Why did it take so long for American law schools to start teaching about climate change? Although most environmental law professors were aware of climate change by 1990, it took nearly fifteen years for them to incorporate the topic into their curriculum. In her innovative new work, Kimberly K. Smith explores how American environmental law professors have addressed climate change, identifying the barriers they faced, how they overcame them, and how they created “climate law” as a domain of legal specialization. Making Climate Lawyers explores the history of why American law schools were resistant to teaching about climate change and how that changed over the course of a forty-year period, resulting in law schools across the country incorporating climate change into their curricula, with many even establishing centers on the environment. Smith challenges dominant explanations of why the United States was slow to develop climate policy: it wasn’t just political opposition or short-sightedness. Creating climate legal professionals required changing the fundamentals of legal education. Based on dozens of interviews with faculty and students, Making Climate Lawyers fills a gap in the literature on the intellectual history of climate change, most of which focuses on the history of climate science. Smith focuses instead on how the climate problem fits (or doesn’t fit) into the structure of American law. She uses this story as a lens through which to understand both the transformation of legal education since the 1980s and the nature of climate change as a policy problem.
Warlords are individuals who control small territories within weak states, using a combination of force and patronage. In this book, Kimberly Marten shows why and how warlords undermine state sovereignty. Unlike the feudal lords of a previous era, warlords today are not state-builders. Instead they collude with cost-conscious, corrupt, or frightened state officials to flout and undermine state capacity. They thrive on illegality, relying on private militias for support, and often provoke violent resentment from those who are cut out of their networks. Some act as middlemen for competing states, helping to hollow out their own states from within. Countries ranging from the United States to Russia have repeatedly chosen to ally with warlords, but Marten argues that to do so is a dangerous proposition. Drawing on interviews, documents, local press reports, and in-depth historical analysis, Marten examines warlordism in the Pakistani tribal areas during the twentieth century, in post-Soviet Georgia and the Russian republic of Chechnya, and among Sunni militias in the U.S.-supported Anbar Awakening and Sons of Iraq programs. In each case state leaders (some domestic and others foreign) created, tolerated, actively supported, undermined, or overthrew warlords and their militias. Marten draws lessons from these experiences to generate new arguments about the relationship between states, sovereignty, "local power brokers," and stability and security in the modern world.

Refusing to hold hearings or confirm the nominee of a Democratic president almost a year away from a presidential election, the Republican-controlled Senate held the court hostage, forcing it to do its work through nearly the entire term ending in June 2017 with just eight justices. In American Justice 2017: The Supreme Court in Crisis, Kimberly Robinson examines the way individual justices and the institution as a whole reacted to this unprecedented, politically fraught situation. In public, the justices put on brave faces, waiting for the confirmation battle to play itself out, while indicating in occasional statements that the court would muddle through just fine. In private, though, things appear to have been more complicated. Narrow decisions, lackluster choice of cases, and odd bedfellows teaming up on the same sides of opinions and dissents give us a hint of the strenuous effort the eight justices made to uphold the integrity of the institution in the face of hurricane-force partisan gales.
Learning and Not Learning in the Heritage Language Classroom, a critical ethnography, describes the first year of a teacher-founded charter high school and presents a case-study of compulsory Spanish heritage language instruction with two Spanish-language teachers, one English dominant and the other Spanish dominant. The study follows the same cohort of Mexican-origin students to their humanities-English class, bringing into focus what works and what does not with this group of learners. Unlike many Spanish heritage language studies, the students in this book did not choose to take part in Spanish class and thus provide unusually raw feedback on their teachers and classes. The engagement and resistance of these students suggests pedagogical directions for engaging Spanish heritage language learners. The modern, centralized American state was supposedly born in the Great Depression of the 1930s. Kimberley S. Johnson argues that this conventional wisdom is wrong. Cooperative federalism was not born in a Big Bang, but instead emerged out of power struggles within the nation's major political institutions during the late nineteenth and early twentieth centuries. Examining the fifty-two years from the end of Reconstruction to the beginning of the Great Depression, Johnson shows that the "first New Federalism" was created during this era from dozens of policy initiatives enacted by a modernizing Congress. The expansion of national power took the shape of policy instruments that reflected the constraints imposed by the national courts and the Constitution, but that also satisfied emergent policy coalitions of interest groups, local actors, bureaucrats, and members of Congress. Thus, argues Johnson, the New Deal was not a decisive break with the past, but rather a superstructure built on a foundation that emerged during the Gilded Age and the Progressive Era. Her evidence draws on an analysis of 131 national programs enacted between 1877 and 1930, a statistical analysis of these programs, and detailed case studies of three of them: the Federal Highway Act of 1916, the Food and Drug Act of 1906, and the Sheppard-Towner Act of 1921. As this book shows, federalism has played a vital but often underappreciated role in shaping the modern American state.
