminal procedure law always should strive to achieve both fairness to the accused and justice for society as a whole. New to the Fifth Edition: Cutting edge developments in caselaw, statutory material, and academic commentary An important reordering of certain areas of the Fourth Amendment and related materials that make them even more user-friendly Insightful examination of the turmoil in the modern Fourth Amendment cases as the Supreme Court, notably splintered over the appropriate methods of interpreting the Constitution, faces the implications of rapidly changing technology. The latest in case law, statutory material, and academic commentary about due process, the right to counsel, pretrial practice, guilty pleas, trial rights, sentencing, double jeopardy, and post-trial procedures Increased emphasis on the role of prosecutorial decision-making An updated treatment of the critical role of plea bargaining A new section on forfeitures and the Eighth Amendment Professors and students will benefit from: A rigorous and challenging criminal procedure casebook with careful presentation and editing A prestigious author team that incorporates the latest and most highly respected developments in legal scholarship in the field of criminal procedure law An appropriate balance of explanatory text and secondary material Thematic organization structured around important main themes Extensive revisions and updates A casebook that is the only criminal procedure casebook on the market today that enables students to understand the roots of the modern controversy over privacy and security in a digital age

Get back to the roots on Revelation Through the centuries since its writing, the book of Revelation has captured the fascination of the Christian church. The earliest Christians were unanimous in understanding it along a premillennial view of Jesus' second coming, but other hermeneutical approaches began to emerge in the third century. These clouded, and added complexity to, the task of explaining the book’s meaning. For most of the Christian era, consequently, many readers have viewed this last of the NT writings as though it were hopelessly embedded in an aura of deep mystery. An avalanche of interpretive literature has evidenced remarkable interest in the book’s contents, but along with the interest has come widespread bewilderment. Written especially for the informed layman, student, and scholar, this commentary seeks to clear the air. The book is interpreted according to a historical and grammatical hermeneutic and propounds a conservative, evangelical theology, but the reader will not get a narrow view on areas of disagreement. This commentary interacts with a range of major views, both evangelical and nonevangelical. It reaffirms the basic framework of eschatology espoused by ancient Christianity, but with added help from centuries of maturing thought and doctrinal progress in the Body of Christ. All exegesis and exposition in this 2-volume commentary are based on the original language of the text. Translations used are those of the author, and textual criticism and word study are included where appropriate. This in-depth commentary also includes extended excursuses on important topics of theological and historical interest.
Criminal Procedure: Investigation and Right to Counsel, Fourth Edition is derived from the successful casebook Comprehensive Criminal Procedure. Like the parent book, it covers the Fourth, Fifth, and Sixth Amendments and related areas using a thematic approach and offers an appropriate balance of explanatory text and secondary material accompanied by well-written notes. In addition to an experienced author team and well-edited cases, the book covers relevant statutes and court rules. New to the Fourth Edition: Updates regarding cutting-edge developments in case law, statutory materials, and academic commentary about due process, the right to counsel, searches and seizures, and the privilege against compelled self-incrimination An important reordering of certain areas of Fourth Amendment law and related materials to make them even more user-friendly Insightful examination of the turmoil in modern Fourth Amendment law as the Supreme Court, notably splintered over methods of constitutional interpretation, faces the implications of rapidly changing technology Professors and students will benefit from: A rigorous and challenging criminal procedure casebook with an outstanding author team Sound grounding of the law in criminal process and the right to counsel Thorough coverage of Boyd v. U.S., The Fourth Amendment, The Fifth Amendment, and the process of investigating complex crimes Thematic organization of the cases and text that make the book both manageable and accessible The latest and most highly respected developments in legal scholarship that help both professors and students alike stay up-to-date in the field of criminal procedure law
Mixed Bag is a detailed and entertaining description of how, throughout his careers, the author dealt with fear, insecurity, and self-doubt instilled during his childhood by social, economic and cultural conditions during the 1930s and 1940s in Birmingham, Alabama. Strong, insightful parents and a solid public school education equipped him to transform these obstacles into challenges and motivation for extraordinary achievement in diverse and difficult careers. These included the U.S. Air Force (Colonel, ret.), Private Industry, and Academia. He earned Masters Degrees and a Doctorate Degree from Big Ten and Ivy League Universities.
