This book examines the history of sexual harassment in America's public places, such as on the streets and on public transit vehicles, in the period 1880 to 1930. Such behavior was referred to then as mashing with the harasser most commonly being called a masher. It began around 1880 as a response to the women's movement as females in America increased their efforts to gain more freedom of movement and greater independence. Women going out and about on their own, or only with other women, threatened male dominance and control of society. One response by men was to turn to the sexual harassment of those women when they were alone in public places. This book looks at the extent of the problem, editorial opinions on the subject, the tendency to blame the victim, and the responses of women in the streets to the harassment. As well, the actions and reactions of the courts and the actions and reactions of the police are studied. Much of the sexual harassment of this period took place in the daytime hours, in busy areas of cities.

When the need for telephone operators arose in the 1870s, the assumption was that they should all be male. Wages for adult men were too high, so boys were hired. They proved quick to argue with the subscribers, so females replaced them. Women were calmer, had reassuring voices and rarely talked back. Within a few years, telephone operators were all female and would remain so. The pay was low and working conditions harsh. The job often impaired their health, as they suffered abuse from subscribers in silence under pain of dismissal. Discipline was stern--dress codes were mandated, although they were never seen by the public. Most were young, domestic and anything but militant. Yet many joined unions and walked picket lines in response to the severely capitalistic, sexist system they worked under.

An aesthetic perspective on the short fiction of Chekhov, Joyce, Hemingway, O'Connor, and Carver Taking a distinctively aesthetic approach to the genre of realist short fiction, Kerry McSweeney clusters the work of five masters--Anton Chekhov, James Joyce, Ernest Hemingway, Flannery O'Connor, and Raymond Carver--to offer a poetics of the form for students and scholars. At the center of this argument is the notion that the realist short story is a glimpse--powerful and tightly focused--into a world that the writer must precisely craft and in which the reader must fully invest. Selecting writers from different generational, national, and cultural backgrounds, McSweeney chooses writers based on their commitment to the realist representation of experience and their shared belief in the importance and efficacy of the short story form. By considering their efforts in tandem, he develops a means to assess the strategies and claims of realist short fiction. McSweeney demonstrates that when the comments these writers have made about their work are assembled and critically scrutinized, the result is an aesthetic critical model--as opposed to more interpretative models that focus attention on the determination (or indetermination) of meanings. He suggests that a fully adequate reading of a realist short story involves the integration of three components: the enjoyment and contemplation of the story in and of itself; affective receptivity, or a response to the story's emotional content; and cognitive activity, or the reflective consideration of the story's conceptual implications. In individual chapters on Chekov, Joyce, Hemingway, O'Connor, and Carver, this presentational model is applied to widely known and often anthologized readings from each writer. McSweeney brings into sharp focus the distinctive features of each piece, makes qualitative discriminations, and assesses the profitability of other critical models. He concludes with an invitation to test the mettle of his approach in reading other realist short story writers.

Vernon D Plueckhahn was for many years Australia’s most prominent forensic pathologist. His expertise was central in correcting some of Australia’s worst miscarriages of justice, most notably the wrongful 1982 conviction of Lindy Chamberlain for murder. This book traces his life, of first serving on a hospital ship for four years in World War II, then becoming a doctor, and then from a small base as the first pathologist at Geelong Hospital becoming known nationally and internationally. He led the way in forensic pathology – in research, for example, to validate autopsy measurement of blood alcohol and then linking alcohol misuse and drowning. He was instrumental in transforming the small regional hospital of Geelong into a leading academic centre. He steered the Royal College of Pathologists of Australasia through turbulent times in the 1970s. His achievements were quite remarkable, with the greatest being the formation of the Victorian Institute of Forensic Medicine, which is now a world leading institution.

This book examines the interface between religion, charity law and human rights. It does so by treating the Church of England and its current circumstances as a timely case study providing an opportunity to examine the tensions that have now become such a characteristic feature of that interface. Firstly, it suggests that the Church is the primary source of canon law principles that have played a formative role in shaping civic morality throughout the common law jurisdictions: the history of their emergence and enforcement by the State in post-Reformation England is recorded and assessed. Secondly, it reveals that of such principles those of greatest weight were associated with matters of sexuality: in particular, for centuries, family law was formulated and applied with regard for the sanctity of the heterosexual marital family which provided the only legally permissible context for any form of sexual relationship. Thirdly, given that history, it identifies and assesses the particular implications that now arise for the Church as a consequence of recent charity law reform outcomes and human rights case law developments: a comparative analysis of religion related case law is provided. Finally, following an outline of the structure and organizational functions of the Church, a detailed analysis is undertaken of its success in engaging with these issues in the context of the Lambeth Conferences, the wider Anglican Communion and in the ill-fated Covenant initiative. From the perspective of the dilemmas currently challenging the moral authority of the Church of England, this book identifies and explores the contemporary ‘moral imperatives’ or red line issues that now threaten the coherence of Christian religions in most leading common law nations. Gay marriage and abortion are among the host of morally charged and deeply divisive topics demanding a reasoned response and leadership from religious bodies. Attention is given to the judicial interpretation and evaluation of these and other issues that now undermine the traditional role of the Church of England. As the interface between religion, charity law and human rights becomes steadily more fractious, with religious fundamentalism and discrimination acquiring a higher profile, there is now a pressing need for a more balanced relationship between those with and those without religious beliefs. This book will be an invaluable aid in starting the process of achieving a triangulated relationship between the principles of canon law, charity law and human rights law.
