An historical analysis of the development and reform of the law of prior obligations as expressed in preexisting duty rule and past consideration rule. Teeven's principal focus is on the judicial rationalization of common law reforms to partially remove the bar to enforcement of promises grounded in the past. This study traces American deviations from English common law doctrine over the past two centuries in developing theories to overcome traditional impediments to recovery presented by the law of prior obligations. It also explores ideas for further reforms found buried in past case law. The growing unease with both the dashing of legitimate consensual expectations and the perceived unfairness to naive, ill-informed, and otherwise disadvantaged parties served as the impetus for liberalization of the exclusive contract bargain test. The resultant reforms adhered to the modern realist emphasis on fairness. The expansion of contractual liability to include promises looking to the past encompasses some of the most important reforms of the consideration contract since its genesis. As a consequence, contractual liability can no longer be defined solely in terms of bargain consideration since contract law now includes a broader range of promissory liability.

Americans have fought two prolonged battles over Vietnam—one in southeast Asia and one, ongoing even now, at home—over whether the war was unnecessary, unjust, and unwinnable. Revisionist historians who reject this view have formulated many contra-factual scenarios for how the war might have been won, but also put forward one historically testable hypothesis—namely that the war actually was won after the 1968 Tet Offensive, only to be thrown away later through a failure of political will. It is this “Lost Victory” hypothesis that Kevin M. Boylan takes up in Losing Binh Dinh, aiming to determine once and for all whether the historical record supports such a claim. Proponents of the “Lost Victory” thesis contend that by 1972, President Richard Nixon's policy of “Vietnamization” had effectively eliminated South Vietnamese insurgents, “pacified” the countryside, and prepared the South Vietnamese to defend their own territory with only logistical and financial support from Americans. Rejecting the top-down approach favored by Revisionists, Boylan examines the facts on the ground in Binh Dinh, a strategically vital province that was the second most populous in South Vietnam, controlled key transportation routes, and contained one of the nation's few major seaports as well as the huge US Air Force base at Phu Cat. Taking an in-depth look at operations that were conducted in the province, Boylan is able to uncover the fundamental flaw in the dual objectives of “Vietnamization” and “Pacification”—namely, that they were mutually exclusive. The inefficiency and corruption of the South Vietnamese government and armed forces was so crippling that progress in pacification occurred only when Americans took the lead—which, in turn, left the South Vietnamese even more dependent on US support.

In Of One Mind and Of One Government Kevin Kokomoor examines the formation of Creek politics and nationalism from the 1770s through the Red Stick War, when the aftermath of the American Revolution and the beginnings of American expansionism precipitated a crisis in Creek country. The state of Georgia insisted that the Creeks sign three treaties to cede tribal lands. The Creeks objected vigorously, igniting a series of border conflicts that escalated throughout the late eighteenth century and hardened partisan lines between pro-American, pro-Spanish, and pro-British Creeks and their leaders. Creek politics shifted several times through historical contingencies, self-interests, changing leadership, and debate about how to best preserve sovereignty, a process that generated national sentiment within the nascent and imperfect Creek Nation. Based on original archival research and a revisionist interpretation, Kokomoor explores how the state of Georgia's increasingly belligerent and often fraudulent land acquisitions forced the Creeks into framing a centralized government, appointing heads of state, and assuming the political and administrative functions of a nation-state. Prior interpretations have viewed the Creeks as a loose confederation of towns, but the formation of the Creek Nation brought predictability, stability, and reduced military violence in its domain during the era.

Yet his fervor was not always appreciated by those for whom he advocated, and some of his more unpopular stands made him a polarizing figure within the Latino community. Carlos Blanton has published the first biography of this complex man of notable contradictions. The author honors Sánchez’s efforts, hitherto mostly unrecognized, in the struggle for equal opportunity, while not shying away from his subject’s personal faults and foibles.