Criminal Procedures: Cases, Statutes, and Executive Materials, Sixth Edition is noted for its comprehensive coverage and excellent selection and editing of cases and materials. The book is known for its special focus on a rich selection of materials from multiple institutions, including primary materials from U.S. Supreme Court cases, state high court cases, state and federal statutes, rules of procedure, and police and prosecutorial policies, along with materials from social science studies. The new Sixth Edition retains the casebook’s engaging writing style and division of materials into “teachable chunks.” Updated cases are chosen for their contemporary accuracy and feel to complement essential cases of historical value. Taken together, the principal materials highlight procedural variety, focus on real process topics, provide the political context, and consider the impact of procedures on the various parties involved. The scholarly expertise and experience of the authors is especially reflected in the Criminal Procedure II materials, which includes coverage of prosecutorial charging, plea bargaining, and sentencing. Their frequent use of Problems gives instructors options for applying concepts and doctrines in realistic practice settings. New to the Sixth Edition: Two new authors join the editorial team: Jenia Iontcheva Turner of SMU Dedman School of Law and Kay L. Levine of Emory University School of Law. With her doctoral training in Socio-Legal Studies and her balanced experience as a prosecutor and a defense attorney in state court, Professor Levine sharpens the focus of the book on the real-world operation of courtroom actors in high-volume state systems. With her background in international criminal tribunals and comparative criminal procedure, Professor Turner strengthens the comparisons between court systems in the U.S. and those around the world. As experienced and celebrated classroom teachers, both Professors Turner and Levine bring closer attention to student learning needs in every chapter of the book. More examples and discussion demonstrate the effects of new technologies on criminal procedure. A revamped Chapter 1 offers a deeper exploration of competing models of policing and useful background about policing organizations. Reorganized Chapters 2 and 7 introduce students to the shifting analytical frameworks that the U.S. Supreme Court now employs to evaluate searches in the context of technological devices that store and collect large amounts of data. Chapter 6 relies on current newsworthy debates about police use of force to explore the alternatives and supplements to the exclusionary rule remedy. A revamped Chapter 12 surveys the major changes in the use of money bail and risk assessment algorithms, previewing the prospects for further system reforms. Chapter 13 covers newsworthy recent changes in the charging policies and diversion practices of prosecutors’ offices, especially those in urban areas such as Philadelphia. Chapter 17 expands its coverage of the tensions between fair trials and public trials, including new materials on public access to court files and statistics. A refocused Chapter 19 provides a more detailed and vivid portrait of sentencing hearings and the use of risk assessment instruments. Professors and students will benefit from: Materials that support class discussion, including criminal court actors beyond the Justices of the U.S. Supreme Court: the vision is “street level federalism” Materials that portray for students the range of current practices in criminal justice rather than a rushed historical narrative about doctrinal trends A supporting website that offers exemplar documents from legal practice, recent news with relevance for criminal procedure, and brief video lectures to introduce each major unit Emphasis on high-volume practical issues in criminal procedure instead of intricate but rarely-encountered questions Intuitive organization—tracking the typical sequence of events in criminal investigations and in the criminal courts—that makes it easy to see connections among different areas of the law
This study is the culmination of seven years research into the Carved Stone Balls of Late Neolithic Scotland. Diagnosis and correction are critical tasks for the vibrations engineer. Many causes of rotor vibration are so subtle and pervasive that excessive vibration continues to occur despite the use of usually effective design practices and methods of avoidance. Rotating Machinery Vibration: From Analysis to Troubleshooting provides a comprehensive, consolidated overview of the fundamentals of rotating machinery vibration and addresses computer model building, sources and types of vibration, and machine vibration signal analysis. This reference is a powerful tool to strengthen vital in-house competency on the subject for professionals in a variety of fields. After presenting governing fundamental principles and background on modern measurement, computational tools, and troubleshooting methods, the author provides practical instruction and demonstration on how to diagnose vibration problems and formulate solutions. The topic is covered in four sequential sections: Primer on Rotor Vibration, Use of Rotor Dynamic Analyses, Monitoring and Diagnostics, and Troubleshooting Case Studies. This book includes comprehensive descriptions of vibration symptoms for rotor unbalance, dynamic instability, rotor-stator rubs, misalignment, loose parts, cracked shafts, and rub-induced thermal bows. It is an essential reference for mechanical, chemical, design, manufacturing, materials, aerospace, and reliability engineers. Particularly useful as a reference for specialists in vibration, rotating machinery, and turbomachinery, it also makes an ideal text for upper-level undergraduate and graduate students in these disciplines.
The fifth volume in the popular NEW AMERICAN COMMENTARY STUDIES IN BIBLE & THEOLOGY series argues that gospel writer Luke is also the author of Hebrews.

For over 350 million years, thousands of species of amphibians have lived on earth, but since the 1990s they have been disappearing at an alarming rate, in many cases quite suddenly and mysteriously. What is causing these extinctions? What role do human actions play in them? What do they tell us about the overall state of biodiversity on the planet? In Extinction in Our Times, James Collins and Martha Crump explore these pressing questions and many others as they document the first modern extinction event across an entire vertebrate class, using global examples that range from the Sierra Nevada of California to the rainforests of Costa Rica and the Mediterranean coast of North Africa. Joining scientific rigor and vivid storytelling, this book is the first to use amphibian decline as a lens through which to see more clearly the larger story of climate change, conservation of biodiversity, and a host of profoundly important ecological, evolutionary, ethical, philosophical, and sociological issues.

Son Of The Red Earth" is based on a story told to me in 1967. The story centers around the life of young Jorney Wilson. Starting in the early 1930s, Jorneys story is about the harsh reality of living with an alcoholic, abusive father and his struggle to keep skin and bones together for the both of them. Sold off to a neighboring farmer for the sum of fifty dollars, Jorney vows not to take another beating. He finds he has to fight back to keep that very thing from happening. With Silas Baldwin down on the ground and maybe dead, Jorney flees to a life of running and hiding, always just one step ahead of the law. From working for the Civilian Conservation Corps (C.C.C.) to running moonshine whisky, Jorney finds a way to get by and makes some lasting friendships along the way. When he finds the girl of his dreams, it seems everything is going to work out alright after all. But then Carl Betterman of the Bureau of Criminal Investigation (BOCI) manages to capture him with a truck load of moonshine whisky. When he finds himself on trial for murder, the darkest days of his young life are ahead of him. Jorney Wilson was truly born of the red earth, thus the title of this book. Follow him as he tries to make a life for himself and find justice and vindication for a crime he didnt commit. Share his adventures as he roams the countryside and helps make history in the young and growing state of Oklahoma. Sit with him in the dark cells of the Atoka County Jail as he awaits his trial for murder. Live with him as he fights to be free as a Son of the Red Earth.

Does government fraud, waste, abuse, and corruption make your blood boil? In The Art of the Watchdog, Daniel L. Feldman and David R. Eichenthal show how to fight back. Based on their own work in federal, state, and local government over the last forty years, they will arm you with the tools and techniques needed to put the spotlight on those who cheat and steal from the public or who squander valuable taxpayer dollars through waste and inefficiency. At the same time, Feldman and Eichenthal outline what they see as the good and the bad of current oversight efforts based on case studies from across the nation. Ultimately their goal is to ensure that the "art of the watchdog" does not become a lost one and to improve the quality and integrity of government and strengthen democracy.
A comprehensive and state-of the-art overview from internationally-recognized experts on white-collar crime covering a broad range of topics from many perspectives Law enforcement professionals and criminal justice scholars have debated the most appropriate definition of “white-collar crime” ever since Edwin Sutherland first coined the phrase in his speech to the American Sociological Society in 1939. The conceptual ambiguity surrounding the term has challenged efforts to construct a body of science that meaningfully informs policy and theory. The Handbook of White-Collar Crime is a unique re-framing of traditional discussions that discusses common topics of white-collar crime—who the offenders are, who the victims are, how these crimes are punished, theoretical explanations—while exploring how the choice of one definition over another affects research and scholarship on the subject. Providing a one-volume overview of research on white-collar crime, this book presents diverse perspectives from an international team of both established and newer scholars that review theory, policy, and empirical work on a broad range of topics. Chapters explore the extent and cost of white-collar crimes, individual- as well as organizational- and macro-level theories of crime, law enforcement roles in prevention and intervention, crimes in Africa and South America, the influence of technology and globalization, and more. This important resource: Explores diverse implications for future theory, policy, and research on current and emerging issues in the field Clarifies distinct characteristics of specific types of offences within the general archetype of white-collar crime Includes chapters written by researchers from countries commonly underrepresented in the field Examines the real-world impact of ambiguous definitions of white-collar crime on prevention, investigation, and punishment Offers critical examination of how definitional decisions steer the direction of criminological scholarship Accessible to readers at the undergraduate level, yet equally relevant for experienced practitioners, academics, and researchers, The Handbook of White-Collar Crime is an innovative, substantial contribution to contemporary scholarship in the field.
Flatlined lifts the veil of secrecy on twenty-first century health care and delves into the realities of good people caught in a bad medical system. Dr. Guy L. Clifton, a practitioner as well as a policy advocate, reveals first-hand accounts of needless tragedy, such as the young man who died after a car wreck for lack of a bed in a qualified hospital and the surgeon who was dejected by the scarcity of resources needed to enable him to perform heart surgery on an uninsured man. Arguing that a lack of coordinated care and quality medical practice benchmarks result in high levels of redundancy and ineffectiveness, Clifton proposes that the key to reducing health care costs, improving quality, and financially protecting the uninsured, is to reduce wastefulness, and offers a solution for achieving success. Flatlined sounds the warning call: By 2018 Medicare and Medicaid will consume about one-third of the federal budget. American businesses now pay three times as much of their payroll for health care as global competitors, expected to worsen as health care grows at twice the rate of the U.S. economy. Based on his years of experience in policy and medicine, Clifton offers an attainable solution through the development of an American Medical Quality System.
Clan, King and Covenant explores the turbulent history of the Highlands during the seventeenth century. The signing of the National Covenant in 1638 first challenged the powers of Charles I in Scotland, but it was only when Alisdair MacDonald joined Montrose in raising the Royalist clans that the country erupted into civil war. Central to the conflict was the ancient enmity between the MacDonalds and the Campbells, Earls of Argyll, as clan Donald attempted to reclaim their ancestral lands in Argyll. There followed a whirlwind year of spectacular victories for Montrose in the name of the King as the Highland clans emerged upon the national stage, before his campaign subsided into eventual defeat. However it was only after the Restoration of Charles II that a bitter and protracted struggle broke out between Church and Crown, after Bishops were reappointed to the national Church. Political and religious tensions mounted with the acession of James VII of Scotland (James II of England) as a Catholic king ruling over a predominantly Presbyterian people. It reached a climax in the outbreak of the Highland War, when Viscount Dundee won a devastating victory at Killiecrankie on behalf of James VII over the Presbyterian forces of Lowland Scotland, but at the cost of his own life. Subsequently the Crown imposed an uneasy peace upon the Highlands, after the cold-blooded plotting of 'murder under trust' culminated in the Glencoe Massacre. Condoned by William of Orange, few events in the blood-stained history of the Highland clans have quite the dreadful resonance of this act, carried out cynically as a matter of public policy. Also available by the same author: Lost Kingdoms and Feuds, Forays and Rebellions (both Edinburgh University Press)

American Indian English documents and examines the diversity of English in American Indian speech communities. It presents a convincing case for the fundamental influence of ancestral American Indian languages and cultures on spoken and written expression in different Indian English codes. A distillation of over twenty years' research, this pioneering work explores the linguistic and sociolinguistic characteristics of English language use among members of Navajo, Hopi, Mojave, Ute, Tsimshian, Kotzebue, Ponca, Pima, Lakota, Cheyenne, Laguna, Santa Ana, Isleta, Chilcotin, Seminole, Cherokee, and other American Indian tribes. American Indian English fills numerous gaps in existing studies of language histories, Indian student school experience, Indian-white contact, and "acculturation." Unlike contemporary studies on schooling, ethnicity, empowerment, and educational failure, American Indian English avoids postmodernist jargon and discourse strategies in favor of direct description and commentary. Data are derived from conditions of real-life experience faced by speakers of Indian English in various English-speaking settings. This practical focus enhances the book's accessibility to Indian educators and community-based teachers, as well as non-Indian academics.
The United States Marine Corps has a unique culture that ensures comradery, exacting standards, and readiness to be the first to every fight. Yet even in a group that is known for innovation, culture can push leaders to fall back on ingrained preferences. Jeannie L. Johnson takes a sympathetic but critical look at the Marine Corps's long experience with counterinsurgency warfare. Which counterinsurgency lessons have been learned and retained for next time and which have been abandoned to history is a story of battlefield trial and error—but also a story of cultural collisions. The book begins with a fascinating and penetrating look inside the culture of the Marine Corps through research in primary sources, including Marine oral histories, and interviews with Marines. Johnson explores what makes this branch of the military distinct: their identity, norms, values, and perceptual lens. She then traces the history of the Marines' counterinsurgency experience from the expeditionary missions of the early twentieth century, through the Vietnam War, and finally to the Iraq War. Her findings break new ground in strategic culture by introducing a methodology that was pioneered in the intelligence community to forecast behavior. Johnson shows that even a service as self-aware and dedicated to innovation as the Marine Corps is constrained in the lessons-learned process by its own internal predispositions, by the wider US military culture, and by national preferences. Her findings challenge the conclusions of previous counterinsurgency scholarship that ignores culture. This highly readable book reminds us of Sun Tzu's wisdom that to be successful in war, it is important to know thyself as well as the enemy. This is a must-read for anyone interested in the Marines Corps, counterinsurgency warfare, military innovation, or strategic culture.

This book offers a clear, accessible account of the American litigation over the restitution of works of art taken from Jewish families during the Holocaust. For the past two decades, the courts of the United States have been an arena of conflict over this issue that has recently captured widespread public attention. In a series of cases, survivors and heirs have come forward to claim artworks in public and private collections around the world, asserting that they were seized by the Nazis or were sold under duress by owners desperate to escape occupied countries. Spanning two continents and three-quarters of a century, the cases confront the courts with complex problems of domestic and international law, clashes among the laws of different jurisdictions, factual uncertainties about the movements of art during and after the war, and the persistent question whether restitution claims have been extinguished by the passage of time.Through individual case studies, the book examines the legal questions these conflicts have raised and the answers the courts have given. From the internationally celebrated “Woman in Gold” lawsuit against Austria to lesser-known claims against Germany, Hungary, Spain, and museums and private collections in the United States, the book synthesizes the legal and evidentiary materials and judicial rulings in each case, creating a coherent narrative of proceedings that are often labyrinthine in complexity. Written by a leading authority on litigation and procedure, the book will be of interest to readers in various fields of the humanities and social sciences as well as law, and to anyone interested in the fate of artworks that have been called the “last prisoners” of the Second World War.
